犯罪危害性评价的方法论

犯罪危害性评价是我国传统刑法理论的核心内容。有关该问题的研究,学者们仅驻足于本体论与价值论层面,而在方法论层面则缺乏必要的深入。运用辩证思维探寻犯罪危害性评价的方法论,把握犯罪危害性评价的个体性与社会性、伦理性与政治性、历时性与共时性,不仅有助于犯罪危害性评价的科学化与合理化,而且对于进一步明确犯罪危害性理论的学科地位也将大有裨益。

Men and manners: Kantian humanism,rhetoric and the history of ethics

Modern humanist ethics (more Kantian than is sometimes thought) is driven by a will-to-perfection in the form of ideals of self-transcendence. This perfectionism entails a (would-be) exclusion or marginalisation of certain elements of ‘pre-Enlightenment’ ethical cultures bearing on rhetoric, manners and self-empowerment. This essay provides a set of conceptual-historical arguments preliminary to reinserting these disparaged elements into the forefront of a progressive ethos which, it is claimed, cannot afford to be exclusively dependent on an amalgam of Enlightenment and Romantic ideals. Ethics is irreducible to the realm of ideal and values, and there are other sorts.     

论道家生态伦理思想对建设“美丽中国”的启示

The Moral Imaginary of Discourse Ethics

Abstract

The central claim of this essay is that Habermas' pro gram of discourse ethics fails to establish the necessary immanent connection between the universality of discourse ethics and the quasi-transcendentalism, which is supposed to provide its ground. Habermas' attempt to avoid the spectre of subjectivism leads him to develop an understanding of universalism that hinges on a critical error, the confusion of subjectivity with ethical sub stance. Using Castoriadis' theory of the imagination to illuminate this failure, I demonstrate the way in which Habermas' moral theory of discourse inadvertently harbours a moral-imaginary horizon, a pre-political kernel which undercuts its capacity to serve as a universalist ethic.     

Discourse Ethics and the Normative Justification of Tolerance

Abstract

The following paper considers the extent to which discourse ethics can adequately respond to Habermas' own call for normative justification for the expectation of tolerance. It concludes that discourse ethics is able to lend its services to the flagging fortunes of the idea of toleration, not by seeking to underscore this idea with rationally compelling argumentation, but by offering insights into the possibilities opened up to a life which accepts this principle.     

基于环境伦理的旅游者环境行为差异分析

该文基于国内外环境伦理与环境行为相关理论,以大连为案例地,着重对不同环境伦理观旅游者之间的环境行为差异进行了研究。运用描述性统计分析发现,旅游者普遍认识到旅游发展对环境带来的负面影响。根据环境伦理倾向,通过聚类将旅游者分为生态中心者、立场中立者和立场模糊者。研究发现,不同伦理观念旅游者的环境行为之间存在差异,并以生态中心者的环境关注度最高。

错误扣船若干问题研究

错误扣船是依法扣船的异化。随着海事案件的日趋增多,错误扣船的概率也日益增多。目前,我国《海事诉讼法》对错误扣船并无具体的规定。因海事请求而申请扣押船舶是一种重要的海事请求保全制度．而实践中错误扣押船舶的情况又将造成一定的财产损失,而且会带来较大的负面影响。因此,为充分保护当事人的合法权益,亟待合理规范扣押船舶制度。
