20年中国法理学的嬗变及其时代课题

要克服中国法理学在嬗变中存在的缺陷，重塑科学精神，必须处理好本土化与国际化、制度研究与过程研究、现实主义与理想主义、核心问题的拓深与边缘领域的拓展等四大关系。     

论网络时代思想政治教育工作的环境变迁

网络时代的到来，造成了思想政治教育宏观环境与微观环境的重大变迁。宏观环境主要包括政治、经济、文化、大众传播媒介等；微观环境主要包括家庭、学校、社区、社会组织、同辈群体等。面对环境发生的重大变迁，我们必须尽快构建全方位的网络思想政治教育工作的新格局，净化思想政治教育的网络环境，加强校园网络文化、企业网络文化建设，不断提高思想政治教育工作者的素质。     

晚清女性服饰改革:女性身体与国家、细节和时尚——从废缠足谈起

晚清服饰改革在晚清女性解放运动中发挥着特殊的作用。在以维新人士为主的精英知识分子的倡导下,废缠足等女性服饰改革被提到了强国保种的高度,但由此带来的另一个后果是人们忽视了女性身体的真实处境。女性身体被隐匿的另一原因是晚清女性服饰繁琐的细节,细节的堆砌淹没了身体。随着服饰改革的推进和细节的被剪除,女性的身体和内心都得到了重新的展示,而在这一过程中,时尚起到了关键性的作用。     

检察机关案件管理机制改革下检察委员会应做好的四个转变

当前,检察委员会(以下简称检委会)在案件管理方面存在的主要问题有:被动性、局限性、非亲历性、微观性。案件管理机制改革改变了粗放式的案件管理模式,使检委会能够对全院检察业务进行全面监督和整体掌控,检委会应以此为契机,做好四个转变,改进检委会工作制度、转变检委会职能,推动检察工作科学发展。     

价值观念的嬗变对“90后”青年的影响

在多元价值观念的影响下，深切关注个人价值，勇于承担社会责任，逐渐注重务实高效，更加趋向开放宽容，已成为“90后”青年人生价值取向的主流。在看到价值观念的嬗变对“90后”青年积极影响的同时，也必须看到理想信念虚无化、政治观念淡漠化、价值目标世俗化、婚恋观念功利化等不利影响。面对价值观念多元化的负面影响，我们应该加强引导，做到趋利避害。     

利玛窦墓地的历史变迁与中西文化交流意义

以利玛窦陵园碑刻文献考察为起点,通过对相关书面文献的核查,追述利玛窦来华的过程并阐述“利玛窦经验”,分析利玛窦墓地的文化变迁,总结利玛窦于中西文化交流的意义.最后得出几点启示:第一,利玛窦以他个人和群体的努力,开启了东西方科技、文化等方面的实质交流.第二,利玛窦把世界介绍给中国,同时也把中国介绍给世界,实现了互动双向的输入与输出.第三,今日之中国在与他国进行文化交流的过程中,应当重拾“利玛窦经验”和“利、徐之交”的“温和主义”路线,广揽人才,重温大国气度与开放情怀.

Causes and Effects of Child Welfare Workforce Turnover

ABSTRACT

This paper provides an overview of the current state of knowledge on the causes and effects of workforce turnover in child welfare. The causes of workforce turnover are abundant and have been categorized into three areas cited most often throughout the literature: individual factors, supervisory factors, and organizational factors. On the other hand, the empirical research on the effects of workforce turnover in child welfare is scant. This paper discusses the need for new empirical knowledge on the relationship between turnover and child welfare outcomes. The authors conclude with consideration of the gaps in the research and implications for social work practice and profession.     

British Gas v Accenture: Round one

British Gas is currently seeking to recover around £220 m from Accenture in respect of Accenture's design and build of a new billing system. Two judgments on preliminary issues in the litigation were handed down in November 2009. This article provides the background to the dispute and then examines three areas considered in the judgments which are of general interest to practitioners. First, the article considers the issue of breach and the extent to which aggregation of breaches and a forward looking approach to their consequence may assist in determining their materiality. Secondly, the article considers the nature of notices of breach given under IT contracts. Finally, the article looks at issues of allocation of certain categories of loss to the two different limbs of Hadley v Baxendale, and as a result their potential recoverability.     

Case comment: BSkyB v. EDS [2010] EWHC 86 (TCC) case no: HT-06-311 26.01.2010

The Technology and Construction Court has issued its long-awaited decision in the epic court battle between BSkyB and EDS. Mr Justice Ramsey found that EDS had fraudulently induced Sky into a £54 million contract for a new customer relationship management (CRM) system. Since judgment was given, EDS has been ordered to pay Sky £270 million in damages and interest.
