笔者在国内首次提出"蛇窝之诉"."蛇窝之诉"是美国的违宪审查之诉.当政府违背"正当法律程序"条款,将公民推入危险境地,该公民因此受到其他公民或者自然因素的侵害,政府应负赔偿责任.

知识经济和经济全球化是21世纪新的重要内涵,将带来人类生产方式的重大变革和世界范围内产业结构的提升,这对发展中国家和地区是一次重大的历史机遇。中国经济完全可以借助这种外部经济效应,推进非连续性的产业转换,由区域倾斜向产业倾斜转变,实施工业化反梯度推移战略,力求在不太长的时间内缩小同发达国家和地区的差距。     

Consumerism as a Civilizing Process: Israel and Judaism in the Second Age of Modernity

Modern post-emancipatory Jews have long been associated with cosmopolitanism, mostly as a bad thing. They've been anathematized as rootless cosmopolitans so often that cosmopolitan, used as a noun, is in some circles an anti-Semitic code word. During the heroic moments of Zionism, as with other liberation movements, this cosmopolitan strand of Judaism was de-emphasized in favor of conceptions that emphasized separateness and self-consciousness. There exists a side of Jewish identity that Zionism consciously suppressed, namely its urban, pleasure-loving, shopping-oriented cosmopolitanism. This exists also in social theory: Consumerism and modernism are joined at the hip because consumption is an indispensable part of the civilizing process. The process of consumption, of expressing our identity through tastes and possessions, changes the entire field of interaction. It makes possible new kinds of social identity. And it makes possible new forms of social integration, based on individuation and sympathy.     

Unequivocal Victims: The Historical Roots of the Mystification of the Female Complainant in Rape Cases

Historically, numbers of women complainants in rape trials have been regarded suspiciously, or prejudiced in that their credibility has been seriously called into question, or undermined, both from within and outside the courtroom. Arguably, public and legal perceptions as to the expected conduct and behaviour of the stereotypical rape victim have been grounded in the belief that genuine women who allege rape should act and portray themselves as unequivocal victims. This suggests that the contemporary construct of the female rape victim and her associated stereotypical image should be considered not solely as a legal derivative but also within a wider cultural context. This article explores the historical influences that shaped the cultural construct operating in the U.K., in particular, the societal and legal attitudes of the mid-Victorians towards women and sexual violence, creating an historical mystification around the construct of the female rape victim and the crime of rape itself. Reference is made to a number of cases reported in The Times newspaper between 1850–1885 which underline the requisite portrayal of the rape complainant as an unequivocal victim. It is argued that the relocation of this historical and socially constructed mythological imaginary within the context of the law and the trial process has disproportionately contributed to the modern scepticism which surrounds the female complainant. Corporate interests and public affairs: organised business–government relations in EU member states

The internationalisation of economic and political affairs changes the way in which business interests are brought to bear on public policy. This is a global phenomenon but can, in particular, be observed in Europe. The construction of the European Union, the development of the Single Market and the build‐up of the policy institutions to go with it, together change business–government relations profoundly. This paper answers the question of how organised business interests relate to government agencies and political institutions. By using the example of trade associations in the Netherlands and Germany, the paper shows that, despite the internationalisation of public affairs in Europe, the national political level remains strategically important for the representation of business interests. The paper thus argues that changes in European business–government relations are institutionally embedded at both the European and the national level. The implication for future research is that much of the dynamics of economic and political internationalisation materialises within the domestic arrangements of interest politics.
