女性主义对公民资格理论传统的批判在凸现传统公民资格理论中女性之缺席的同时,却由于潜在的性别本质化分析而陷入普遍主义正义伦理的两难,关怀伦理成为女性主义摆脱正义伦理两难处境的另类思考。与以关怀为基础的路径相一致,差异性立场、身份政治转而成为女性主义表达其性别正义诉求的武器。但是如果妇女并非一种统一的性别象征,如何能够提出妇女的政治主张?因此,建构一种基于宽容、对话、理解、友爱、团结基础之上的包容不同身份差异(包括性别差异)的公民身份和公民制度成为继身份政治之后女性主义进一步考虑的重点。 相似文献

Previous research on cooperative and competitive reward systems has investigated the relation between extreme cooperative and competitive conditions, along with an intermediate noninterdependent neutral condition, to numerous outcome variables. This study added two additional conditions to these three usual conditions, between the neutral midpoint and the cooperative or competitive extremes, to see if these intermediate conditions might be distinctive in the outcomes they produced. The study used 240 participants, divided into groups of three that played a board game under these five different reward conditions. Participants' attitudes toward self, others, and task were then assessed and analyzed along with objective measures of performance, measures of self-esteem, state and trait anxiety, and results coded from an autobiographical report in game-defined roles. Results indicated that the intermediate cooperative condition was distinctively different from the extreme cooperative condition in predicted ways, and that the intermediate competitive condition was distinctively different from the extreme competitive condition, but in unpredicted ways. The research also demonstrated that an individualistic condition, which had previously been thought to produce neither a cooperative nor competitive social orientation, in fact produced both, raising questions as to whether reward interdependence, as researchers have defined it, is really the cause of cooperation and competition. 相似文献

This study investigated the effects of procedural justice on discrete emotional responses. Based upon the cognitive appraisal model of emotion, it was argued that the experience of procedural justice (or injustice) allows individuals to derive meaning from favorable and unfavorable allocation decisions. Thus, procedural justice works with outcome favorability to produce a variety of emotional states. These ideas were tested in a laboratory experiment. As predicted, two happiness-related emotions (happiness and joy) and a sadness-related emotion (disappointment) showed only a main effect for outcome favorability. Two anger-related emotions (anger and frustration) were highest when an unfavorable outcome occurred because of an unfair procedure. Higher levels of guilt and anxiety were reported when an unfair procedure resulted in a favorable outcome. This paper analyzes the felt legitimacy of poverty and wealth in the United States, West Germany, The Netherlands, Hungary, the Czech Republic, and Russia. Several theories on poverty and wealth perception are discussed; of these, dominant ideology theory has been the most influential. This theory can predict the existence not only of a legitimizing ideology in a society, but also of challenging beliefs that incumbents of specific social positions hold. It is argued that poverty and wealth perceptions are more complex, however, involving at least three latent dimensions. Using data from the International Social Justice Project it is demonstrated that, regarding poverty, individuals distinguish between merited, unmerited, and fatalistic types of poverty. Merited poverty is poverty brought about by the individual's own doing or not doing, unmerited poverty is due to forces external to the individual, whereas fatalistic explanations attribute poverty to ascribed properties of the individual. For wealth also there are three causally relevant factors: in addition to merited und unmerited ones, a social capital factor that sees social contacts as a source for determining economic success. Using a structural equation approach and its group comparison option for comparing countries, the different explanations of poverty and wealth are translated into specific measurement models. Testing simultaneously with linear regression models show how preferences for particular explanations are shaped by stratification-related experiences and by the social position of an observer. 相似文献

What distinguishes this contract is the nature of the right delegated to the agent: The capacity to make law gives the opportunity to take advantage of the incompleteness of the constitutional contract. 自奥巴马政府以来,特别是新冠肺炎疫情暴发后,国家安全在美国全球供应链调整中的影响日益彰显。在国家安全的视域下,美国政府调整全球供应链的逻辑依据为“国防论”与“选择性贸易保护主义”。美国的国家安全侧重国家利益与价值,全球供应链调整则诉求产品(或服务)的可替换性,二者交互作用,贸易保护主义性质的“国防论”与“选择性贸易保护主义”就成为分析美国全球供应链调整的理论分析框架。“国防论”侧重诠释具有国防意义产品(或服务)的进出口,而“选择性贸易保护主义”则分析了普通贸易实践对美国整体福利乃至国家安全的损害。美国在国家安全视域下调整全球供应链的路径依赖于软硬两种手段。一是无弹性的硬手段,表现为官僚体制、决策机制、相关法律制度与管理规范,美国全球供应链上的企业必须遵守,其具有吓阻功能。二是具有弹性的软手段,体现为国家战略以及政策说明等,其不具有强制性。基于此,这一研究有助于进一步厘清时下美国政府变动不居的对华经贸政策,构建合作与开放的中美经贸关系。 相似文献

基于时中国基层司法的调查和研究,本文试图概括地总结中国基层司法中经常运用的一些在现有的法律知识体制中末于以足够重视的知识和技术,并予以初步的理论分析。本文认为,由于中国基层法院法官所处的特定制度空间(初审法院)和时空位置(中国基层社会),他/她们所需要的知识和技巧不仅与理想型法官不同,而且与上诉审法官也不同。在这种余件下,中国基层法院法官实际上经常并非自党地创造和运用一些知识和技术。这种知识和技术有助于实用主义地解决一些实际问题,并且从现代的其他学科知识看来也具有一定的学理上的正当性,但是在有些情况下,也有可能被滥用。这种从司法实践来的知识,尽管来自基层,缺乏实践者的自我反思,但仍然具有实践意义和理论意义,需要当代中国关注现实的法学象的重视和研究。 相似文献
