18世纪末至20世纪初吧城华人社会房屋租赁问题研究——以《公案簿》第1-14辑资料为中心

18世纪末到20世纪初,不断到吧城的华人新客给当地房屋租赁市场带来潜在商机,一些具有投资意识的商人、宗族负责人和少数土著等群体开始涉足房屋租赁行业,出租房屋赚取租金。吧城华人大多限于资金而选择租房自住或做商铺,租房程序较为简单,大致包括租赁双方协商议定房租、签订合约,有时也会由中间商居间沟通达成租房协议。为了保证租房收益,房屋所有者会采取交纳押金、约定租期和交租方式、指定收租代理人以及申请吧国公堂调解等方式来控制经营风险。

从20世纪初期10年日本青年流行语的情况考察,流行语创造者的权威性或社会声望是导致某一词语广为人们仿效的决定性因素。流行语所反映或表征的对象往往是某一时期社会关注的热点问题或现象。流行语本身对有关现象的生动刻画,以及在使用过程中造成的幽默、娱乐的效果等因素,也是一些词语得以在某一时期流行的原因。     

武汉汉族人群D20S85和D6S477基因座遗传多态性调查

目的对武汉地区280名汉族无关个体的D20S85和D6S477位点遗传多态性进行调查,研究其在法医学检验中的应用价值。方法应用PCR和PAGE技术进行分型检验。结果分别检出10个、9个等位基因,获得各等位基因在该地区汉族人群分布频率,基因型频率分布符合Hardy-Weinberg平衡。两位点的DP值分别为0.9085、0.9127。结论D20S85和D6S477是法医学中重要的遗传标记。

在20世纪上半叶,学界对中国少数民族艺术的研究可以划分为3个时期:1900至1919年为萌芽时期,中国少数民族艺术研究的视野开始展开;1920至1937年为奠基时期,中国少数民族艺术研究的理论方法基本确立;1938至1949年为发展时期,中国少数民族艺术研究的规范化得到进一步推进。     

G20 institutional transition and global tax governance

The G20 is in transition from a short-term crisis institution to long-term steering institution, adopting a new ‘G20 + established international organization’ governance approach. In this approach, the main role of the G20 is to set the agenda and build political consensus for global economic governance. The established international organization provides the technical support and facilitates proposal implementation, while the precondition for the G20 institutional transition is that the emerging economies need to participate on an equal footing with the advanced economies. The case of global tax governance is among the few success stories of the G20's institutional transition. Within the ‘G20 + OECD’ governance architecture, the G20 builds the political consensus that the profits should be taxed where they are performed, while the OECD proposes the technical Base Erosion and Profit Shifting Action Plan. In this way, the G20's political leadership and the OECD's technical advantage complement each other, making a giant leap in global tax governance.     

Zu den Pflichten des Immobilienverwalters bei rechtsgeschäftlicher Beendigung des Verwaltungsverhältnisses

Im Zusammenhang mit der Beendigung des Verwaltungsverh?ltnisses und der damit einhergehenden Notwendigkeit einer Verwaltungsübergabe stellt sich eine Reihe rechtlicher Fragen, deren Beantwortung sich nicht ohne weiteres aus den Bestimmungen des ABGB über den Bevollm?chtigungsvertrag bzw aus den speziellen Verwaltungsbestimmungen des WEG erschlie?t. Angesichts der in der Praxis im Zuge der Verwaltungsübergabe doch sehr h?ufigen – weder dem Interesse der Auftraggeber noch dem Ansehen des Berufsstandes des Immobilienverwalters f?rderlichen – Auseinandersetzungen zwischen den beteiligten Personen (Liegenschaftseigentümer bzw Eigentümergemeinschaft, übergebender Verwalter, übernehmender Verwalter), die bisweilen vor dem Hintergrund diffuser Rechtsmeinungen geführt werden, ist eine n?here Untersuchung1) des für die "Verwaltungsübergabe" relevanten rechtlichen Rahmens durchaus angebracht.     

Wirksamkeit einer Beschlussfassung bei anonymer Stimmabgabe und Auszählung durch einen Notar

Die Enthebung und Bestellung des Verwalters geh?rt zu jenen Rechtsgesch?ften, die gem § 24 Abs 3 WEG einen Stimmrechtsausschluss gebieten, wenn durch das Naheverh?ltnis eines Wohnungseigentümers zum Verwalter Gemeinschaftsinteressen auf dem Spiel stehen. Das hat umso mehr zu gelten, wenn ein Miteigentümer selbst zum Verwalter bestellt ist. Bei Abbestellung eines Hausverwalters unter Neubestellung eines anderen Hausverwalters ist von zwei getrennten Beschlussgegenst?nden auszugehen, so dass der Stimmrechtsausschluss des betroffenen Wohnungseigentümers nur den ersten Beschlussgegenstand (Abbestellung des Hausverwalters) betrifft. Das "Transparenzgebot" betreffend das Abstimmungsverhalten der Mit- und Wohnungseigentümer sowie der Modalit?ten des Abstimmungsvorgangs ist schon auf der Rechtsgrundlage vor der WRN 2006 zu bejahen. Beschr?nkungen dieses Informationsanspruchs stellen eine wesentliche Behinderung des Beschlussanfechtungsrechts der überstimmten Minderheit dar und sind daher mit dem aus § 24 Abs 7 WEG 2002 folgenden Grundgedanken unvereinbar. Die Ankündigung einer gesetzwidrigen Anonymit?t (hier: Ausz?hlung durch einen Notar) erfasst und behindert bereits die Grundlage der Willensbildung der Mit- und Wohnungseigentümer, ist doch nicht auszuschlie?en, dass sich Einzelne gerade aus diesem Grund überhaupt nicht am Abstimmungsvorgang beteiligten.

The Marquises of Viana: building distinction through the past (1875-1927)

In turn-of-the-century Spain, Teobaldo and José de Saavedra embodied an understanding of an aristocracy with one foot in the past and the other in the present. As holders of a recently created marquisate, their lifestyle exemplified the challenge faced by aristocrats who adopted practices and customs that were alien to them, whilst seeking to preserve elements of distinction they considered inalienable, such as dynastic history and dense family networks. The aim of this paper is to study the process of building aristocratic notability from a non-patrician origin. To this end, the profiles of the first and second Marquises of Viana are explored, paying special attention to their financial situation, social relations – particularly at Court – and a lifestyle steeped in their modern context. A key theme is their attention to art as a symbol of distinction, conceived as an instrument to leverage them to the position of the social elite of which they were becoming members. At the same time, the Marquises of Viana’s careers also reveal clear connections with Europe’s elite as they sought an exclusivity that would set them apart as a social group in a turbulent world.
