地方行政区划和府际关系的重构是20世纪以来中国现代国家制度建设工程的重要内容.关系到国家的政治稳定和地方社会经济的可持续发展。建国60年来,中国地方行政区划和府际关系的调整和改革,基本上延续了传统中国的治理逻辑和治理术,即以属地管辖和行政内部发包制为特征、由职权同构和行政分权构成的多层级的地方政府结构为基本治理结构。为适应工业化、市场化和城市化的现实要求,中国地方行政区划和府际关系必须根据法治政府、责任政府和公共服务型政府的制度设计,对既有的地方治理结构进行改革和调整。以民主化和地方自治促进和改善地方治理,使地方行政区划和府际关系以及相应的产权、财税权和人事权等制度走向法治化、制度化和规范化。  相似文献

This paper argues that in medical discourse, there is insufficient unanimity of opinion with regards to the time at which an accurate diagnosis of PVS can be made and that clearly, there is an incomplete medical knowledge of the PVS condition. The judiciary chooses neither to question medical opinion that patients can be considered to be in PVS despite a failure to satisfy the diagnostic criteria, nor medical opinion that patients in `near PVS' will never recover. It is apparent from an examination of the judgements given in PVS cases that the law does not ascribe such individuals with full human status. Such a legal position is particularly problematic in ethical terms when applied in cases involving patients who are in a `near PVS' position, and in the light of evidence that some PVS diagnoses are inaccurate. The application of the best interests test in PVS cases results in the adoption of a paternalistic, objective approach that fails to respect the former competent individuals whom PVS patients once were. If, alternatively, the substituted judgement test were to be adopted, the principle of individual autonomy would become central to the question of whether PVS patients' treatment should be withdrawn. Furthermore, the application of this test would also ensure that PVS patients continue to be viewed as `persons'.  相似文献

A persisting question in international studies is whether academic research can have an impact on the making of foreign policy. Much research has shown that policy decisions can be greatly influenced by misperceptions, just as much as by objective factors. The article describes an effort by academic researchers to challenge U.S. policymakers' image of an actor in the U.S. foreign policy process—the American public. The study's focus was a widely held assumption in the U.S. foreign policy community that the American public in the wake of the Cold War was entering a renewed phase of isolationism, similar to the interwar years. The study first interviewed policy practitioners on their perceptions of the public, then performed a comprehensive review of existing polling data, and finally conducted new polls with input from policymakers themselves. The net result of the elite interviews and the analysis of public attitudes revealed a significant gap in all areas, which is presented in synopsis. Interviews with policy practitioners reveal two key dynamics that could well contribute to policymakers' misreading the public: a failure to seek out information about the public and a tendency to assume that the vocal public is representative of the general public. Indications that the study did have some impact on the thinking of policy practitioners are discussed in the conclusion.  相似文献

制定自治条例和单行条例 (自治法规 )是民族区域自治地方自治机关的一项自治权。自治法规的效力等级高于一般地方性法规而具有法律性质 ,但其适用范围仅限于本民族区域自治地方。上级国家机关要尊重和保障民族区域自治地方自治机关的自治权 ,但自治法规不能规定和约束上级国家机关。制定机关和批准机关对于自治法规都享有“半个立法权”的说法 ,实际上是把报请批准自治法规视同提请审议自治法规案 ,把自治机关享有的自治法规制定权视同拟定权。自治州、自治县的自治法规报请省级人大常委会批准后生效的规定 ,是一项宪法原则 ,这是我国民族区域自治地方立法体制的一大特点。在自治法规的效力等级和适用范围问题上的分歧 ,源于如何正确认识民族区域自治制度。  相似文献

Although agricultural biotechnology has been a seminal reference point in risk perception studies, public awareness of their exposure to risk deriving from this new technology has been minimal at best. However, recent events indicate there may be growing public concern as new variations of this technology appear. Understanding what drives perceptions of benefits from the third generation of the agricultural biotechnology and what determines public worries are keys for the future of this technology. To this end, this study analyzes survey data from the midsouth region of the United States to construct four separate regression models of perceived benefits from and worries over plant‐made industrial products and plant‐made pharmaceuticals. Findings suggest that while prior experience with and knowledge about agricultural biotechnology has an impact on perceptions of benefits and worries, trust in farmers plays a highly important role in determining perceptions.  相似文献

1959-1961年的农业危机是在国家控制力极强、乡村社会自治性极弱的政治格局下,基层民众被迫执行国家一系列非理性政策的结果.近代以来,国家政权建设表现为单方面的国家权力下沉态势,地方社会的自治性不断削弱.随着1949年新政权的建立,国家对乡村社会的控制达到前所未有的规模与深度,二者演变为控制与被控制、挤压与被挤压的极端不对等关系.在此状态下,国家权力极度扩张而发生非理性的行为,乡村社会"缓冲地带"消融,面对外界的过度索取失去免疫力,无力抵抗,最终酿成农业危机.  相似文献

ABSTRACT

Anna Stilz defends a political autonomy account of self-determination that, she argues, best explains our intuitions about why colonization, annexation and foreign occupation are wrong. These are wrong, on Stilz’s view, because they unilaterally coerce individuals living under those systems of government. I argue that Stilz does not show that her account of self-determination explains our intuitions about autonomy in these kinds of cases, because she does not have a separate argument for the value of belonging to particular political groups.  相似文献
