国企公司化改制的关键:有效的公司治理

多数国有大中型企业实行公司化改制后 ,经营状况依然不佳 ,其直接原因在于公司的治理存在严重的问题和缺陷。现代公司虽然不可避免地出现代理问题 ,但规范的公司治理结构能有效缓解代理问题 ,使得现代公司制企业表现出强大的生命力。而国有企业的产权残缺性使公司治理结构中的直接监督和间接监督等有效的缓解代理问题的手段不能得到充分发挥。因此只有通过股权结构的分散化调整 ,使国有股不占控股地位 ,从而弱化国有产权代表在公司治理活动中的作用。与此同时 ,这也能充分发挥非国有股权所有者的积极作用。只有这样 ,国有企业公司化改制才能建立有效的公司治理结构 ,提高国有企业的运行效率     

行政指导新论

作为一类非强制性的行政作用,行政指导不仅能够与传统的依法行政理念相契合,而且其存在本身即预示着传统行政模式的转型。我国当下应谨慎地实施行政指导,并以过程的公开化、内容的科学化以及救济的类型化为基点,逐步将行政指导纳入法治化的轨道。     

Forensic science does not start in the lab: the concept of diagnostic field tests

An attempt to improve an analytical system can focus either on the actual processing or on the input. In forensic science, much emphasis has been placed on improving laboratory procedures, as though the input is already the best that can be obtained. Means of improving the basic input have gained much less attention. Yet, it must be agreed that even the best laboratory cannot gain from an item more than has been contained in it when it arrived from the field. The detection of latent materials at the crime scene by physical or chemical techniques and the diagnostic examination of material already discovered belong to the concept of diagnostic field tests. This group also includes "mapping" for the presence of certain materials, such as latent fingerprints through the distribution of amino acids on the surface. These tests are conducted outside the laboratory, without sophisticated instrumentation, at the crime scene, the suspect's home, or elsewhere. A significant advantage of the use of diagnostic field tests is the ability to deal with "dissipating evidence" such as gunshot residue or explosive traces on the hands of suspects. If time is lost, there is a risk of losing such evidence, which is liable to deteriorate rapidly. In my presentation, I will discuss older and some newly developed forensic field tests, with specific emphasis on the Israeli experience.     

侵占罪的管辖问题探讨

根据现行法律规定,公安机关对侵占罪没有管辖权,但可接受被害人的报案并可依法采取一定的紧急措施。检察院对侵占罪没有公诉权,它对被害人的代为告诉仍然没有脱离自诉程序的范围。法院对于检察院提起公诉的侵占案件不应当开庭审理,而应建议检察院撤回起诉。建议增加“在特定情形下公安机关可以对侵占罪行使管辖权”的法律规定。     

论我国警察制度再次创新的理论支点及实现途径

社区警务战略虽然在警察哲学与警务改革等诸多领域改变着传统,在打击犯罪与促进警察自身队伍建设方面取得了巨大成就,但存在着许多不足与局限性,诸如缺乏现实操作性、长效性不明显、公众热情无法持久、弱化了警察核心职能等。在这种背景下,新公共行政管理,如公共服务的契约外包、民营化等理念成为世界范围内的警察乃至我国警察制度再次创新的理论基础,新公共行政管理的核心特征已深深融入警察机关的管理结构,产生了警察行政的“优化管理实践”的许多新原则、紧缩与分权理念及私有化与竞争理念。     

“能动生存人”：教学管理的逻辑起点

任何一种管理理论或方法均以一定的人性假设为基础和逻辑起点.教学管理活动的特殊性使普通管理学的人性假设不适宜于此,应将教学管理的主客体定位于"能动生存人"这一逻辑起点上,以满足教学管理的特殊要求.将"能动生存人"作为教学管理理论的人性假设,就应该从对人的生命的深刻体悟出发、从人的生存性出发、从人的能动性出发来实施教学管理.     

Mobility and fusion in the literary field: the maverick poetry of Dolors Miquel

Abstract

With the aim of exploring the correlations between sociological and aesthetic areas, this article examines the mobility of poet Dolors Miquel in the Catalan literary field, where she has occupied positions ranging from the poetics of orality to ruralism, and where her work has been printed in the commercial press as well as underground publications. This paper ties that mobility in with practices of fusion such as the parodical discourse and camp, based on the hypothesis that in literatures affected by subordination, as is the case of Catalan literature, the partial overlapping of the spheres of general and restricted consumption is conducive to the emergence of dual languages. The satire, the revision of tradition, and the purposely “low-cost” tone that characterise Miquel’s poetry can be read as discourses formed by the combination of popularised stagings and elitist knowledge. Although this combination compromises the distinction between select minority and mass public audiences, it offers new answers to a question posed in the Catalan literature from the 1960s on and which continues to apply today: the question as to the space to be occupied by popular literature.     

Mobilizing Millennial Voters with Targeted Internet Advertisements: A Field Experiment

Internet advertisements have come under tremendous scrutiny recently for their potential to impact electoral outcomes. However, academic research has yet to determine if they have an effect on turnout. This article presents the results of a preregistered field experiment conducted in Dallas, Texas, in partnership with The Dallas Morning News in which individually targeted banner ads were able to generate a statistically significant increase in turnout among Millennial voters in a municipal election. The results show that a combination of information and voting reminder ads was effective, but only for voters in competitive districts. Estimated treatment effects were on par with a telephone mobilization campaign using live callers. These findings contribute to theoretical knowledge about the role of political knowledge and electoral competitiveness in voter mobilization, and offer a new method for testing online advertisements used by political campaigns.     

文明转型与权力转换:艺术集聚的文化空间再造

艺术集聚作为文化产业的空间载体之一，在精神社会层面具有文化空间再造的意义。从精神内核来看，艺术集聚的文化空间再造表征为由生产力与生产关系所驱动的文明形态转型。前工业文明、工业文明的文化空间在艺术集聚的活化与再造中得以重构，伴生于文明交融而彰显出更加显著的后工业文明特征。从另一层面来看，在艺术集聚变迁的场域斗争中，文化资本的能动性实践和被动性挤压，引发了文化空间的“僭越”与“变异”，这又从动态演进的符号权力转换视角，赋予艺术集聚文化空间再造以新的意涵。     

清末及民国地方教育行政体制的历史审思:1906—1949

清末民国时期,我国地方教育行政体制相继经历了成立劝学所、设教育科、恢复劝学所、成立教育局、教育局改组与重建、裁局设科、恢复设局等阶段。彰显出规范化、民主化、独立化、专业化与开放化等特征。同时,也存在着机构紊乱、目标理想、内容西化、方式激进等问题。清末民国地方教育行政体制的变迁历史对于当下我国地方教育行政体制改革具有重要的启示与借鉴意义。
