犯罪侦查活动的有效开展离不开群众的参与,而长期形成的保密制度使侦查程序往往是在"屏蔽"指挥的谋略下进行,虽能避免一些法外因素的干扰,但其封闭性也滋生出诸多负面效应。确立侦查适度公开原则,允许新闻媒体对犯罪信息进行恰当报道,不仅有利于破获案件和收集证据,还能在强化公民知情权的同时监督侦查活动的合法进行。  相似文献

近年来,我国有部分检察机关在职能配置方面做出改革,将诉讼职能与监督职能进行不同程度的分离。两职能的分离可以在一定程度上减少检察机关作为控方当事人和中立监督者之间的角色冲突,提升內外监督的适用效果。但在实践中,两职能在功能和运行上都难以分离,即使分离也会导致诉讼效率上的问题。因此,我们应正视检察机关职能配置改革中的局限性;坚持以诉讼职能为主,监督职能为辅的基本原则;在原运行模式的基础上,采取将一部分职能适度分离的优化进路;不同层级检察机关可结合各自特点,采用不同的职能配置模式。  相似文献

Despite putting themselves in a thorny relationship with heavy-handed party leaders, some US legislators continue to join moderate coalitions. To understand why, this article derives seven explicit hypotheses concerning electoral, institutional, and strategic dimensions and tests them on two moderate coalitions from the 107th to the 110th Congress (2001–8): the Republican Main Street Partnership and the New Democrat Coalition, along with the Senate's ‘Gang of 14’ during the 109th Congress (2005–6). The article finds that, as expected, a member's ideology and previous affiliation strongly predict who joins these caucuses. What is surprising from the findings is that the constituencies' partisanship does not always predict the legislators' decision to be a moderate caucus member. There is little evidence that more electorally vulnerable members join these caucuses; on the contrary, when it does matter, members from competitive districts appear to stay away from moderate coalitions. Therefore, the findings call into question the prevailing ‘constituency-based’ understanding of moderate coalition membership in a polarised Congress and call for a new examination of electoral connection between moderate members and moderate caucuses.  相似文献

不同的历史时期,监狱呈现出具有时代特色的形态,监狱形态蕴含着监狱的管理理念,我国《监狱设计标准》的修订为监狱布局调整提供了项目论证、决策、实施的重要依据。同时,所体现出的监狱管理理念主要有分类建设和分类管理的理念、规模适度的理念、过程管理的理念、安全稳定的理念、以教育改造为中心任务的理念、对监狱人民警察人文关怀的理念、保障罪犯合法权益的理念等。这些理念的落实面临主观和客观两方面的困难。监狱形态不是单一的建筑问题,它折射了监狱刑罚理念、法治思想、社会文化和社会文明,因此,与时俱进,有必要探索监狱形态设计新的发展路径。  相似文献

Despite the escalating terrorist actions, there is no polarized constellation in the Islamic politics of Dagestan. Russia's Federal Security Service (FSB) officers regard the corrupt Dagestan authorities to be significantly responsible for the massive conversion of youths to terrorism, and began to contact with moderate Salafis to isolate the “forest brothers” (armed Salafis) in 2010. Exploiting the FSB's soft strategy, secular intellectuals requested to reform the Muslim Spiritual Board of Dagestan by electing a legitimate mufti. Having seen the incompetence of intra-Sufi opposition (non-Avar sheikhs) in the War on Terror, the Spiritual Board jumped on the bandwagon of dialog strategy in 2012. The secular authorities of Dagestan, indifferent to intra-Muslim politics, limit their activities to the call for dialog between the secular authorities and the forest brothers. In this way, political actors hijack the master narrative of the “War on Terror” and these narratives are imported to local politics.  相似文献

The international crisis has exerted a strong impact on the National Innovation Systems (NIS) of three Southern European economies: Italy, Portugal and Spain. These countries represent interesting cases for analysing responses to the crisis because they show a sort of innovation paradox: despite the weakness of their institutional systems and the defensive policies developed by governments, some of their companies have nevertheless been able to innovate even during the hardest years of the recession. In order to shed light on this paradox, three matters are taken into account: the distinctive features of the South European National Innovation Systems; the behaviour of governments and companies; the ‘generative dynamics’ and the ‘creative processes’ that have taken place during the crisis.  相似文献
