共有不动产执行中的争议处理——兼论执行立法草案相关条文的内容构成

共有不动产的执行是实务中的难点之一。其难处主要在于如何处理“析产”所引发的种种争议,对于这些争议的处理解决往往牵涉到“执行程序与诉讼程序”“执行部门的诉讼与另行起诉”“查封阶段与处置阶段”等因素的选择组合,在理论上则存在着“形式审查说”与“有限实质审查说”之观点分歧。以夫妻共有不动产的执行为研究重点,在梳理执行实务中常见应对方式的基础上,就相关争议的处理解决及基本程序的构建进行分析,并对民事强制执行立法草案既有的若干方案作出评价。     

Lessons from Experiences of Syrian Civil Society in Refugee Education of Turkey

Abstract

Turkey arranges for the protection of about 1.7 million Syrian refugee children on its territory. This article addresses initiatives and policies towards Syrian children in Turkey, considering characteristics and paradigm shift of refugee education in which hosting large refugee populations. It focuses on experiences of refugee community organizations (RCOs) working on the matter of education. Drawing on an exploratory case study with purposively selected Syrian RCOs in Istanbul, it particularly investigates to explore activities of “Temporary Education Centers” emerging in the emergency-based perspective in early times of Syrian refugee migration and radically disappearing in the integration-based interventions of the State. We will discuss handicaps of making schools refugee places linking with the socio-political conditions of post-displacement and possibilities of cultural orientation of the refugee agency.     

A Coordinated Community Response to Intimate Partner Violence on the College Campus

Recent statistics indicate that intimate partner violence is magnified on college campuses. In the university setting, victims of intimate partner violence may encounter numerous agencies (e.g., campus police, local courts, victim advocates) following reporting of victimization. The need for a coordinated community response to intimate partner violence of college students has been emphasized in recent years, yet little research has been conducted. This qualitative, exploratory study examines perceptions of 15 service providers in a recently implemented, campus-based, coordinated community response. Narrative data from semistructured interviews indicate that service providers are generally satisfied with the current response, but report a need for increased training and resources. Implications for future research, education, and public policy are discussed.

Justice and power in civil law negotiations

The relationship between power and justice in civil law negotiations is discussed. It is argued that the concept of power is essential to understand justice behavior in civil law negotiations. Distributive justice appears to be hardly relevant in civil law disputes and should be replaced by retributive justice to understand the behavior of the parties. The analysis leads to the observation that justice is more likely to be relevant for the powerless party in civil law disputes than for the power-holder. I conclude that both the relative power and justice behavior cannot be studied without taking into account the perception by individuals of both the relevant norms and the salient characteristics of the interaction.     

推定在民事诉讼中的运用

由于法律推定和事实推定的诉讼功能不同,民事诉讼中推定适用的基本规则应分为法律推定与事实推定两种。同时为了加强程序规制推定在民事诉讼中的运用,需要设置推定适用的程序性规则。另外,为了平衡当事人的攻击与防御手段,需要赋予受推定不利影响的另一方当事人以救济方法。
