Towards agonistic peacebuilding? Exploring the antagonism–agonism nexus in the Middle East Peace process

Many contemporary conflicts are framed as antagonistic and difficult to resolve because of their zero-sum framing among the disputants. This article addresses the antagonism–agonism nexus and the political and contested nature of building peace. It has a three-fold aim: (1) to critically assess the interplay between constructive and destructive dynamics; (2) to analyse the circumstances under which conflict may move from antagonism to agonism; and (3) to advance the novel notion of agonistic peacebuilding. The Middle East Peace process is used as a critical case of intractable conflict to elucidate the enabling and restraining conditions for agonistic peacebuilding.

论我国保险法上受益人之变更

保险合同以关系人利益为中心进行权利配置 ,这是保险合同与一般民事合同别异其趣之处。保险法上的相应规则亦应以是否有利于被保险人利益为标准来予以设计。只有被保险人才能根据自身利益处分保险合同利益。变更受益人由被保险人的单方行为来实现的。意思自治原则是保险法的核心理念 ,变更受益人无须强行法上的过多限制 ,变更受益人的行为不能当然解释为要式行为 ,在变更通知上应采书面通知的对抗主义模式 ,而不应采取成立主义和生效主义模式。我国现行保险法关于变更受益人的相关规则应据此作出修正。     

The role of memory in populist discourse: the case of the Italian Second Republic

Cento Bull's paper takes as its starting point Ernesto Laclau's and Chantal Mouffe's conceptualization of populism as counter-hegemonic, and argues, with reference to the Italian case, that populism not only takes the form of a rejection of the establishment and political elites, but also entails a construction of ‘the people’ that requires, as well as the development of empty signifiers as shown by Laclau, also the deployment of common myths based on a collective memory of an imagined past. Cento Bull therefore argues, in line with Ritchie Savage, that the role of memory in populist discourse has been underestimated. Specifically, many populist movements and leaders engage in a fundamental redefinition of who constitutes ‘the people’ accompanied by mistrust and demonization of the Other, which is predicated upon (and justified with recourse to) a reimagining of the nation's and/or democracy's ‘founding moment’. Furthermore, many populist movements make use of a political rhetoric revolving around the ‘anti-subversive impulse’ and aimed at instilling fear and a sense of being under threat.

民间法生成、运作及其发展的经济学分析

与国家法相对,民间法自生发于有限地域当中,其对特定群体的规制效果长久以来被归因于法律文化的传承,然而文化论的解释对于民间法何以能够成为法,何以能够成为文化,进而何以能够为个体所遵守却不能给出令人信服的答案,法经济学原理的分析进路为我们提供了找出深层原因的依据。因此,我们有必要以经济学原理为分析工具,揭示民间法在生成、运作及发展过程中为个体所接受并产生规制实效的原因所在。     

Emigrants and the state in Ethiopia: transnationalism and the challenges of political antagonism

ABSTRACT

Since the fall of military-socialist government in 1991 in Ethiopia, the Ethiopian Peoples' Revolutionary Democratic Front (EPRDF) has embarked on the total restructuring of the state. It has presented ‘Nations, Nationalities, and Peoples’ as an ‘organizing principle’ and it has been working towards the rebuilding of the Ethiopian state along this line. The focus of this paper is EPRDF's policies and practices of engagement of Ethiopian emigrants. The analysis is based on information and interviews with government officials in Addis Ababa and with Ethiopian migrants in Washington DC during February–May 2013. This study indicates that the EPRDF government gradually started to focus its attention on Ethiopian migrants around the world, mainly due to the growing economic significance of their transnational engagement in Ethiopia. The study also shows the circumstances in which political debates about the conditions in Ethiopia has been permeating interactions within Ethiopians emigrants.
