Commercial Choice of Law in Context: Looking Beyond Rome

English courts are frequently criticised for their flexible approach to the finding of implied choice and the use of the escape clause in the context of the Rome I Regulation/Convention on the law applicable to contractual obligations. This paper argues that such criticism is misplaced. Based on empirical evidence, the article shows that those choice of law decisions are directly influenced by their procedural context and respond to the need to balance the multiple policy issues generated by international commercial litigation. In particular, English decisions need to be assessed in light of three distinct factors: the standard of proof required at different stages of the procedure in England, the national policy to promote England as a center for commercial dispute resolution and the incentives to export English law in certain strategic industries. The use of implied choice and the escape clause to achieve these ends constitutes a legitimate practice that does not frustrate the aims of the EU choice of law regime.

Reflections on Devolution: Twenty Years on

May 2019 marks twenty years since the first elections to the Scottish Parliament and Welsh Assembly. This report discusses a paper published by the Institute for Government (IfG) that reflects on the experience to date of devolution, drawing on interviews with thirteen individuals who have served as ministers in the devolved governments. Reflecting the structure of the IfG paper, there are three main themes in this report: governing without a majority, institutional change, and—in the light of Brexit—relationships between the devolved governments, Westminster and the EU. The conclusion is that the report, although limited in coverage, provides a useful addition to the literature on devolution.

The Lion and the Eunuch: National Identity and the British Genius

The Lion and the Eunuch challenges the failures of British politicians to adequately understand the complexities, and the subtleties, of British national identity, and goes on to define it for them. It also explains reasons for our current confusions over who we are in the world. In 1940 Orwell wrote The Lion and the Unicorn as a rallying cry for a richly identifying country that was still able to imagine itself, and re‐imagine itself, as the need arose. This essay suggests that without a radical change of government policy and thought, that power will continue to decline with far reaching consequences for the peoples of these islands.
