话语、体制与投入:乡村治理中的义务教育——以LY县为例

处于乡村治理环境之中，义务教育的成长、变化必然受其规约、影响。通过话语、体制与投入三个维度审视乡村治理中的义务教育，厘清了农村义务教育宏观、中观及微观层面的发展历程，展现了LY县义务教育的具体情势。同时发现，乡村治理中的政府权责、微观体制及其资源分配中存在的问题，依然是制约义务教育实现有效性、合理性及公平性的重要因素。透过乡村治理中的义务教育，国家与农民的关系昭然若揭，而后者恰恰是农村义务教育模式的决定性因素。     

西方有效需求理论对我国扩大内需的启示

消费需求是最终需求,是拉动经济增长的最终动力。阐述西方有效需求理论的主要内容,在此基础上分析目前我国有效需求的基本状况,包括投资需求和消费需求不足的主要表现,由此得出有利于扩大内需的相关启示。     

《两岸投保协议》背景下台胞投资保护立法的完善

近20年来，祖国大陆先后出台一系列保护台胞投资的法律法规，这些立法切实保护了台商在大陆投资的合法权益，有效地鼓励了台商投资的积极性。但是，随着两岸关系的发展和大陆投资环境的变化，《台胞投资保护法》及其《实施细则》的部分条文已不太适应当前两岸关系的需要。2012年8月《两岸投保协议》签署后这一问题更加凸显。因此，大陆方面应以落实《两岸投保协议》为契机，加快台胞投资保护立法的修订工作，协调其与《两岸投保协议》的关系，为台商在大陆的投资发展提供更加良好、宽松的法律环境。     

北美投资移民立法之启迪

各国制定移民法的宗旨为：通过立法对移民的规模、构成、素质以及经济能力进行调控，以达到为本国政治、经济和安全各项利益服务的目的。因此，各国移民法的共同特点是在体现迁徙自由和人道主义的国际法原则下，以最低成本吸引他国专业技术人才和资本，从而促进本国社会和经济的发展。其中，近年以美国、加拿大及其魁北克省为代表的投资移民立法就是这种趋势的典型反映。因此，笔者拟就北美国家关于投资移民的立法进行比较评析，同时研讨中国关于投资移民立法的前景。     

How interest groups influence public opinion: Arguments matter more than the sources

Through what mechanism do interest groups shape public opinion on concrete policies? In this article, three hypotheses are proposed that distinguish between the effect of the arguments conveyed by interest groups and the effect of interest groups as source cues. Two survey experiments on the proposed Transatlantic Trade and Investment Partnership (TIPP) and the 2015 Paris Agreement on climate change allow the testing of these hypotheses. The resulting evidence from several countries shows that, with respect to interest groups’ attempts at shaping public opinion, arguments matter more than their sources. This is so even when accounting for people's trust in the interest groups that serve as source cues and for people's level of information about a policy. The finding that interest groups affect public opinion via arguments rather than as source cues has implications for the literature on elite influence on public opinion and the normative evaluation of interest group activities.     

Multinational-firm responses to an Asian-crisis comeback: evidence from European transnationals

Abstract

Despite many predictions to the contrary, the Republic of Korea (ROK) is currently one of the countries with most pro-American attitudes. We investigate what is behind the extraordinary resilience in US popular standing in an allegedly least likely setting. Using survey data from 2002 and 2007 and a novel methodology, Classification and Regression Tree models, we test whether US standing is: (1) a matter of interests, i.e. a reward that the USA receives because it either provides security or international public goods; or (2) whether it is a matter of image, i.e. the recognition that the USA is a role model to emulate. We find that across a large number of predictors, the Korean public mostly liked the USA because they liked American ways of doing business, which gives support to the image hypothesis. Security interests played a secondary role in shaping US standing, while the provision of international public goods had no impact in the popular assessment of the USA in the ROK.     

浅议BOT在我国的应用及其立法的完善

BOT是20世纪80年代以来全球兴起的一种投资方式。本文阐述了BOT的意义,尤其是对我国引进外资、发展基础设施的作用;介绍了两个我国利用BOT方式建设的项目;分析了我国现行法律与BOT在我国的发展不相适应之处,提出应调整和完善我国目前的BOT立法,以保障BOT投资方式在我国的良好运行。     

技术转移要求、投资鼓励与国际投资环境的关联关系——结合WTO贸易与投资关系工作组的研究报告和晚近国际投资立法进行分析

根据WTO贸易与投资关系工作组近年来对技术转移要求和投资鼓励问题的专题研究 ,结合晚近国际投资立法的相关规定 ,不难发现未来相关国际投资立法的可能发展趋势 :适当的有关技术移转方面的引导措施可以存续 ,强制性技术转移要求应逐步取消 ;投资鼓励措施只能作为吸引和引导外资的辅助性工具 ,制约投资鼓励措施的国际多边规则会逐步出现并日趋严格     

论西部开发中投资环境与生态环境营造的法制协同

西部大开发首先需要营造良好的投资环境 ,这是由西部的地域特点、民族特点及经济的落后性决定的。同时 ,西部脆弱的生态环境又要求西部大开发必须走可持续发展的道路 ,把投资环境的改善同生态环境的保护和改善依法协调起来。
