This study examines the contrast between initial and secondarymovements, and explores exile in relation to broader forms ofsecurity and need. It tests the assumption that safety is themost important consideration for refugees and looks at additionalinterests that they have and why. It contrasts conditions ininitial places of exile (experienced or anticipated) with thoseexpected of the UK and highlights reasons for subsequent movements,arguing that distinctions between stages are false and thateach is part of what exile means. This study shows that initialand irregular secondary movements arise because of the interestspeople have in accessing safety, as well as quality of lifeand certainty in exile. It concludes that it is only by wayof how refugees are defined that these are overlooked or aredistrusted by host areas, and recommends that hosts should revisitexpectations and properly respond to refugees’ needs.  相似文献

Scholars sometimes criticize durable regulatory systems for being costly, inefficient, ineffective, and inequitable. This article reassesses regulation, arguing that a mis-categorization of types of regulatory activity has led critics astray. More specifically, the article observes that regulation “hardened” by being built into infrastructure often ceases to be seen as regulation and its benefits are therefore inappropriately omitted from assessments of regulatory accomplishments. Hardening into one or another durable form can create two important benefits: durable regulation moves some items off the agenda of regulators, conserving resources for other regulatory work; durable regulation also creates regulatory endowments, preserving key bargains struck at the time infrastructure was created and reducing future opportunities for capture. Such endowments can then become the foundation for other regulatory work. Examples from the regulation of drinking water in the United States and brief discussions of road safety and disability regulation illustrate the argument.  相似文献

The current policy emphasis on data-driven decision-making is creating the right incentives for government agencies around the world that have not traditionally disseminated their administrative data to do so. The literature on statistical disclosure control focuses on the technical aspects of a variety of methods designed to protect data confidentiality. There is, however, a void in the literature in regard to what other elements are necessary to create and sustain a successful initiative. This paper examines six case studies of individual-level datasets. It reviews current practice in several domains and summarizes recommendations from expert practitioners including challenges for future initiatives.  相似文献

Legal context: Although traditional medicine constitutes a component part ofthe identity of the cultural communities concerned, this formof intangible cultural heritage is vulnerable in a globalizingworld where little place is left for the protection of beliefsystems. Key points: While much has been written on traditional knowledge and IPrights, less scholarly attention has focused on the culturaldimension of traditional medicine. Further, no solution hasbeen reached on the best way to ensure its protection. Thiscontribution attempts to establish a linkage between differentsectors of international law, addressing the complex interplaybetween traditional medicine, intended as a special form ofintangible cultural heritage, and international knowledge governance. While the TRIPS Agreement adopts only proprietary approachesto knowledge governance, it has been questioned whether, inthe case of pharmaceuticals, other non-proprietary approacheswould be preferable. Different approaches will be put forwardand the Draft Treaty on Medical Research and Development willbe considered. This would provide a better framework for safeguardingand diffusing traditional medicine. Practical significance: Protecting and promoting traditional medicine may help curingdiseases spread all over the world. Thus, beyond its culturalaspects, the practical importance of traditional medicine liesin its capacity to promote the right to health and human dignity.  相似文献
