检察官职务独立性之研习

检察官的职务独立性能够保证检察官处理司法事务的纯正性。以检察官的法律定位和检察组织体系内部的权力配置方式为视角,考察现代主要法治国家和地区的检察官制度,保障检察官职务独立性的制度设计的重要意义就会显现。检察官职务独立性能够作为主诉检察官制度的理论基础,对其进行研习能够为主诉检察官制度的进一步发展起到理论指导作用。     

多中心治理：一种公共服务的协同供给方式

本文从协同理论的视角来解释公共服务供给主体的选择标准，认为最优的公共服务供给方式的选择和主体边界的确定取决于公共服务的性质。通过研究政府、市场、非营利组织的非线性的相互协调、共同作用，来实现组织智慧和各种资源的有机整合和系统建构，从而达到明显推进城乡公共服务均等化的目的。     

PARTICIPANTS’ EVALUATIONS OF ASPECTS OF THE LEGAL CHILD CUSTODY PROCESS AND PREFERENCES FOR COURT SERVICES

Domestic relations courts continue to experience large caseloads. As the volume of cases in which families are in crisis continues to grow, policy makers, practitioners, judges, and attorneys struggle to meet the growing demand and seek more effective ways to address the needs and issues of those who are engaged in child custody processes. The present study provides an examination of parent attitudes concerning various aspects of the legal process and preferences concerning a variety of court‐based family services and interventions.     

INSTITUTIONALIZATION OF MEDIATION

Mediation has evolved, grown, and been accepted within our society from preschools to doctoral programs and in courts, legislatures, and private industry. The passage of the Uniform Mediation Act, the birth of the Association of Conflict of Resolution, and the involvement of government bodies in the regulation of mediators indicate the importance of the institutionalization of mediation within every aspect of our society. This article focuses on a few of the hot issues currently swirling in the field raising questions for practitioners, researchers, and others involved in shaping access to conflict resolution policy and the future of the mediation profession.     

我国养老产业发展面临的现实困境及其破解

当下,我国已经步入老龄化社会且老龄化程度正在持续上升,老年人口在给养老产业发展带来新机遇的同时也对我国传统养老服务改善升级提出了新的要求.通过客观分析我国养老产业发展面临的现实困境,本文认为,进一步发展养老产业,应注重宏观政策的延续性和协调性,发展模式应满足需求的多样性和融合性,加强养老产业人才队伍建设.     

Location privacy: The challenges of mobile service devices

Adding to the current debate, this article focuses on the personal data and privacy challenges posed by private industry's use of smart mobile devices that provide location-based services to users and consumers. Directly relevant to personal data protection are valid concerns about the collection, retention, use and accessibility of this kind of personal data, in relation to which a key issue is whether valid consent is ever obtained from users. While it is indisputable that geo-location technologies serve important functions, their potential use for surveillance and invasion of privacy should not be overlooked. Thus, in this study we address the question of how a legal regime can ensure the proper functionality of geo-location technologies while preventing their misuse. In doing so, we examine whether information gathered from geo-location technologies is a form of personal data, how it is related to privacy and whether current legal protection mechanisms are adequate. We argue that geo-location data are indeed a type of personal data. Not only is this kind of data related to an identified or identifiable person, it can reveal also core biographical personal data. What is needed is the strengthening of the existing law that protects personal data (including location data), and a flexible legal response that can incorporate the ever-evolving and unknown advances in technology.     

行政服务中心: 发展、 问题与对策

作为打造服务型政府,推动行政审批体制改革的载体行政服务中心因缺乏行政主体地位、权限设定混乱、信息不透明、监督缺位,导致其不能发挥应有的作用.所以,要通过赋予行政服务中心应有地位、实施相对集中的行政许可权制度、增加信息透明度、完善监督机制等措施,进一步发挥行政服务中心的职能作用.     

论保安的社会控制功能

作为一种社会控制的工具和手段,保安主要通过预防犯罪、对违法行为和危机事件的快速反应、弥补警力不足、收集和共享情报、影响人们的安全观和适应非传统安全的发展等方式实现其社会控制功能;保安既有社会控制的优越性,也有其不可避免的局限性,这种局限性主要体现在:保安对公众场所的大量控制会削弱正式控制力量、人员素质的参差不齐影响控制效果、公众对保安的负面认识影响社会控制的执行力。认识保安的社会控制功能及其作用机制,正视保安的社会控制功能的局限性及其对社会控制的消极影响,更有利于实现社会控制,有助于促进社会的和谐发展。     

When trade unions succeed: Cases of blocked liberalisation in the common market

Despite the generally accepted weakness of trade unions at the European Union level, an analysis of two high profile cases – the Services Directive and the Port Directive – shows that trade unions are able to mobilise effectively at the European level and, within constellations of actors, crucially impact EU decision making. In contrast to common claims that a lack of access to EU institutions makes such groups powerless, it is argued here that the exclusion of large opposing societal groups from consultations is neither a quick nor a sure fire recipe for dismantling opposition. On the contrary, it politicises the process and may lead to opposing groups mobilising in more contentious ways.     

Development of E-Governance and Electronic Services in Ministry of Finance

Over the last two decades, government has made essential changes in order to improve public administration functioning. These changes were driven by a new government philosophy. The key concept in this new public policy is to connect information society, and public administration. In this context, the purpose of this study is through analyzing the process of computerization of public administration to determine the specific services provided electronically to the National Revenue Agency （NRA） in Ministry of Finance. Ministry of Finance and NRA are the administrative bodies that are reformed significantly in this field. E-governance is a political concept and philosophy which includes principles and the public administration working mechanism. E-government is electronic services provision platform that uses information and communication technology. The extensive monitoring and analysis lead to conclusions in two key areas--legal and technical organization. The lack of consistency between governments and the total reorganization of some areas of the state causes difficulties in implementing cyber plan in administrative services. There are other essential weaknesses that corrupt the system electronic reforms. It is important to be created a digital broadband market in Bulgaria. This will integrate the network systems of Bulgarian official institutions in a common electronic network.
