天人合一思想的当代诠释学意义

近年来 ,许多学者都注意到天人合一这一中国古代哲学思想蕴含着深刻的生态意义 ,但是 ,几乎都将其解释为天人“同”一而不是天人“合”一或天人“和”一。这种差异是巨大的 ,前者所追求的是自然与人的混沌未分 ,而后者则强调自然与人是分离并矛盾的 ,正因为其矛盾而构成了相互不可或缺的差异协同的互补性整体。     

共犯与身份问题初探——兼与日本刑法之比较

日本刑法65条对共犯与身份作了规定,我国刑法总则中没有涉及这个问题。日本刑法65条同时体现了"身份的连带作用"和"身份的个别作用"这一对看似矛盾的概念,而从共同犯罪的本质出发,也没有办法解决。只能从违法身份的连带作用和责任身份的个别作用这个角度,来消除这个矛盾。     

Foreign Investment and Trade in Cuban Development: A 50-Year Reassessment with Emphasis on the Post-1990 Period

This article provides a 50-year reassessment of foreign investment and trade in Cuba and locates this analysis within Cuban debates on development and the economics of transition. Transformations contextualised in these debates cover three periods. The 1959–1989 period was characterised by nationalisations and expropriations, the imposition of the US trade embargo, and the trade and economic assistance agreements signed with the Soviet Union. The Special Period crisis emerged in the 1990s and Cuba had to turn to foreign investment and alternative trade options while continuing to reject the adoption of open regionalism and neoliberal policies. The 2005–2008 period was characterised by Cuba's incorporation into the Bolivarian Alternative, a new regional integration model.     

近亲属请求死亡赔偿的法理基础

死亡抚恤金是国家或有关单位按相关法规规定给予死者近亲属和被扶养人一定金额的慰问金及生活补助费,抚恤金代替不了死亡赔偿。死者已无从取得主张赔偿的权利,但法律不能无视利益受到损害的近亲属。基于身份关系的重要性,从亲属法的角度进行分析,应当以近亲属身份权被侵害作为近亲属索赔的理论依据,近亲属不仅可以向直接致害人提起死亡赔偿,也可以要求学校和政府承担起相应的责任,这样才能使近亲属被侵害的身份利益得到真正的救济。     

东盟的经济安全观

20世纪80年代以来,由于国际政治经济环境的变迁,经济安全从原来的低级政治转变为高级政治。东盟传统的国家安全观强调综合安全,尤其将军事和政治安全置于最重要地位,随着地区传统安全威胁的消除,东盟国家将经济安全视为新时期的焦点。经济发展是东盟一些威权国家政治合法性的基础,因此经济安全是维护其政治安全的重要手段。为维护各国经济安全,东盟国家一方面采取经济自由化改革参与全球化进程以便提高自身经济竞争力,另一方面实行开放地区主义策略,既依靠本地区的集体力量增强经济实力,又充分利用地区外的市场和资源。     

公共关系视角下的企业生态化管理初探

以生态学的观点为元理论，将公共关系进行本质回归，探讨公共关系视角下企业与社会环境的互动匹配，生态位的内涵、价值和选择，以及生态智慧哲学，认为公共关系管理应该上升到生态化管理的高度，即企业运用传播沟通的手段促使其与社会环境的适应状态最优化，以形象生态位为基石，构建和维护基于生态智慧的和谐关系生态。     

The Freedom Front Plus: an analysis of Afrikaner politics and ethnic identity in the new South Africa

From the perspective of conflict analysis the main feature of contemporary South Africa is the absence of political violence. Yet it would be naive to think that the new political context is blissful to the point that ethnic tensions or anxieties do not exist. Certainly, for some groups, South Africa is not a place where ethnicity is no longer significant or politically relevant. This article explores contemporary issues relevant to Afrikaner politics and ethnicity in terms of concerns which have been voiced by its political organ – the Freedom Front Plus. The research findings point to the incompleteness of the process of conflict transformation in the country and identify certain factors that have given rise to a mood of alienation among some Afrikaners. Political and cultural disenchantment is manifested in a desire for territorial separatism. By exploring the Afrikaner perspective as it is articulated by the party, this article provides insight into the problems that surround inter-group reconciliation and nation-building in the country.     

反思欧盟制宪实践——哈贝马斯式的视角

在质料意义上而言,欧盟已经存在有宪政雏形。哈贝马斯认为,制宪将会促成欧洲范围内全方位、多层次的大辩论,为各国协商对话和沟通创造契机,产生政治公共领域,培育共同政治文化。文章指出,一部形式和规范意义上的欧盟宪法是社会治理系统工程的开端和象征,代表着一种新秩序,无论是在欧盟内部还是在世界舞台上。     

Groups Work for Women: Gender and Group Identity in Social Dilemmas

Behavior in social-dilemma (mixed-motive) situations has been of great interest to economists, psychologists, and negotiation scholars. In this study, we used a threshold social-dilemma game to examine factors that have not yet been investigated and that may have an impact on behavior in these settings: gender and group identity. We found that, for women, interacting with members of a naturally occurring group increased coordination and efficiency, while for men, interacting with members of a naturally occurring group decreased coordination and efficiency. Psychological literature on gender differences and group interdependence explains these differences. We conclude by discussing the implications of these results for gender differences in negotiation behavior.
