汉魏晋的礼仪立法与礼仪故事

在古代礼仪法的沿革发展史上 ,汉魏晋时代具有特殊而重要的地位。此间 ,礼仪立法繁荣 ,故事广泛运用。从形式上看 ,封建制的礼仪法在这一时期从草创发展到规模粗具 ,规范从零散、分散发展到系统化于一部专门的法典 ;就内容而言 ,从古礼到新礼的转化也在这一时期开始并基本完成。这为后世礼仪法制的成熟与完善奠定了坚实的基础

对于民法性质的界定,学界已达成共识.而关于"民法"语源之探讨,虽有所涉及,但仍显不足.本文即较为详尽地梳理了汉语"民法"在近代的缘起,尤其指出了"民律"至"民法"转化的过程及蕴意.     

中国法制史课程多元化教学方法探析——以《宋代法律制度》一章的教学为例

尽管中国法制史教育具有重要的现实意义,但从目前的教学实践来看,中国法制史课程未得到应有的重视。为改变这种状况,应采用多元化教学方法,即除了采用传统的讲授教学法外,还有必要引入案例教学法、比较教学法和多媒体教学法,从而增加课程的趣味性,激发学生的学习兴趣,培养学生独立的法律思维能力。本文以《宋代法律制度》一章的教学为例,探析多元化教学方法在中国法制史教学中的应用。     

人文主义传统中的青年角色

在欧洲从中世纪进入近现代的文艺复兴、宗教改革、启蒙运动这三大思想革命中,青年都扮演了重要角色,这是青年在人类历史上首次登上变革历史的舞台。当时的社会变革与青年成长形成水乳相融的互动关系,改变了历史中青年的社会存在与对青年的认识。青年日益被社会期待成为创造新价值观的承担者,历史也证明青年是创新人文主义和社会变革的生力军。     

Imagining modernity: the language and genealogy of modernity in nineteenth-century Arabic

This article employs the methodology of conceptual history to contest two of the most common theoretical approaches dominating our understanding of modernity in the field of Middle Eastern studies. The first approach relies on the assumption of incompatibility between modernity and Islam and captures Arab modernity using concepts such as ‘adoption’. The second understands Arab modernity through concepts such as ‘imitation’, contending that it is a legacy of Western imperialism. This article challenges both theories by examining the genealogy of tamaddun (civilization, being civilized), a pivotal concept used in nineteenth-century Arabic to imagine modernity. The genealogy of tamaddun elucidates that medieval paradigms derived from the concept of madina (polity) were rediscovered, reimagined, and reused in the context of the rise of the nation-state and the challenge of Western imperialism. The article suggests understanding Arab modernity and its critique from within, rather than outside of, the temporality of the historical condition.     

How should the Past be Treated in Estonian Schools? Constructions of History Teaching in an Estonian Teachers’ Newspaper

In the context of pluralization, globalization, and developments in pedagogy and academic history, ideas about the functions and objectives of history teaching (HT) have significantly diversified. Though traditional conceptions still prevail among the broader public, in professional circles traditional ideas about HT are accompanied by deconstructionist and multi-perspective approaches, deriving from the notion that history should not be regarded as true and unambiguous. The objective of this study is to discern the variety of representations of HT in Estonia, as reflected in an Estonian teachers’ weekly newspaper, an “interface” between the broader public and narrower professional spheres and discussions.     

Performative Translation Options Under The Soviet Regime

Translations must be read in their immediate social context in order to understand their performative meaning. The Soviet period in Estonia featured censored and self-censored public writing, whereas cultural discourse that doubted the hegemonic ideology could be conducted primarily through translation. This reality renders significant the selective differences between translators on both the metatextual and textual levels. The topic of this article is the translations of Enn Soosaar (1937–2010), a writer keenly aware of the value of his translations as weapons of communication trained on their environment.     

‘The highest flights of circumlocutory art’: Britain,Latvia and Recognizing the Soviet Annexation of 1940

The British Government never recognized the Soviet annexation of the Baltic States in June 1940, but almost did so early in 1942 and was ready to do so again in 1944, when it took at face value Stalin's revision of the Soviet constitution. The result was ‘trouble’ from the Baltic ambassadors in London, particularly the Latvian ambassador. The British Government changed its stance in autumn 1945 when the revisions to the Soviet constitution proved to be sham. Thereafter British policy amounted to procrastination, as the developing Cold War prevented a final post-war settlement.     

客观性的探索与主体性的确立——“日本的哲学”课题

真正的"哲学",应该说并不是在一个背离"生命"的、抽象思辨的过程中被捏造出来的学问。倒不如说,它的本质就在于我们的"存在经验的精炼化"。日本一直以来都是站在具体事象的立场,以自身的存在经验所凝练出来的精神活动为核心,由此来展开自身的学术研究。"日本的哲学"这一研究本身应该说带有了双重内涵:第一,应该是一个学术探索,即如今要站在"哲学的"基础上来认真地、客观地重新探索日本人的"人生观.世界观"的历史传承;第二,应该说是一个哲学研究,即不局限于第一个立场,而是要在"现代"这一科学技术极度发达、文明冲突与异文化摩擦频繁发生、充满了冲突与争执的全球化人类社会之中,我们日本人面对世界必须形成一种主体性的自觉,必须提出并树立起一种新的"哲学性"的"人生观·世界观"。     

从检察制度的历史与比较论我国检察官之定位与保障

改革开放以来,我国与国际社会交流频繁,特别是受美国制度影响,一直有将检察官行政官化的呼声。但是,从检察制度的历史渊源以及各国检察官类型的比较研究可以得知,纯粹行政官化的检察官并不契合我国社会。我国应将检察官定位为司法官,并仿效大陆法系国家,给予其充分的身份保障。
