Legitimacy is essential to state-building after conflict. Yet, the prescribed path to gaining legitimacy is often a narrow one that borrows heavily from the experiences of Western states. Elections are prescribed as an essential first step on the logic that this means gaining process legitimacy can rebuild a social contract between citizens and the state, a social contract that is rooted in democratic norms and values. This article proposes an alternative path, one that emphasises the critical role of performance legitimacy and its non-exclusive nature. Performance legitimacy is granted when citizens perceive that some or all of their basic needs are being met. The article offers a new analytical framework for understanding a state’s potential source of performance legitimacy, how non-state actors may vie with the state to seize this form of legitimacy, and what consequences this has for processes of state institution-building after conflict. In this respect, this article seeks to reorient theory and practice to a broader view of legitimacy and its critical role in post-conflict state-building.  相似文献

Abstract

Following the end of the Cold War, post-conflict democratisation has rarely occurred without a significant international involvement. This contribution argues that an explanation of the outcomes of post-conflict democratisation requires more than an examination of external actors, their mission mandates or their capabilities and deficiencies. In addition, there is a need to study domestic elites, their preferences and motivations, as well as their perceptions of and their reactions to external interference. Moreover, the patterns of external–internal interactions may explain the trajectory of state-building and democracy promotion efforts. These issues deserve more attention from both scholars and practitioners in the fields of peace- and state-building, democracy promotion, regime transition and elite research. Analyses of external actors and domestic elites in post-conflict democratisation should therefore address three principal issues: (1) the identification of relevant domestic elites in externally induced or monitored state-building and democratisation processes, (2) the dynamics of external–domestic interactions and (3) the impact of these interactions on the outcomes of post-conflict democratisation.  相似文献

This article investigates whether a ‘light footprint’ approach to peacekeeping and peacebuilding by the international community more effectively addresses local drivers of conflict than the dominant model of large, multidimensional peace operations. It considers international engagement in the Nepalese peace process through the United Nations Mission in Nepal (UNMIN), and argues that the international community’s approach to local ownership became more focused on non-imposition and therefore less politically engaged over time as a result of both local and international factors. This facilitated local elite ownership of the process, which fundamentally undermined the international community’s capacity to support peace consolidation as elites moved away from key transformational pledges of the peace settlement.  相似文献

In this Special Section, this article reviews South Korean views on Japan's ‘peace’ Constitution and the Abe government's attempts at constitutional reform. It identifies three different understandings among South Korean academics on why Japan is escalating attempts to revise the Constitution under the Abe government. An in-depth analysis demonstrates that all three perspectives pay specific attention to Japan's constitutional reform in relation to security policy changes. However, they differ in assessing the impact of Japan's constitutional reform on South Korea as well as how South Korea should deal with such a change. A minority opinion considers Japan's ‘remilitarisation’ through constitutional revision as conducive to South Korean security interests by increasing deterrence against North Korea, whereas the dominant opinion is that any attempt to revise the Constitution could be in and of itself a potential threat to South Korea's security due to a lack of trust attributed to unresolved historical conflicts between Korea and Japan. However, all three approaches pay hardly any attention to the positive role of Japan's peace Constitution while Japan's peace Constitution might provide a regional peace model in Northeast Asia.  相似文献

Five years after people took to the streets in protest at political organisation across the Middle East, the consequences of these actions remain. As the protests gained traction, states began to fragment and regimes sought to retain power, whatever the cost. While a great deal of focus has been upon what happened, very little attention has been paid to the role of agency within the context of the fragmenting sovereignty and political change. This article contributes to these debates by applying the work of Giorgio Agamben to the post-Arab Uprisings Middle East, to understand the relationship between rulers and ruled along with the fragmentation of the sovereign state. The article argues for the need to bring agency back into conceptual debates about sovereignty within the Middle East. It concludes by presenting a framework that offers an approach building upon Agamben’s bare life.  相似文献

The plural legal system in post-conflict Liberia expresses tensions between modern and customary institutions. This article seeks to understand how Liberians navigate choices in the plural legal system to address gender-based violence cases. By asking how and why people make the choices they do, we highlight how Liberians solve tensions between institutions, by creating flexible categories that allow them to pursue a course of action that does not compromise their ability to access social networks and resources.  相似文献

This paper intends to contribute to recent developments in the theory of critical peace education. The role of cosmopolitanism in critical peace education is examined, particularly in relation to universal moral inclusion, secularism and universalism. It is then recommended that critical peace education draw from post-universalist and dialogical approaches to cosmopolitanism. Walter Mignolo’s border cosmopolitanism is suggested as a decolonising framework for critical peace education. This would entail the theory of critical peace education orienting itself towards the aim of reconsidering cosmopolitanism from the perspective of coloniality. Connections are drawn between border cosmopolitanism and Paulo Freire’s problem-posing education. The result is a vision for critical peace education to empower participants through centring personal and lived experience in critical deconstructions of cosmopolitan discourses.  相似文献

About half of the nations that experience civil war eventually relapse into renewed conflict within a few years after the original war ends. This observation has motivated a stream of research into the factors that affect the risk of peace failure in the aftermath of civil war. While the outcome of the previous civil war—for example, military victory versus peace agreement—structures the post-war environment in ways that affect the risk of peace failure, the capacity of the post-war state to enact and implement policies that affect the incentives for and capacity of groups to undertake armed violence as a means of advancing their interests should also affect the risks of peace failure. Using Geddes’ categories of nondemocratic regime types, we will present a theory of how different regime types have varying capacities to repress and/or implement accommodative policies that affect the risk of peace failure. We test propositions derived from this theory with a series of event history models. Our findings suggest that while peace agreements significantly increase the duration of post-civil war peace, peace agreements involving some types of nondemocratic regimes actually increase the risk of post-civil war peace failure.  相似文献

There is a palpable sense of humility within the United Nations and other international institutions regarding peacebuilding. Rather than seeking to implement the liberal peace, they now pursue the more modest goal of ‘good enough’ outcomes. This shift reflects a growing consensus in the critical literature that space needs to be provided for the local agency that will ultimately determine the outcomes of peacebuilding. At first blush this emphasis on local agency is positive; it offers an important correction to the technocratic and generally top-down nature of liberal peacebuilding. But, is the ‘good enough’ approach to peacebuilding good enough? What are the pitfalls and potential of the local turn? This article uses a case study of Timor-Leste to answer these questions. It finds that the local turn can help lend legitimacy to the state and increase opportunities for political participation and the delivery of public goods at the local level. However, the emerging evidence from Timor-Leste also highlights the pitfalls of the local turn. Most significantly, the state can transfer responsibility for public goods provision to the local level in order to lessen the burden on the state and to divert attention from ineffective or illegitimate central institutions.  相似文献

Extensive fieldwork in Liberia revealed that security agents and civilians alike all talked of community policing, yet they had different visions, understandings and legitimizations of the idea in mind. These ranged from community meetings to vigilante groups, and were divergent in whether they were orientated towards a Weberian-state model or the community as a primary security provider. This variation was not simply an example of hybrid policing, but revealed a multi-scalar adaption process across and between international, national and local actors and (geographical) scales. Theories on hybridity are insufficient to analyse such implementation processes since the scholarship heuristically still favours binary and essentialized actors and ‘pure’ starting points or blueprints.  相似文献
