The Implementation Effectiveness of Trash Management in Ambon,Maluku: The Influence of Socialization,Coordination and Control to the Effectiveness of Trash Management

Principally, the policy is made to change the situation to be the desired one. The policy implementation in management context is in the terms of socialization, coordination and the control. This research is focused in the result process of public policy related to the trash management. The joint influence between the socialization, coordination and the control through the implementer and society behavior to the effectiveness of trash management in Ambon is being considered. The structural equation modeling (SEM) and Analysis of Moment Structure (AMOS) 20 is used to analyze the data in this research.     

Writers from Anhui and provinciality in modern China

Abstract

This article discusses the problems of Chinese local and national identity in relation to Anhui province in the twentieth century. It begins with Anhui's contradictory image as both the location of some of the country's most esteemed cultural sites and a place currently perceived as backward and impoverished. After explaining the social uses of local affiliation in the Republican era, it then focuses on the attempts of aspiring young writers from Anhui to join the national literary scene in Beijing during the early 1920s, and analyzes their subsequent reception. It looks at the personal and professional choices that these writers made and, following a selective survey of developments in Anhui since the establishment of the People's Republic of China (PRC), concludes with a consideration of the evolving self-image and changing realities in the province today.     

Governance and Hyper-corruption in Resource-rich African Countries

Official corruption is frequently associated with the abundance of valuable extractive resources. This article reviews the worst cases of ‘resource curse’ in Africa—Angola, Republic of Congo, Democratic Republic of Congo, Equatorial Guinea, Gabon, and Nigeria—in light of the most recent developments. Despite its systematic association with public corruption, however, mineral wealth is neither a necessary nor a sufficient condition. Corruption is widespread in resource-poor countries as well—in Africa and elsewhere—and some resource-rich African countries such as Botswana have a record of good economic performance and high public integrity, suggesting specific ways in which transparency and accountability for the use of mineral resources can be encouraged and corruption correspondingly reduced. Because corruption in resource-rich African countries is heavily influenced by external interests, particularly the multinational extractive industries, recent initiatives by the United States and the international community to foster transparency carry a significant potential for reducing corruption and improving governance.     

贵州汉族19个STR基因座多态性及法医学应用

目的调查19个常染色体STR基因座在贵州汉族人群中的等位基因分布,评估其在法医学中的应用价值。方法应用Goldeneye~(TM) DNA身份鉴定系统20A试剂盒,研究贵州520名汉族无关健康个体19个常染色体STR基因座多态性。用310型遗传分析仪进行毛细管电泳,Gene Mapper~ID v3.1进行基因分型。结果 19个常染色体STR基因座的杂合度为0.603 8~0.916 4,个体识别率为0.790 0~0.985 6,非父排除率为0.295 5~0.826 9,多态信息含量为0.553 5~0.908 9,累积个体识别率为1-1.230 0×10~(-22),累积非父排除率为0.999 999 99。贵州汉族和其他五个地域的汉族两两之间等位基因频率比较,仅贵州汉族与山东汉族、辽宁汉族、山西汉族之间存在基因频率差异具有统计学意义。结论 D19S433等19个常染色体STR基因座在贵州汉族人群中具有良好的遗传多态性,对群体遗传学和法医物证学研究有应用价值。     

Ein Wohnungseigentümer kann vom WE-Verwalter die Legung der Vorausschau im wohnrechtlichen Außerstreitverfahren auch für die Vergangenheit verlangen

Wegen des gegenüber § 17 Abs 1 Z 2 WEG 1975 ge?nderten Texts des § 20 Abs 2 WEG 2002 ("in absehbarer Zeit" anstelle von "für das folgende Kalenderjahr") sowie in Abkehr von der OGH-E 5 Ob 311/99t kann ein Wohnungseigentümer den WE-Verwalter im wohnrechtlichen Au?erstreitverfahren dazu verhalten, dass dieser die Vorausschau auch für die Vergangenheit legt.     

Vom Rechtsvorgänger im Kaufvertrag auf den Wohnungseigentümer übertragener Rechnungslegungsanspruch gegen den (gekündigten) WE-Verwalter

Ein Rechnungslegungsanspruch ist im besonderen Au?erstreitverfahren gem § 52 Abs 1 Z 6 auch gegen den WE-Verwalter durchzusetzen, dessen Verwaltungsvertrag nach § 21 WEG 2002 bereits aufgel?st ist. Auch vor dem 1. 7. 2002 f?llig gewordene Rechnungslegungsansprüche verj?hren nach § 56 Abs 10 WEG 2002 in 3 Jahren, beginnend mit diesem Zeitpunkt. Zum intertemporalen Recht der inhaltlichen überprüfung von "richtigen" Abrechnungen im WE, die vor dem 1. 1. 2000 (= diesbezügliches Inkrafttreten gem Art IX Z 1 der WRN 1999) gelegt worden sind. Den WE-Verwalter trifft die Rechnungslegungspflicht nur gegenüber den in der ma?geblichen Abrechnungsperiode verbücherten einzelnen Wohnungseigentümern. Ein Wohnungseigentümer kann den Rechnungslegungsanspruch als mit dem dinglichen WE verbundenes akzessorisches, aber nicht h?chstpers?nliches Recht im Kaufvertrag auf seinen Einzelrechtsnachfolger übertragen, ihm aber davon losgel?st nicht abtreten, da dieser Anspruch prim?r nicht aus der schuldrechtlichen Beziehung des Wohnungseigentümers zum WE-Verwalter resultiert. Durch die kaufvertragliche (= Titelgesch?ft) übertragung kann der neue verbücherte Wohnungseigentümer auch die au?erstreitrichterliche Prüfung von Abrechnungen für Zeitr?ume vor Einverleibung seines WE beantragen.

就2005年8月在西宁市召开的全国外国法制史研究会第十八届年会上与会学者就其中心议题“20世纪外国刑事法律的理论与实践”提交的一些重要论文及就此展开的学术讨论进行了概括性和综合性的介绍。     

A 26plex Autosomal STR Assay to Aid Human Identity Testing*†

Abstract: A short tandem repeat multiplex assay has been successfully developed with 25 autosomal loci plus the sex‐typing locus amelogenin for a total of 26 amplified products in a single reaction. Primers for the loci were designed so that all of the amplicons present were distributed from 65 base pairs (bp) to less than 400 bp within a five‐dye chemistry design with the fifth dye reserved for the sizing standard. A multiplex design strategy was developed to overcome challenges encountered in creating this assay. The limits of the multiplex were tested, resulting in the successful amplification of a wide range of genomic DNA sample concentrations from 2 ng to as low as 100 pg with 30 cycles of PCR. The 26plex has the potential to benefit the forensic community for reference sample testing and complex relationship evaluation.

Schon aus dem Wortlaut des § 40 Abs 2 WEG 2002 folgt, dass die Anmerkung der Einr?umung von WE nur "an den Erwerber des Rechts auf Einr?umung des Wohnungseigentums übertragen werden" kann. Eine übertragung nur der Anmerkung ist daher ausgeschlossen.
