在航空运输中,由于多种原因,航班延误难以避免,因航班延误引起的纠纷时有发生.现行的民航法及相关法规对于航班延误的定义、承担延误的责任原因、承担责任的方式、延误赔偿限额等问题或者没有规定,或者规定太原则、笼统、不统一,缺乏可操作性.时至今日,关于航班延误的诸多问题仍然不能"依法解决".有关部门应当尽快制定并完善相关法律法规,使航班延误的处理工作步入法制化的轨道,依法解决航班延误的有关问题. 相似文献

The nature of air disasters includes factors that exacerbate challenges in the identification process. Of the 49 deceased in the US Bangla air crash in Kathmandu, Nepal, four were intact, 11 presented with burn injuries, another 11 presented with partial charring, and 23 were completely charred. Personal belongings were useful in the identification phases for all types of victims. Fingerprints were obtainable and useful in intact victims and victims with less severe burn injuries; medical and surgical information was useful in bodies with burn injuries; finally, dental findings were useful in cases of extensive charring. Other useful methods in the process included marks of identification, physical features, and exclusion. In certain resource‐limited settings, especially in closed population disasters, where scientific identification (DNA, dental records, etc.) is not currently available, personal belongings, clothing, and physical findings analyzed by an identification team using a structured organization may be cautiously used as the primary means of identification. 相似文献

航空旅客运输有国际国内之分,在法律适用上有所差异;国际航空运输中主要适用华沙体系和1999年《蒙特利尔公约》,国内航空运输则适用各国国内法的规定。从国际航空公约和我国航空法对旅客损害赔偿责任体系的比较看,二者对旅客损害赔偿责任期间、损害构成、赔偿主体等规定模糊,我国航空法对旅客损害赔偿的归责原则规定的比较单一,赔偿标准较低。我国应当结合国际航空条约中的有益规定和国内相关法律中的规定对航空法进行修订,这是健全和完善我国航空法体系的必由之路。 相似文献

Van Parijs’s Linguistic Justice for Europe and the World furthers a nascent examination of multilingualism within political philosophy, drawing on continental European contexts where multilingualism is the norm. Van Parijs argues, in effect for linguistic cosmopolitanism via English as the current world language, and this seems ostensibly to be a considerable improvement on ‘the untrammeled public monolingualism’ of Anglo-American political theory. However, Van Parijs’s account is flawed in four key respects. First, there is the fundamental problem of his reductionist account of language – by which language is viewed only in terms of its communicative uses and reach and not in relation to its symbolic and identity functions. Second is his simplistic advocacy of English as a global lingua franca, which ignores issues of power and inequality, along with related delimited access to high-status English language varieties. Third are the inherent limitations associated with his advocacy of linguistic territoriality, which recognizes state-sanctioned languages but little else, thus failing to mitigate existing linguistic hierarchies. Finally, the wider argument for English as a global lingua franca is inevitably underpinned by a monolithic/hegemonic view of English itself. This monolithic conception of English stands in contradistinction, not only to the actual plethora of Englishes in the world today, but also, more importantly, to their widely varying status and use in furthering cross-communication and related notions of social and economic mobility. The latter thus fatally undermines Van Parijs’s central argument linking social and economic mobility ineluctably to access to English. 相似文献

This article considers whether the HOPE VI program has achieved two of its key goals: improving neighborhood conditions and increasing resident self-sufficiency. Findings from the Maverick Gardens HOPE VI program in Boston, Massachusetts are presented and discussed in the context of other research on HOPE VI and other relocation initiatives. Evidence from the Boston site affirms that the combination of relocation and redevelopment can lead to dramatic improvements in neighborhood quality for many – but not all – residents. Self-sufficiency outcomes, on the other hand, were not achieved: employment did not change, job networks were not expanded to new neighbors, and some residents experienced a decline in economic stability as a result of the program. Why HOPE VI has failed to improve neighborhood conditions for all residents and why it has failed to impact resident self-sufficiency is discussed, and how program goals and strategies might be adjusted to make it more effective is considered. 相似文献

This paper summarizes the social science research on the record of housing dispersal programs since 1995. The research shows a consistently disappointing record of benefits to low-income households. Households moved out of high-poverty neighborhoods, voluntarily and involuntarily, show few or no beneficial effects in terms of economic self-sufficiency, health benefits, or social integration. The benefits of dispersal are confined to feelings of greater safety and satisfaction with neighborhood environmental conditions. We offer a framework for understanding the disappointing record of dispersal, highlighting its translation from social science diagnosis to policy, problems in the policy's implementation, its underlying theory of poverty, and the political context within which dispersal has been applied. 相似文献

Over the last decade, the Housing Choice Voucher Program has grown to become the USA's primary strategy for providing safe, decent, and affordable housing. Annually serving more than 2 million low-income households, the program is designed to help low-income households afford private market rental housing. The program also allows for the “portability” of vouchers nationally between housing authority jurisdictions. Both features aim to mitigate the effects of concentrated poverty. Research on the Moving to Opportunity Program and the Gautreaux consent decree have produced data confirming that residential mobility can at times lead to positive opportunities for assisted households. This past research has been conducted on specific programs occurring outside of the general Housing Choice Voucher Program framework and has focused on household-level outcomes, paying little attention to the ways in which program administration may affect outcomes for voucher households. This article aims to understand voucher portability from the perspective of housing authority executive directors and program administrators, in order to better understand how program administration impacts the types of household outcomes observed in prior research. The results reveal that housing authority administrative practices and inter-housing authority relationships play a significant role in shaping the types of outcomes realized by porting voucher households. These findings suggest several changes to program administrative design and policy that may improve support for voucher households as they make portability moves. 相似文献
