Pandemic Disease: A Past and Future Challenge to Governance in the United States

Throughout history, pandemics have posed significant challenges to governments. Examination of the ways that governments have responded to pandemics can contribute to the U.S. government's ability to react in the future. We utilize past cases of Severe Acute Respiratory Syndrome (SARS) and multiple forms of influenza to identify specific challenges governments have faced. Based on that knowledge, we discuss the major issues that the United States will have to address in the event of a future pandemic.

Abstract

The widespread use of military language to describe modern epidemics is often attributed to the popularization of the germ theory of disease. Whatever its origins, critics regularly deplore martial imagery in the medical context finding it by turns dangerous, humiliating, and offensive. This article examines the most famous of these critiques, Susan Sontag's rebuttal of disease-as-war language, and finds it problematic in a number of respects. Mass emergency response to the Severe Acute Respiratory Syndrome (SARS) outbreak in Hong Kong in 2003 offers a cross-cultural case study in the use of representations of war. Key to the argument is the proposition that disease-as-war language expresses something ‘real’ not illusory, vital not frivolous, about the community which employs it. The language is a vehicle for articulating social emotions of collective fear, patriotism, homage, and exculpation in conditions that presage collective death

SARS是一场严重的公共危机,引发的刑事犯罪多种多样.尽管SARS的防治已被正式纳入传染病防治法律体系,但我国现行传染病防治法律制度的缺陷使得实践效果不佳,如何运用刑事责任这道"安全阀"来保障SARS防治工作存在不少盲点,对此,本文在对其缺陷进行了分析的基础上提出了具体对策,以期深化对SARS引发的刑事责任的认识,从而帮助完善传染病防治法律制度.

Westminster constitutions in the South Pacific: A “policy transfer” approach

Constitutional crises in Fiji and Solomon Islands and donor concerns about “good governance” raise older questions about the appropriateness of introduced constitutions to local conditions. This article analyses the process of transfer of “Westminster” constitutions in island states of the Pacific. It considers the factors that facilitated or constrained transfer into and within the region. It also considers cases where alternatives to Westminster were considered but rejected by the local leaders. The article concludes that Westminster has been spread by replication, almost irrespective of underlying social and political conditions.
