Recent statements on European Union (EU) trade policy towards developing countries (DCs) have stressed the need for differentiation between trading partners depending on their level of development. But what does this mean in practice? This article assesses the substance of EU trade policy towards a number of partners at different levels of development on the basis of the texts of recent preferential trade agreements (PTAs). It argues that EU PTA policy exhibits differentiation within a general shift towards reciprocity vis-à-vis DCs and that this needs to be assessed at the level of specific policy areas as much as partner country. It also suggests that the factors shaping EU policy vary from case to case with commercial competition and sector interests relatively more important in PTAs with emerging markets and high-income DCs and norms and institutional factors relatively more important in shaping those with least developed or low-income DCs.  相似文献

Public Administration has gone through conceptual development to inject renaissance and public value creation. The literature provides a battleground of ideas between bureaucracy, new public management and post NPM with the latter ones chastising bureaucracy. The new developments should be seen as perfecting and correcting some of the extremes of bureaucracy but cannot replace it entirely. Owing to the broad nature of the public sector coupled with complex goals, agencies and mandates; this paper argues for a synergistic relationship and harmonization of the principles espoused by each paradigm; because each may be applicable in specific context, sector and periods.  相似文献

Do profit‐seeking foreign direct investors value a country's transition to democracy? If they do, they should vote with their pocketbooks, resulting in a post‐transition increase in foreign direct investment flows. This study attempts to uncover links between transition to democracy and foreign direct investment (FDI) in Asia, Latin America, and the Caribbean, In doing so, it addresses existing arguments about connections between democracy and investor behavior. The regions examined have not only experienced democratic transitions, they also account for the majority of the increasing flow of FDI to the developing world. This research employs time‐series cross‐sectional (TSCS) economic and political data, using ordinary least squares with panel corrected standard errors. The central finding is that transition to democracy has a negative effect on FDI. Secondarily, political instability and higher levels of democracy also deter foreign direct investors.  相似文献

This paper conceptualizes the behavior of higher courts in the politics of former Soviet republics and attempts to set up a framework for the study of democratic contributions by post-Soviet constitutional courts. Although political expediency is noted to be the central driving force behind the judges’ decisions in politically sensitive cases, as courts are subject to different constraints from quasi-autocratic executives, it is argued that constitutional review tribunals are generally pro-democratic in their political orientation and that they can become the allies of pro-democratic parties in transitional periods of elite change. To support this proposition, this paper proceeds from a series of theoretical arguments to empirical observation of judicial behavior in times of political uncertainty, the latter being a perfect test for probing the political orientation of the courts.  相似文献

The collapse of the B1 Dam of VALE SA mining company in Brumadinho, Minas Gerais, Brazil was the largest humanitarian disaster and occupational accident in the country’s history, and it posed challenges regarding the management and identification of multiple victims. We evaluated the impact of the iron ore tailings on the victims’ bodies. We examined the scientific identification of the victims and the dynamics of the disaster over the 1st year after it occurred. We also determined the socio-demographic profiles of the victims. In this retrospective, cross-sectional study, we investigated the expert reports of the victims’ biological remains from 25 January 2019 to 25 January 2020. We analysed the socio-demographic data, identification methods, identification status, identification time, and necroscopic information. During the study period, 259 of 270 victims were identified, and 603 biological materials were analysed; among them, 86.2% were body parts and 13.8% were whole bodies. Of the total cases registered that year, 476 (78.9%) were submitted during the first 10 weeks after the disaster. Friction ridge analysis accounted for 67.9% of primary identifications and DNA analysis did so for 91.6% of re-identification cases. Body dismemberment was 3.4 times greater among mine workers than among community victims. Adult males accounted for the greatest number of victims (P < 0.001). Polytraumatic injury was the prevalent single cause of death. Necropsy examination revealed the occurrence of asphyxia in 7% of cases. The higher number of fatalities and greater dismemberment among employees than with community residents underlines the occupational dangers in the mining industry and clarifies the dynamics of the disaster. In the initial weeks after the dam collapsed, friction ridge analysis was the most appropriate method for identification. Subsequently, DNA analysis became the most-used technique for identification and re-identification owing to the great volume of body parts and decomposed biological tissue. Autopsy allowed diagnosis of the causes of death to be clarified according to the Brazilian criminal legal system.  相似文献

Global diffusion of regulatory reforms in telecommunications has prevailed in many countries, engendering major institutional changes and entailing the establishment and/or reform of regulatory agencies. Although the triggers and timing of such agentification processes have been more or less similar, agency independence displays significant cross-country variation. Seeking to explain such variation based on a sample incorporating middle-income countries (MICs), this paper examines the impact of political-institutional settings in which the agencies operate, in addition to the impact of economic parameters. Regression analysis reveals that political rights appear as the central parameter, while their impact is more robust in MICs than in advanced countries. The results underscore considerable cross-national variation in regulatory governance, along with a noteworthy decoupling between MICs and advanced countries. Concurring with the regulatory regionalism perspective, the paper delineates distinct regional clusters, albeit remaining agnostic about the determinants of such clusters.  相似文献

What can be learned from two decades of studies on policy entrepreneurship in developing countries? Policy entrepreneurship is a rapidly evolving analytical concept. A growing number of studies exploring public policy in developing countries use policy entrepreneurship as an explanatory theoretical concept. However, a substantial part of this research relies on qualitative case study analysis, lacking a comprehensive overview of the concept of policy entrepreneurship. This paper conducts a systematic review of the literature on policy entrepreneurship in developing countries. A total of 47 papers addressing policy entrepreneurship in the developing world, published between 1993 and 2017, have been analysed. The purpose and contribution of this paper are to offer a clearer picture of policy entrepreneurship in the developing world by concentrating on two aspects. First, we describe the characteristics of the studies on policy entrepreneurship in the developing world. Second, we analyse such studies, identifying the lessons that can be drawn on the phenomenon of policy entrepreneurship in the developing world. We conclude with an agenda for future studies, examining new theoretical, methodological, and empirical opportunities to advance the understanding of policy entrepreneurship in developing countries.  相似文献
