Latency – Time for lawyers to get up to speed?

While latency issues have always existed in IT systems, it is only in recent years that latency has become a significant focal point for both IT suppliers and customers. This paper will provide an overview as to how latency arises in IT systems, why latency is becoming important across a variety of business sectors and then explores some of the prominent legal issues inherent in contracting for low-latency solutions.

地方政府投资参股银行机构,既是一种模糊产权形式,也是一种过渡产权形式。允许地方政府的资本进入银行业,本意是体现责、权、利相匹配的原则。然而,这可能导致地方银行机构成为地方政府的"提款机",信贷扩张增大,政府融资平台贷款持续增加,信贷集中度会更高,地区贫富差距会扩大,弱势群体的贷款难问题会加剧等。因此,作为过渡性产权形式,地方政府股权的退出将是一种必然结果,虽然短期内难以实现,但是这是解决这一问题的必然出路,因而必须壮大民营银行产权并使之成为第一行动集团。只有这样,地方政府才可能逐步退出银行的产权控制领域并让民营银行成为间接融资渠道的主体,实现银行产权的更替,最终分散和化解金融风险。     

饲养动物侵权责任的法律适用探析

动物侵权的问题不仅关系到公民个人权利的法律保障,从更高层面上看,还关系到人与自然的和谐。人类基于各种目的饲养动物,不可避免地发生动物致人损害的责任问题。法律的功能在于定纷止争,这类问题自然是侵权责任法律制度的一个重要调整对象。《中华人民共和国侵权责任法》①的颁行,为这一领域提供了法律规范的依据。本文在对前后立法变化进行说明的基础上,解析了侵权责任法中关于饲养动物致人损害责任问题的相关规定,以期为正确适用法律提供有益借鉴。

分析西藏IT产业发展现状中存在的问题,经济增长总体质量不高;产业结构不合理;数字鸿沟逐渐显露;整体认识不到位;重视不够;科技人才匮乏,根据上述问题从而制定出比较符合西藏IT产业实际情况的发展模式。一是推广藏文计算机软件,消除地区间数字鸿沟;二是提高现有业务人员的综合素质和业务能力;三是政府作用应逐步向政府辅助扶持型转化;四是以网络业发展为特色;五是以国际人才为平台;六是以引进成熟技术为主的发展战略。     

转型期我国户籍制度改革新探

当前,我国户籍制度改革面临盲目性、不彻底性,法律规范滞后及定位不准等困惑。为此,提出建立城乡统一的居民户口制度,强化户籍管理的基础性工作,分类引导人口合理流动以及尽快完善户籍立法等户籍制度改革路径。
