组织视角下的民事诉讼发回重审制度

民诉法学界和实务界有关二审程序中的发回重审存在较大争议,该制度成为本次民诉法修改的重要议题之一。为了形成共识,对这一问题从法解释论的角度进行阐释解说尤为必要。为了限制发回重审裁量权的滥用,我国司法实践中采用程序细化与加强对审判的组织管理并行的策略。不过这种"程序"与"组织"的交织并不能真正抑制裁量权滥用,反而因剥夺当事人的程序参与权而损害审判的公信力。为调整二者的相互关系,应在审判管理的组织背景下保障审判程序的自主性,恢复当事人在程序运作中的结构性位置。     

我国有限合伙企业合伙人身份转变规定的完善

合伙人身份转变与合伙人数量变更是合伙人变动的两种情形。我国《合伙企业法》虽对合伙人身份转变作出了一些规定,但在内容上存在着很大缺陷。应当加强对有限合伙企业合伙人身份转变过程中债权人利益的保护。立法者可以通过付与有限合伙企业告知义务和赋予其债权人异议权,以充分保障普通合伙人转变为有限合伙人过程中有限合伙企业债权人的利益。

组织公正理论视阈下的工作场所暴力问题分析

工作场所暴力是指发生在工作场所或工作场所以外与工作关系有关的暴力行为,是针对人实施的身体侵害或心理威胁以及针对财物实施的损毁行为。组织公正是组织或单位内人们对与个人礼仪有关的组织制度、政策和公平的主观感受,组织的公正性状况影响工作场所暴力的发生情况。工作场所暴力的应对以预防为主,制度公正、管理公正和有效沟通以及组织公正文化能防范工作场所暴力的发生。加强组织的环境建设、建立组织安全预案和安全预警机制以及发展组织内部的支持资源是预防工作场所暴力发生的重要措施。     

Mandated justice: The potential promise and possible pitfalls of mandating procedural justice in the workplace

This study addresses the question of whether and how legal authorities ought to intervene in work organizations in order to most effectively regulate the behavior of employees. This question is examined empirically, by exploring whether the association between the level of fairness employees experience in procedures regarding pay and benefits, and their adherence to workplace rules, differs depending upon whether those procedures are enacted by companies voluntarily or mandated by law. This question was addressed using both a survey of a representative sample of employees in Israel, as well as their reactions to an experimental vignette. The results generally suggest that evaluations of the procedural justice of performance appraisal hearings more strongly influenced judgments of overall workplace fairness, perceptions of management legitimacy, and employee rule‐adherence behavior when employees believed fairer workplace procedures were required by law.     

公共部门人力资源编制管理流程再造:机理与策略

公共部门编制管理流程再造是公共部门人力资源管理变革的核心内容之一。传统编制管理流程在编制占有上以"部门所有"为导引,在编制分配上以"三定方案"为核心,在编制审批上以"流程割裂"为特色,在编制管理上以"手工操作"为手段,在编制监督上以"控制失灵"为常态。编制管理"金堂模式"的核心内容是:编制审批前置、集中编制资源、双轨动态调整、信息技术支撑。新流程按照"三元"衔接的管理思路,即编制管理部门与组织人事部门、财政预算部门相互衔接,共同为执行编制负责,在实践中推动了绩效提升。

近年来,吉林省民间组织的发展已经迈上了一个新台阶。对吉林省民间组织的研究也日益成为吉林省政府与相关学者们研究的一个重要课题。本文概括地分析了吉林省民间组织的发展状况,结合当前政府职能转变的契机,从政府和民间组织两个方面对吉林省民间组织发展的路径提出建议。     

A Bayesian Approach to Age Estimation in Modern Americans from the Clavicle*

Abstract: Clavicles from 1289 individuals from cohorts spanning the 20th century were scored with two scoring systems. Transition analysis and Bayesian statistics were used to obtain robust age ranges that are less sensitive to the effects of age mimicry and developmental outliers than age ranges obtained using a percentile approach. Observer error tests showed that a simple three‐phase scoring system proved the least subjective, while retaining accuracy levels. Additionally, significant sexual dimorphism was detected in the onset of fusion, with women commencing fusion at least a year earlier than men (women transition to fusion at approximately 15 years of age and men at 16 years). Significant secular trends were apparent in the onset of skeletal maturation, with modern Americans transitioning to fusion approximately 4 years earlier than early 20th century Americans and 3.5 years earlier than Korean War era Americans. These results underscore the importance of using modern standards to estimate age in modern individuals.     

Cybercrime investigation in Finland

Nordic police cooperation concerning cybercrimes has been developed during the last few years, e.g. through the Nordic Computer Forensics Investigators (NCFI) and Nordplus training programmes. More empirical research is needed in order to enhance cybercrime investigation and address the training needs of police officers. There is a knowledge gap concerning organizational models for the police’s cybercrime investigation: How the function is organized, what the professional characteristics of the staff are and how to combine computer forensics with crime investigation? The purpose of this paper was to study the organization of cybercrime investigation in Finland. Data were collected by a questionnaire from all 11 local police districts and the National Bureau of Investigation in July–August 2014. In addition, six thematic interviews of cybercrime investigators were conducted in 2014. Three investigation models of computer integrity crimes were found: (1) Computer forensic investigators conduct the entire pre-trial examination, (2) Computer forensic investigators conduct only the computer forensics, and tactical investigation is done by an occasional investigator, (3) Computer forensic investigators conduct only the computer forensics and tactical investigation is centralized to designated investigators. The recognition of various organizational models and educational backgrounds of investigators will help to develop cybercrime investigation training.
