从判决书看缓刑的适用

刑事司法政策、缓刑制度功能、刑法条文规定、犯罪案件类型及被告人自身情况等都是影响缓刑适用的因素。从判决书反映的情况来看,不管是基层法院还是中级法院,故意伤害案件和交通肇事案件缓刑适用率都相对较高,财产类犯罪案件则较少适用。在实践中,缓刑的适用主要存在对宽严相济刑事政策的把握不准,缓刑监督考察机制不健全等问题。可以考虑从这两方面入手完善我国的缓刑制度。     

Research on the Affordable Housing Community: Review and Prospect

The construction of affordable housing is not only housing construction，but also community cultivation. The construction of affordable housing community is one of the key indicators to determine the effectiveness of the housing policy. Based on collecting related literature in CNKI, the researcher conducts a quantitative analysis of the research literature on affordable housing in China by using Bicomb2.0. The study has found that the quantity of research results is closely related to the development of the policy. The research focuses on the housing policy, financing and post management. Community research is marginalized in the research heat maps, and research disciplines are mostly human geography, management and so on. Then the researcher reviews the four core issues in the study of affordable housing community, such as the spatial location and community segregation of affordable housing, the satisfaction and influencing factors of housing community, the neighborhood interaction and social integration of affordable housing community and public service and community governance of security housing community. Finally, the paper provides proposals for future study.     

我国社区治理“碎片化”整合机制探析

在我国社区治理不断深化的背景下,社区多元治理主体在参与治理过程中面临着"碎片化"困境,主要表现为治理主体的"碎片化"和治理过程的"碎片化"。治理主体"碎片化"分化为内部"碎片化"和外部"碎片化",治理过程"碎片化"表现为整体过程"碎片化"和具体过程"碎片化"。导致社区治理"碎片化"的根本原因在于多元治理主体的错位及协动不足。在未来的社区治理中,可以参考日本的社区协动治理机制,明确社区多元治理主体的角色定位,完善社区多元治理主体协动治理机制,以营造共建共治共享的良好氛围。     

强制性戒毒措施的实施现状及其改革

《中华人民共和国禁毒法》废除了传统的强制戒毒和劳教戒毒，重新确立了由强制隔离戒毒、社区戒毒和社区康复等三种新的戒毒措施构成的强制性戒毒体系。该法近五年的运作实践表明，这三种戒毒措施的实施效果违背了立法者的初衷，“宜粗不宜细”的立法模式所造成的弊端也逐渐开始显现。我国应该明确“社区为主、隔离为辅”的强制性戒毒措施体系，同时对强制隔离戒毒和社区戒毒进行制度性完善。     

应对数字艺术公共安全隐患的立法策略研究

当下数字艺术的产生和迅速崛起从根本上改变了原子艺术长期以来建构起来的艺术生态和艺术秩序,引发了某些引起人们重大关切的公共安全问题,其中突出的有网瘾问题、网络文化低俗化问题、数字谣言问题以及数字艺术知识产权保护问题等。这些问题不同于原子艺术公共安全隐患发生学上的外生性、随机性和个别性,而是呈现为内生性、公共性、流行性和危害性特征。一条比较可行的防控策略是在对数字艺术实施事前立法规范的同时,对数字艺术公共安全机制同步实施事后追溯监管。此外,加强数字艺术公共安全性及其应对机制的科研攻关和科普宣传,尽快提高全社会对数字艺术特殊规律及其公共安全性的认识和了解也是当务之急。

Since the early 2000s, the governments in ASEAN (the Association of South East Asian Nations) countries have developed ‘good agricultural practices’ (GAP) as public approaches to field-level quality assurance. Besides the primary goals of consumer food safety and quality assurance, these public GAP programs aim to support small-scale farmer inclusion in mainstream markets. This goal represents the antithesis of the prevailing trend that private GAP approaches have tightened integration with resourceful, large-scale producers in global value chains. This paper examines the compatibility of the goals of safety assurance and social justice in a public GAP approach through comparative analysis of Thailand's Q-GAP between two local contexts of fruit production and marketing. The research findings suggest that while the public GAP scheme could draw the participation of a broad cohort of local small-scale producers and serve to certify their production, its impact on changing producers' on-field practices and catalyzing their access to the global market through food safety assurance is limited. The binding factors include the lack of producers' understanding of the principles of the programme, limited additional economic merits for them, and the influence of extra-local market forces that stress economies of size and food quality rather than food safety.     

论社区矫正在刑罚中的运用

《中华人民共和国刑法修正案（八）》规定对判处管制、宣告缓刑、被假释的犯罪分子实施社区矫正,但对社区矫正如何执行并未做具体规定。针对社区矫正试点工作中存在的问题,应着重从社区矫正立法、执法理念及适用范围等方面,探讨如何进一步完善我国社区矫正制度。     

法律监督向社区矫正范畴的延伸

社区矫正在全国范围内试行,预示着我国刑罚制度由重刑主义向轻刑主义演化,这种新的行刑方式亦存在许多问题和不完善之处,检察机关须改进法律监督的职能,并向社区矫正全方位延伸,才能使社区矫正工作达到预期的矫正效果。     

近代西南地区少数民族基督徒群体社会心态探析

目前,学术界对基督教在西南少数民族地区的传播史的研究大多集中在教会活动方面,而对少数民族基督徒群体社会心态研究还很不够。其实他们的社会心态五彩缤纷,互相交织,内容极其丰富。所以,有必要对对其社会心态进行探析,以利于我们更好地把握西南少数民族社会的整体变迁。     

社区矫正中的公益劳动问题

公益劳动是我国当前社区矫正试点工作中的一项重要内容,其实践的操作运行中存在一些问题,急需改革。要想取得实质上的进展,需要对公益劳动进行科学的定位,解决公益劳动与刑罚轻重的问题,公益劳动的决定机构的问题以及公益劳动的强制性、规范性问题,并最终将公益劳动纳入到我国刑罚体系中。
