区域协调发展是我国的国家战略。近年来,在党的领导下,我国区域协调发展中的地方立法协调实践探索,呈现出京津冀、珠三角、长三角等几种典型样本,并各具特色及示范价值。进入新时代后,区域地方立法协调面临诸多国内无先例可循的新问题。根据党的十九届四中全会提出的“构建区域协调发展新机制”等时代新要求,需要重点思考我国区域立法协调的发展空间、聚焦领域和可能的溢出效应等理论难点。从已有的样本探索和发展趋势看,区域内跨省市的大气、水流等生态环境共保共治问题,区域市场一体化及区域营商环境共建问题,区域一体化示范区共建问题等,将是今后我国区域地方立法协调的侧重点和聚焦点。 相似文献

司法体制改革大背景下,安徽地区法院更多关注与研究的应该是司法权运行改革下的合议庭负责制如何更好地构建。笔者对当前合肥市法院审判权合议庭制度的运行现状进行了调研,发现当前合肥地区案多人少的矛盾非常突出,法院审判资源配置不足,相对固定的合议庭审判团队组建困难;合议庭审判职权与审判管理权界定不明确;合议庭内部流程制度不健全职能弱化等突出问题。笔者进而结合实地对全国部分试点审判权运行改革法院的考察情况,提出了安徽地区法院司法权运行改革下的合议庭负责制的构建一些想法:要优化审判资源的配置,配齐组建新型的合议庭审判团队;要合理界定审判权与审判管理权,充分发挥合议庭的审判职能;要理清合议庭提交审委会讨论案件范围与形式,真正实现"让审判者裁判,让裁判者负责";要明确合议庭负责制内部工作流程,确保合议庭内部运转正常;要健全对合议庭的考核监督激励机制,调动合议庭的工作积极性,加强合议庭的工作责任心。 相似文献

检察机关作为国家的法律监督机关,既肩负着反腐倡廉的历史使命,又面临着自身建设与反腐工作的巨大挑战。在开展党的群众路线过程中,一些基层检察机关不同程度地暴露出诸如作风不正、纪律不严、执法不实、行为不廉等与党的群众路线不相符甚至对立等问题,一些领导干部、检察人员的形式主义、官僚主义、享乐主义和奢靡之风依然盛行,这既严重损害了检察机关的良好形象和执法公信力,也严重阻碍了检察工作的健康持续发展。因此,检察机关需凝聚反腐工作共识,着力加强检察廉政精神文化、行为文化、制度文化和物态文化建设,努力营造以廉为荣、以贪为耻的检察机关廉政文化氛围。 相似文献

There is building evidence in India that the delivery of health services suffers both from an actual shortfall in trained health professionals and from unsatisfactory results of existing service providers working in the public and private sectors. This study focuses on the public sector and examines de facto institutional and governance arrangements that may give rise to well‐documented provider behaviors such as absenteeism that can adversely affect service delivery processes and outcomes. We analyze four human resource management (HRM) subsystems: postings, transfers, promotions and disciplinary practices from the perspective of front‐line workers—physicians working in rural healthcare facilities operated by two state governments. We sampled physicians in one “post‐reform” state that has instituted HRM reforms and one “pre‐reform” state that has not. The findings are based on both quantitative and qualitative measurements. The results show that formal rules are undermined by a parallel modus operandi in which desirable posts are often determined by political connections and side payments. The evidence suggests an institutional environment in which formal rules of accountability are trumped by a parallel set of accountabilities. AbstractDecentralization reforms introduced to Africa have not always delivered the intended outcomes. Through interaction with the broader historical, political, social and economic context, reforms seem to have engendered political consequences beyond decentralization itself. Most of the literature on decentralization and development emphasizes questions of institutional design and policy, but here we expand the focus of analysis and incorporate the harder-to-pin-down political patterns marking the workings of decentralization in Africa. Through the case-studies of Ghana, Senegal, Zimbabwe, Namibia, Ethiopia and Uganda we seek to connect the debates on development with the scholarly literatures on comparative federalism, comparative decentralization and local democracy. The conclusion that emerges is that no magic formula which can turn countries into peaceful, stable and prosperous democracies overnight exists. And, importing formal institutions without regard to the local historical, political, social and economic context risks leaving us with elegant but dysfunctional iron houses in the tropical heat. 相似文献

AbstractDeinstitutionalisation movements of the mid-1900s led to changes in policy and practice in the management of people with special needs (defined for this article as people with severe and persistent mental illness, intellectual disabilities and high levels of personality factors that interfere with treatment participation). Although the majority of clients with special needs receive care in community settings and interact more with family, friends and others in the community, some such clients require more rigorous case management. For clients who have offended, especially sexually, community-based services are scarce, and concerns regarding reoffence potential often supersede traditional understandings of diminished capacity. Recent reports suggest that jails and prisons have replaced hospitals as the institutions-of-choice for clients with special needs who engage in inappropriate conduct. This paper examines policies and practices regarding community risk management of people with special needs who have sexually offended. Vignettes are provided to illustrate how some clients and agencies have been affected, and suggestions are made to ensure best practices in risk management and public safety. 相似文献
