单位化背景下的乡村关系——杨村调查

本文在简单回顾乡村关系制度变迁的基础上，考察了BJ市城乡结合部农村单位化现象，探讨了在单位化背景下乡村关系的表现形态及其意义。文章认为，改革开放以来，中国农村出现了两种倾向，一种是以个体经营为主的分散农户的原子化，而另一种倾向是以集体经营为主的村民单位化。在单位化乡村社区，村民的地缘意识、血缘意识在下降，而单位意识在提升和凸显。在城市化进程中，单位化了的村民担心自己被排斥在单位体制之外，而小心呵护着单位与村民之间的庇护与被庇护关系。本文的基本结论是，在单位化村庄中，乡村关系表现为单位体制下的上下级关系，具有强烈的行政色彩，村民自治的自治空间因此变得极为有限。     

Dealing with Diversity in the Construction of Indigenous Autonomy in the Sierra Norte of Oaxaca

Building autonomy in the Sierra Norte of Oaxaca has not depended on the development of Zapotec ethnic identities, isolation or rejection of the integration of outsiders into the communities. The communities of Ixtlán and Guelatao have developed strong local identities and strategies related to the appropriation of external legal categories, and the combination of these with their own customary practices to integrate newcomers into their social, political and economic organisation. Dialogue has been one of the main tools for building autonomy and achieve the integration of outsiders, while continuing the dynamic reproduction of their internal organisation and way of life.     

Does the Statutory Regulation of Advance Decision-Making Provide Adequate Respect for Patient Autonomy?

This paper considers advance decision-making in the context of healthcare. The common law recognition of advance decisions is contrasted with new statutory provision. This paper will examine the Mental Capacity Act 2005 framework for advance decisions and lasting powers of attorney. The ‚best interests’ test and substituted judgment as criteria for proxy decision-making are compared by application to a case example. The paper examines the statutory safeguards in respect of refusals of ‚life-sustaining treatment’ and postulates that these safeguards may render respect for autonomous advance decision-making difficult to achieve in practice.     

认真履行职责切实推进农村妇女参与村民自治

保障、提高农村妇女的政治参与程度是在农村落实男女平等基本国策的必然要求,是进一步深化村民自治的客观需要。十年来,民政部门一直把促进农村妇女参与村民自治作为的一项重要任务,完善各项政策措施,积极创造良好条件,将农村妇女参与村民自治工作进一步推向了深入。     

抑制残存宗族组织对村民自治制度负面影响的对策思考

各民族当代残存的宗族组织必然对我国正在全国范围内推行的村民自治制度造成千差万别的正负面影响 ,本文着力研究探讨残存宗族组织对村民自治制度所产生的负面影响的对策。笔者认为 ,加强村民自治建设的具体对策 ,应当从法律层次、经济层次、自身建设层次、社会文化层次四个层次着手。     

“It's not Fair!” Adolescents' Constructions of Appropriateness of Parental Reactions

Research suggests that perceived appropriateness of parental discipline plays a role in whether adolescents accept or reject parental messages, but little is known about how adolescents conceptualize or construct their ideas of appropriateness. One hundred twenty-two adolescents (M age = 16.87) answered questions about past situations (both antisocial and prosocial), how parents responded to these situations, the adolescent's perceived appropriateness of the parent's reaction, how the parent's reaction made the adolescent feel, and what the adolescent thought the parent's intentions were. Appropriateness ratings were related to the type of parental discipline used, with yelling associated with lower ratings of appropriateness and talking associated with higher ratings. Ratings were also related to adolescents' emotions, with negative emotions associated with lower ratings of appropriateness and positive emotions associated with higher ratings. Lastly, ratings were related to adolescents' perceptions of parental intent, with inhibiting and controlling intentions associated with lower ratings of appropriateness and caring and helping intentions associated with higher ratings.     

论民族地区教育行政制度创新--从新制度经济学视角的分析

文章运用新制度经济学的理论和方法,分析我国教育制度变迁的供求关系,分析我国民族地区教育及教育行政制度的特殊性,进而指出民族地区教育行政制度创新特殊的意义。     

New localism or fuzzy centralism: policymakers’ perceptions of public education and involvement in education

This research examines local authority involvement in education as a function of local policymakers’ perceptions of education as a public service – namely, whether public education is for the benefit of society as a whole, or for individual students and parents. Perceptions of education and involvement in education were assessed through 107 questionnaires returned by mayors and heads of local education departments in Israel. The results show that (1) local policymakers tend to perceive public education as a general public service, and (2) the relationship between this perception and involvement in education varies with the locality’s centre-periphery status. In peripheral localities, perceiving education as a general public service and an understanding of ‘society’ as the local community leads to greater involvement in education. In central localities, involvement rose with a more individualised perception. Implications of the findings are discussed in line with viewing education in the spirit of new localism.

民族自治区域享有自治权、法律的变通权,使民族自治区域法律冲突的产生成为必然。随着《民族区域自治法》及《国务院实施〈中华人民共和国民族区域自治法>若干规定》越来越有效地贯彻和实施,随着各自治区域不断开放和经济不断的发展,民族自治区域法律冲突,从产生的种类及数量上必然会越来越多,本文主要对法律冲突的成因及其解决进行探讨。
