China＇s Labor Contract Law and the liberalization of global markets： Will employees＇ rights equate to employers＇ nightmares？

Lower labor costs and realization of profits have been key components in the expansion of the global market. As we continue to witness the prolific liberalization of the global market, it is essential that we remember the importance of human capital. Workers play a paramount role in the realization of continued and sustained global market growth. Paradoxically, sustained growth in the global market is also fueled by the absence of workers＇ rights and the resulting reduction of labor costs. Thus, multi-national companies and workers employed by multi-national companies, have encountered a seeming contradiction of workplace realities. From a capitalistic economic perspective, it is necessary for multi-national companies to compete for market share and realize profits. However, in order to promote social harmony and ensure against large-scale social unrest, workers must be given basic rights ensuring economic security and workplace justice. China has enacted the Labor Contract Law to address challenges surrounding these issues. This paper will discuss the efficacy of China＇s embracing the rule of law so as to effectively enforce the Labor Contract Law. The paper will also give an overview of the concepts forming the foundation of the rule of law. Further, the paper will offer a brief comparative analysis of the United States＇ use of the rule of law in relation to resolving post-slavery labor issues. Finally, the paper will recommend a model system for use by China in enforcing the Labor Contract Law.

新修改的《公司法》在相关理论和实践发展的基础上,突破了股东治理结构的局限性,改变了职工民主权利从属于资本的划分标准,规定了在所有的公司制企业都实行以职工代表大会为基本形式的民主管理。明确规定公司的职工董事和职工监事制度,极大地推进了职工参与公司治理制度的深化和规范化。

Learning,Negotiating, and Surviving in Child Welfare: Social Capitalization Among Recently Hired Workers

In the child welfare workplace, accessible relationships and support, although understudied, are vital to worker success. Using telephone interviews with a statewide sample of recently hired, frontline workers (N = 38), this study applied a social capital framework to consider support functionality or capitalization. Findings highlight that, although nearly all workers recognized the importance of instrumental and expressive support, many workers did not capitalize on support. Agencies may benefit from an atmosphere focused on collective interests rather than individual survival. Policy can promote supportive atmospheres through providing agencies with the ability and time to foster recently hired workers’ skills.     

In Search of the Holy Grail in Public Service: A Study on the Mediating Effect of Public Service Motivation on Organizational Politics and Outcomes

ABSTRACT

There appears to be a research gap in terms of examining whether PSM will hold fast even in the midst of a politically charged work environment. This article investigates how highly motivated government employees would react to the potentially adverse effects of political perception (POP) on organizational commitment, job satisfaction and workplace stress. The findings indicated that PSM exists among the respondent municipal social workers in the Philippines and that this motivation directly translates to positive outcomes. However, PSM did not have the expected mediating effect which is a departure from the commonly held view about its buffering power and mitigating role.
