继父母收养继子女若干问题探究——关于《收养法》第14条未尽之内容

继父母对继子女的收养是我国现行《收养法》中规定的一种收养方式,现实生活中大量再婚家庭的出现也使得继父母对继子女的收养可以成为调整再婚家庭关系的良好措施之一。但该制度在现实生活中并没得到很好的运用。一方面是人们没有更多了解收养这一法律行为对维系再婚家庭的良好促进作用,同时现有的完全收养制度也是阻碍再婚家庭选择收养方式的因素。基于现实的需要,我们有必要对继父母收养继子女问题作更多探究与思考。

新闻自律是舆论监督法治化语境下对新闻工作者提出的基本要求。即正确的角色认知是新闻自律的自觉性前提；合理的道德价值取向是新闻自律的伦理基石；科学的新闻职业精神是新闻自律的内在动力。     

论反致制度及我国的立法选择

反致作为国际私法独有的制度历来是引起各国专家学者广泛争论的问题。本文以反致制度在当今各国立法中的运用作为基点,通过分析反致在传统和现代国际私法中存在的价值基础,对反致制度进行再思考,认为在当今越来越多国家接受反致制度的背景下,应结合我国具体国情有限度地接纳反致制度。     

Comparison and adoption： Food recall system in China

Since the official implementation of Food Safety Law of PRC on June 1, 2009, it has played a crucial role in solving problems regarding food safety currently, eliminating food safety damages, elevating food quality, maintaining consumers＇ health. Based on analyzing and encapsulating the status quo of food recall system in some developed countries, integrated with Chinese realities, this paper discusses the existing shortcomings and disadvantages of China＇s present food recall system, and provides suggestions.     

我国心理测试结论的证据属性与定位

目前各国关于心理测试(测谎)结论的法定资格的态度大体可以分为两类:一类是持基本肯定的态度;另一类是持完全否定的态度。在我国司法领域中,心理测试结论的最终的出具形式仍是"测试报告",并没有把它隶属于鉴定结论的范畴,它和鉴定结论之间有着本质的差异。但在借鉴国外证据的"有限采用规则"和"补强规则"的框架下,心理测试技术和测试结论仍在我国的司法实践中有着广泛的应用价值。

第三人利益的保护——善意取得还是无因性原则

我国正在制定的《物权法》,在第三人利益保护的问题上 ,存在着适用善意取得制度或物权无因性原则两种观点的争论。本文认为 ,善意取得制度更能体现法的正义性 ,也更切合我国的国情 ,所以应是我国立法的选择。但善意取得制度应吸取无因性原则的优点 ,对善意的认定应采用客观推定的办法。本文同时提出了其他方面完善的措施。     

The Diffusion of Human Trafficking Policies in the Post-Soviet Region: A Comparative Analysis of Policy Adoption in Ukraine,Latvia, and Russia

This paper analyzes how human trafficking policies diffused in the post-Soviet region. By adapting the diffusion of innovation framework to fit the international context, I examine whether human trafficking adoptions in the post-Soviet region were due to internal determinants and/or diffusion effects. A comparison of Russia, Latvia, and Ukraine found that internal determinants such as state commitment to human trafficking policy and interest group strength were more important to policy adoption than external pressures from the international community while state capacity and bureaucratic restructuring impeded policy adoption. I argue that policymaking, even in authoritarian regimes, is more nuanced than blind compliance with international treaties and shows that interest groups and policy entrepreneurs work within the constraints of national policymaking to adopt human trafficking policies.     

EPSAS—Worrying the Wrong End of the Stick?

The ultimate objective of the European Public Sector Accounting Standards (EPSAS) project is for the European Union (EU) to improve budgetary surveillance of its member states through more reliable statistics. The objective of this article is to analyze the EPSAS decision and discuss the efficacy of the proposed solution. Harmonization is already present through national accounting rules; will more standardization do the trick? Is the problem really being dealt with, or is it just an attempt by the EU to appear to be doing the right thing while the real issue is ignored? This article suggests that targeting governmental accounting systems for this purpose may prove futile.
