无效法律行为之探讨——海峡两岸相关概念之比较

在民法上，“法律行为”向为建立法律关系之基础，亦为民法体系中之重要核心。中国大陆民法总则编建议稿有关“法律行为”之规定，亦为民法核心之一，且其规范之条文，系重要民法立法。而“法律行为”可谓已成为任何一种民法之基础。法律行为之存在，在某些情状下仍有可能衍生“无效”之问题。在我国台湾地区，法律行为之无效，系指按照法律之一定条件，对于已成立之法律行为进行评价后，所得之否定性结论。然而，我国台湾地区民法第一百一十三条与现行制度，例如不当得利、物上请求权或第二百四十七条之给付不能、第九百七十九条之1订婚赠与物之返还等，规范上明显冲突。该民法第113条为大陆民法所无，故有就海峡两岸相关概念加以比较之必要。     

地方政府开展绩效评估的科学路径

政府绩效评估是一种有效的政府管理模式和手段,开展地方政府绩效评估已成为我国行政管理创新的重要实践。因此,选择地方政府绩效评估的科学路径,促进地方政府绩效评估健康发展,是我国推进地方政府绩效评估面临的一个战略议题。     

铁路公安机关转制后组织结构与绩效评估改革初探

铁路公安机关转制是政治体制改革的一部分。转制后,铁路公安机关警务活动外部环境发生了变化,直接参与铁路建设的非警务活动也将减少。为了适应这些变化,铁路公安机关一方面要从宏观结构和微观结构两个方面构建均衡、合理的组织结构,另一方面要科学界定警务绩效评估内容,制订主客观相结合的警务绩效评估标准。     

Correlation Between Employee Bonus and Company Performances＂ FTSE TWSE Taiwan 50 Index Companies

In addition to examining the efl＇ect of employee compensation tools on its financial report, a public company should evaluate whether such tools could also retain or attract talent that can strengthen its competitiveness. This research aims to study how an employee reward system could impact on a company＇s performance, and develop a theory on how enterprises choose their employee reward plan. Taking into consideration that there is a lack of agreed objective of an employee reward plan, this paper attempts to evaluate the need for an employee reward system and its effectiveness from the perspective of how a system is implemented. In order to explore the relationship between an employee reward system and company performance, this research will compare in total the performance of 80 companies between 2002 and 2012：50 of them are from the FTSE TWSE Taiwan 50 index that have a reward system and the other 30 are also listed companies but without a structured reward plan in place. The findings include that companies with an employee reward system generally perform better than those without one, and this is especially the case for those implementing a single employee bonus system than those with multiple systems. It is found that the employee reward tools can have a positive impact on a company＇s performance, particularly employee cash dividends and employee shares and bonuses.     

政府绩效审计的国际比较

研究各国政府在审计机构隶属关系、审计标准、审计内容以及对政府绩效提高方面民间审计作用的比较,对于审计部门更好地开展工作,尤其是加快推进我国政府绩效审计工作具有十分重要的借鉴意义,也是改进我国绩效审计工作的重要着眼点之一。     

The Impact of Knowledge Sharing on Work Performance: An Empirical Analysis of the Public Employees' Perceptions in South Korea

This article examines the impact of knowledge sharing on individual work performance by analyzing perceptions of 323 public employees in South Korea. An analytical model is drawn from an extensive review of literature on knowledge management and sharing from which nine exogenous variables are identified as antecedents of knowledge sharing that affect individual work performance. The results indicate that four exogenous variables—employee training, reward systems, support from the top management, and openness in communication—are perceived to have a positive influence on employees' knowledge sharing, which, in turn, improved individual work performance. Perceived trustworthiness between individuals involved in knowledge sharing has also positively influenced both knowledge sharing and individual work performance. These results imply that individual work performance may be dependent on the effective use of knowledge sharing.     

解读警察执法行为艺术

警察执法行为艺术作为技艺之学,是指警察执法行为在执法理念指导下,依法运用科学、规范的执法技巧与方法,妥善处置警务,以达到最佳执法效果的状态。警察执法行为艺术的构成要素是由执法理念、执法规范、执法技巧与方法、执法效果所组成的。警察执法行为艺术可分为语言艺术与行为艺术两类,在警务活动中表现为两种形态,即警察执法行为的过程形态和结果形态。培育警察执法行为艺术的目的是减少与化解执法冲突,提高执法水平,追求执法公正,实现和谐执法。     

政府职能转变中绩效评估的工具作用

理论上，政府职能转变可以从狭义和广义两方面进行理解，党的十八届三中全会通过的《中共中央关于全面深化改革若干重大问题的决定》为解读政府职能转变提供了经典的范本。宏观层面的政府职能转变总体比较顺畅，在微观层面，政府职能转变的困境既有客观的因素，也有主观的原因。在内容上，职责不明、关系不顺的问题大量存在。运用政府绩效评估是促进政府职能转变的重要方法工具。政府绩效评估可以提供战略性的导向机制、操作性的了解机制和确定性的责任机制，有助于推动政府职能转变。     

Listening and moving in the urban environment

This article discusses The Language of the Listening Body, a collaborative creative project between choreographer Hope Mohr and composer Michelle Nagai exploring an active listening and moving practice in the urban environment of New York City. Mohr discusses listening and moving practices in the studio and in ‘soundwalks’—walking meditations where participants are encouraged to maintain a high level of sonic awareness. The article discusses discoveries and questions that arose during a creative process with a focus on: (1) the relationship between listening-based movement research and public soundwalks, and (2) the unique issues involved in environmentally based creative process and performance.
