论形势与政策课程教学中理性思维能力的培养与国际政治理论——以中国—东盟伙伴关系建构为例

当前,中国—东盟伙伴关系建构作为高校＂形势与政策＂课程的一个主要内容受到较多的关注。由于种种原因,当前＂形势与政策＂课程的教学中存在＂理性思维＂缺失的情况,这不利于学生把握中国—东盟伙伴关系建构的实质获得独立完整的人格和科学的能力结构体系。本文认为,通过在坚持马克思主义科学方法论的基础上,引入主流国际政治理论并以其为视角分析国际问题,能够有效地弥补现有教育的不足,提高学生的理性思维能力。     

A literature review of partnerships

In today＇s competitive era, all organizations and enterprises, including small and medium enterprises （SMEs）, should have collaboration with each other to survive and they cannot be globally successful by working alone. A partnership is the relationship existing between two or more persons or entities that join to carry on a trade or business. Each one contributes money, property, labor or skill, and expects to share the profits and losses of the business. There are different types of partnerships, and organizations should inform from them and apply from it in suitable cases. Each partnership has its own advantages and disadvantages as well. This paper aims to describe some types of partnerships between governments, communities, new social movements and firms.

关于建立我国有限合伙制度的法律思考

我国现行法律未明确规定有限合伙,原先对推行有限合伙的各种担忧在市场经济快速发展的今天已显得苍白无力。走主体立法之路,建立我国有限合伙制度是必然的选择。以登记为主要方式的公示制度和表见普通合伙人责任制度的确立以及承认法人合伙,也是非常必要的。

有限责任合伙立法,是专业合伙为规避普通合伙无限连带责任所产生的经营风险的产物.但如今美国绝大多数州立法及英国等国立法都已将有限责任合伙的适用范围扩展到各种营业.在美国的影响下,英美法系国家和地区也纷纷制定了有限责任合伙法,并且大多采取的是独立立法的形式.为保护债权人权益,各国立法规定了建立替代性的赔偿资源、限制合伙分派及资产取回等制度.作为一种制度创新,特殊普通合伙企业固然一定程度上满足了以会计师事务所、律师事务所为代表的专业服务机构的迫切需要,但该制度仍存在明显的缺陷.不过,这些缺陷均可通过合适方案加以补救.     

Angola and Kenya Pavilions in the 2013 Venice Biennale: African Contemporary Art and Cultural Diplomacy in the “Olympics of Art”

A record six African states were awarded a national pavilion at the 2013 Venice Biennale, the premier venue for showcasing a nation's contemporary art, from which Africa has historically been excluded. While first-time participant Angola won the top prize, Kenya's pavilion was the target of bafflement and ire. Using a cultural diplomacy framework that integrates the insights of leading scholars, this research makes concrete recommendations for practitioners vis-à-vis a comparative case study of the two pavilions. Analysis and recommendations consider the interests of a variety of stakeholders and offer insights relevant to Africa and other emerging regions.     

企业法律形态的分化设计
