构建我国社区矫正制度的若干思考

社区矫正代表着罪犯处遇的未来走向 ,但我国当前社区矫正的总体发展水平比较低 ,加紧社区矫正制度的构建和完善已成当务之急。应当构建完备的立法、科学的裁量机制和健全的执行体系 ,以保障和促进社区矫正在我国的发展。     

An Examination of Mental Health and Psychiatric Care among Older Prisoners in the United States

Despite that prisons in the United States (and other high-income countries) have witnessed an increase in the proportion of older inmates, and that prison populations exhibit high rates of psychiatric illness, there is limited knowledge on the nature of older inmates’ psychological health and use/provision of psychiatric care. The present study addresses these gaps, analyzing a nationally representative sample of 1,907 male and female older inmates (age range = 50–84 years; M = 56) housed in U.S. state and federal prisons. The results highlight: (a) the prevalence of psychological issues among older prisoners; (b) factors associated with certain mental disorders and symptoms of mental health issues; (c) the prevalence of psychiatric treatment before and during imprisonment for those with (and without) reported psychological health issues; (d) similarities and differences between male and female older inmates in relation to psychological health, factors associated with psychological issues, and the use/provision of psychiatric care. Discussion points toward recommendations for managing inmate mental health, as well as direction for further research on older inmate mental health and psychiatric care.     

服刑人员心理特征及心理危机干预策略探究

服刑人员心理分为积极和消极的心理两种特征。服刑人员心理危机包括境遇性危机、存在性危机、发展性危机、个体人格特征引起的危机等几种形式。科学分析服刑人员的心理状况，及时采取有效的干预措施，有利于全面提高服刑人员的心理素质，进一步减少危机事件的发生。     

论看守所留所服刑界犯脱逃的防范

近年来,看守所留所服刑罪犯脱逃成为影响看守所安全的突出问题。防范留所服刑罪犯脱逃,要在分析其脱逃原因的基础上,有针对性地采取重点预防与一般预防,动态预防与静态预防,预防与打击相结合等措施,综合治理留所服刑罪犯的脱逃。     

“90后”服刑人员家庭特点分析——兼论针对“90后”服刑人员的家庭特点在改造中的策略

青少年犯罪已成为世界三大公害之一。中国在20世纪90年代确立市场经济以来,社会生活各方面巨大变化,作为社会负面的犯罪问题也随之出现新的特点,其中青少年犯罪尤为值得关注!纵观当代青少年罪犯,他们在年龄上有个共同点——＂90后＂。由于＂90后＂罪犯年龄上的特点,其家庭因素在其误入犯罪歧途及改造中均有不可忽视的作用。所以本课题组分析＂90后＂服刑人员家庭特点,希望利用家庭资源对＂90后＂服刑人员的改造发挥一份力量。     

The Prisoner Dilemma: Britain,Germany, and the Repatriation of Indian Prisoners of War

Abstract

Between October 1914 and December 1915, nearly 135,000 Indian riflemen—known as sepoys—fought in the trenches of France and Belgium at the battles of Ypres, Festubert, Givenchy, Neuve Chapelle, Second Ypres and Loos, suffering some 34,252 casualties. At a prisoner of war camp outside Berlin, Indian revolutionaries and emissaries from the Ottoman Empire attempted to convert the allegiances of the sepoys in their custody with a combination of pan-Islamic and nationalist appeals. Although this campaign ultimately failed, it profoundly shaped British repatriation policy at the end of the war when, cautioned Secretary of State for India Austen Chamberlain, the British could not allow men who had been exposed to ‘strongly hostile influences’ to return home unmonitored. The 1918 armistice and British repatriation policy therefore presented a host of new challenges to Britain’s colonial subjects from South Asia as they navigated the post-war imperial landscape and secured what was most important to them—safe transportation home.     

我国女性服刑人员MMPI测试结果分析

本研究采用明尼苏达多相人格量表(MMPI)对我国女性服刑人员进行测试,结果发现在押女性服刑人员人格与正常人人格没有显著差异;采用美国常模和中国常模的总体趋势是一致的,从现有的数据来看,美国常模对于区分高低分特征更具有现实意义;典型案例中的犯罪人员人格特征缺少普遍性,不能代表犯罪人群的总体。     

Health,Poverty and Service Use Among Older West Indian Women in Greater Hartford

SUMMARY

This study brings to light the phenomenon of aging in the West Indian migrant community in the United States. It presents the results of a cross-sectional exploratory survey of 107 community-dwelling West Indian women aged 55 years and over living in the Greater Hartford region of Connecticut. The data analysis reveals positive self-reports of health and few limiting or disabling conditions. However, there is substantial income inequality, a negative relationship between age group and income and limited use of services among those women most likely to require them. The findings suggest that some of the qualities which contributed to West Indians becoming the “Black success model” in the U.S. may be counterproductive for successful aging. A community-based strategy for addressing these issues is outlined.     

Voters should not be in prison! The rights of prisoners in a democracy

In Hirst v UK, the European Court of Human Rights ruled that the UK must end its blanket ban on convicted prisoners voting. In this paper I argue that the court’s reasoning undermines collective political self-determination by assuming away the essential connection between political citizenship and civil liberty in a representative democracy. I outline a democratic theory of imprisonment and argue that the democratic citizenship of imprisoned offenders is suspended not by their disenfranchisement but by their imprisonment. While many aspects of the UK’s penal practice are inconsistent with democratic self-government, the voting ban is not one of them. I conclude by outlining the numerous rights that prisoners should enjoy in a democracy.
