The regular article tracking developments at the national level in key European countries in the area of IT and communications - co-ordinated by Herbert Smith LLP and contributed to by firms across Europe. This column provides a concise alerting service of important national developments in key European countries. Part of its purpose is to compliment the Journal’s feature articles and briefing notes by keeping readers abreast of what is currently happening “on the ground” at a national level in implementing EU level legislation and international conventions and treaties. 水、油污中无电流斑电击死大鼠皮肤和心肌的病变

目的探讨水中、油污中无电流斑电击死法医学鉴定的病理形态学依据。方法 SD大鼠28只,分为水中、油污中无电流斑电击死各1组,典型电流斑组、正常对照组、死后电击组、死后水中、油污中电击各1组共7组。采用肉眼、光镜及投射电镜观察水中、油污中无电流斑电击死大鼠皮肤和心肌组织病理学改变,并与其它各组进行比较。结果采用肉眼观察,生前水中、油污中无电流斑电击死大鼠皮肤未见明显电流斑。普通光镜观察,可见电击中心部位表皮变性坏死、脱落,表皮细胞变薄、致密,表皮细胞或/和毛囊、汗腺、皮脂腺发生极性化改变。电镜观察,透明层和角质层分离脱落,基底细胞肿胀、细胞器减少、核固缩,汗腺导管上皮肿胀,棘细胞中粗面内质网扩张融合成泡状,线粒体肿胀空泡化;但光镜与电镜的变化与生前电击死比较不明显、典型。而死后电击组皮肤则无明显病理学改变。实验各组大鼠心肌的改变与皮肤改变类同。结论采用光镜和投透射电镜观察在潮湿环境中电击死的组织病理学改变,可为无电流斑电击死提供依据。     

A Comparative Assessment of the Information Technology Services Sector in India and China

The purpose of this paper is to assess the nature of competition in the information technology (IT) services sector between India and China. Using primary and secondary data sources, we compare and contrast the strengths and weaknesses of the IT services sector in the two countries along the main dimensions of Porter's competitive advantage model. The principal findings indicate that the IT services sectors in the two countries are distinctively different, have developed along different paths and are highly complementary to each other. China has a well-established hardware sector and its IT services sector focuses mostly on servicing its domestic market. India's IT services sector is predominantly export orientated with focus on the US and Western European markets. Contrary to popular beliefs, given the complementary characteristics of the IT services sectors in India and China, it is unlikely for the two countries to compete against each other in the near future and greater strategic co-operation between IT service providers in the two countries is a more likely outcome.

法益保护不断前置、总体趋严的刑事立法——历次刑法修正案背后的刑事政策解读

从1999年《刑法修正案》到2011年《刑法修正案（八）》,仅仅12年时间,我国刑法就新增了34个罪名。在入罪方面,犯罪门槛不断降低,危险犯立法模式不断增多;量刑方面,尽管取消了13个死刑罪名,但刑罚总体趋严。这些罪刑变化的背后不仅表现出我国刑法对安全刑法理论的回应,更表明我国刑法对积极一般预防学说的采纳,刑事违法性实质从结果无价值向行为无价值的转变。

论物权法背景下的所有权保留买卖制度

所有权保留买卖制度是《合同法》的一种特色制度。但该制度在司法实务中并未得到充分适用,社会生活中也鲜有发生。随着《物权法》的生效,"物权法定原则"、"物权变动公示原则"、"区分原则"及相关具体规则不可避免地影响、冲击到原有立法体系中的各项财产权制度,而与物权"骨肉相连"的买卖合同,包括所有权保留制度亦莫能外。
