关于城市社区党建工作的思考——延吉市新兴街道社区党建情况的调查

社区党建成为城市党建工作重点之一,是社会结构转型导致的必然结果。社区服务是街道党的主要职能和中心工作,发展基层民主政治、贯彻落实党的民族政策,是社区党建的主要任务。     

刑事调解制度在我国构建的文化与理论基础——从构建和谐社会的视角

任何一种法律制度的存在都根植于一定的文化与理论基础之上,刑事调解制度也不例外。研究刑事调解制度构建的文化与理论基础,可以为刑事调解制度的构建提供理论上的支持与制度设计上的参考;而刑事调解制度的成功构建,能够有效地促进我国刑事司法的人性化,更好地推动我国和谐社会的建设与发展。     

On Trojan Horses and revolving doors: Assessing the autonomy of national officials in the European Commission

National officials working in international bureaucracies regularly invoke the fear that member states strategically use such officials for influencing decision making and agenda‐setting to their advantage. This article theoretically analyses conditions under which the autonomy of national civil servants in international bureaucracies might become compromised. The ensuing predictions are then tested using a unique survey among seconded national experts (SNEs) in the European Commission (N ≈ 400). Finally, evaluating the characteristics linked to reduced autonomy among SNEs in the Commission, the article illustrates that these officials are, in practice, likely to be relatively independent from member state influence.     

The foreign policy and diplomatic attributes of a developmental state: South Africa as case study

With South Africa having declared itself a developmental state, this paper posits that if a developmental state is one that drives development, then the foreign policy of such a state should pursue development as one of its most important goals. Similarly the diplomatic corps of such a state should prioritise economic, commercial, para- and public diplomacy as drivers of diplomacy. In answering the question, ‘What should be the foreign policy and diplomatic attributes of a developmental state?’, the authors, through an exploratory approach, seek to analyse how well the state has fared in achieving this objective. To be a successful developmental state, a strategic capacity should exist and a clear strategic conception of the state's national interest should be formulated. Old paradigms about the role and functions of the diplomatic corps are challenged and a meritocratic diplomatic corps is strongly advocated to support the state's declared developmental goals.     

国家与乡村社会关系的演绎与1959-1961年的农业危机

1959-1961年的农业危机是在国家控制力极强、乡村社会自治性极弱的政治格局下,基层民众被迫执行国家一系列非理性政策的结果.近代以来,国家政权建设表现为单方面的国家权力下沉态势,地方社会的自治性不断削弱.随着1949年新政权的建立,国家对乡村社会的控制达到前所未有的规模与深度,二者演变为控制与被控制、挤压与被挤压的极端不对等关系.在此状态下,国家权力极度扩张而发生非理性的行为,乡村社会"缓冲地带"消融,面对外界的过度索取失去免疫力,无力抵抗,最终酿成农业危机.     

The classification of electoral systems: Bringing legislators back in

It is widely assumed that electoral institutions shape politicians' incentive for personal vote-seeking, with important behavioral and policy consequences. Yet, there is a surprising lack of consensus on how to compare real-world electoral institutions. Using new data this paper examines how legislators' own perception of their electoral incentives in fifteen democracies correspond to some of the most seminal classification schemes in political science. Our survey of 2326 legislators – the empirically broadest study of personal vote orientation so far conducted – demonstrates that legislators do not always understand electoral incentives in the same way scholarly rankings do, highlighting the need for scholars of political institutions to justify their choice of classification scheme. If not, an entire body of literature may be misguided.     

劳动人权与法律规范下的劳动自治

劳动人权是人权的重要内容之一,每个人都享有与生俱来的劳动权利。应当平等保障所有劳动者的劳动人权,以体现劳动价值。在此法律规范下,劳动自治作为意思自治在劳动关系领域的反映,体现了劳动权的契约自由。应允许符合劳动伦理的劳动力自由交易行为。国家应在国际劳工标准基础上,建立与社会物质生活条件相适应的劳动年龄制度,顾及未成年人和退休人员的劳动需求。法律对劳动权利应当保护性限制,而非限制性保护。     

论工会组织参与民事诉讼的理论支点与制度构建

现代诉讼理论早已抛弃严格的实体当事人概念,认为诉权和实体权利可以分离,这为工会组织基于职工利益参与民事诉讼奠定了理论基础。工会组织对自体权益受损以及职工的集体利益受损的案件具有诉讼利益,可以作为民事诉讼程序的当事人。对于职工个体利益受损的诉讼,工会组织则不具有诉讼利益,而应该以诉讼协助者的身份出现。在我国,由于工会自治性欠缺等原因,工会组织很少参与民事诉讼。解决这一问题的关键在于采取措施加强工会建设,提高工会组织的维权能力。     

The Changing Spaces of Local Governance in Nicaragua

This article considers the new spaces for the participation of civil society organisations (CSOs) in local governance that have emerged in Nicaragua between 2000 and 2009, and how government and CSOs interact in these spaces. It discusses the significant changes that have taken place in Nicaraguan local governance during this period, and highlights the challenges for CSOs to engage with these spaces at different points in time. It finds that grassroots CSOs in Managua that based their engagement with the Bolaños government through these spaces on citizenship have been drawn into a more clientelist relationship with Ortega's government.     

对外依存与中国外交的战略自主

改革开放四十年,中国经济得到长足发展,与此同时也带来了对外依存度偏高的风险,而经济上的对外依存与战略自主之间存在密切的相互影响关系。回顾一些大国的对外战略可以看出,相互依存直接影响对外战略,对外依存度过高会导致战略自主性的下降,从而极大缩减战略选项,甚至在一些关键节点不得不诉诸战略冒险。中国的对外依存与战略自主的关系也经历了复杂的演变过程。新中国成立后,中国一度采取"一边倒"的对外政策,在一定程度上影响了战略自主。改革开放之后,中国经济对外部市场、技术和能源的依存度不断上升,也在一定程度上限制了中国对外战略的全面自主发展。因此,中国的大国战略必须在外向与内顾、国际与国内之间保持适当的平衡,更为合理地协调对外依存与战略自主之间的关系,将全面深度改革开放与全方位外交布局紧密联系在一起。唯其如此,中国未来的大国外交才能行稳致远。
