毋庸置疑,公司在现代经济中具有举足轻重的地位,其制度设计当下存在着的致命弊病严重削弱了其发展的气势。作为非公司组织大家庭中的重要成员,合伙是当之无愧的"元老",但其独特性的制度却遭遇了发展困境。风云际会,多种有利因素的综合作用,迎来了非公司组织勃兴的良机。商事组织之间竞争与合作的发展历程阐明了经济、政治、文化等多种因素间的力量对比决定着它们彼此间消长的基本规律。     

次区域经济合作机制研究:一个边界效应的分析框架

次区域经济合作是二战以后伴随经济全球化和经济一体化而广泛出现的一种区域合作现象,这种区域合作是边境区经济行为体的互动过程,受国家边界的影响强烈。从边界的经济属性上分析,边界对次区域经济合作的影响可归纳为屏蔽效应和中介效应。总地看,国家资源的相对稀缺性和经济行为体对外部市场拓展的愿望使各国边界屏蔽效应向中介效应转化,这是一种趋势,会不断促进次区域经济合作的发展。其转化的动力机制来自于参与合作各方的中央政府、地方政府和企业。

我国民商法典的合伙法律制度在市场经济条件下发挥着越来越重要的作用。在合伙的法律性质中,合伙的民事主体地位、财产、责任承担尤为值得探讨。在立法方面,合伙的定义与形式、法人合伙、民事主体地位、责任承担、隐名合伙与有限合伙等问题有待完善。     

Revisiting China’s “peaceful rise”: Implications for India

This article explores the significance and relevance of the concept of China's peaceful rise and its implications for India. Though the concept suddenly lost its usage and was replaced by a more modest term, peaceful development, the basic tenets of the peaceful rise concept hold considerable relevance. Peaceful rise is a concept aimed at managing the consequences of China's rise as a great power. Essentially, while it reiterates China's foreign policy of peace and common development of all, it also indicates a paradigm shift in Chinese foreign policy. Since the essence of peaceful rise is to support a peaceful international order, the concept imparts a peaceful relationship between India and China.     

Perpetrators of Violence and Abuse in Lesbian Partnerships

Scholarship, policy and practice relating to domestic violence have all seen many changes in the recent past. The definition of domestic violence is often wide ranging describing physical violent within an adult (married) couple to the inclusion of intergenerational abuse and violence. As a result of feminist interventions a gender-based approach to domestic violence is now well established. Most research using this model shows that the majority of victims are women and most perpetrators are men. This impacts upon the policies, initiatives and service provision. One consequence is that it fails to explore the possibility of women’s different experiences of domestic violence. The point of departure for this paper is that it fails to take account of domestic violence in lesbian partnerships. Using data generated by way of an annual analysis of counselling cases of generated by a German lesbian specific social services agency and data from focussed interviews with 20 lesbians who have been violent to their lesbian partners this article offers a range of new insights into the nature and experiences of domestic violence in same sex domestic relationships and considers the significance of this data in relation to policing and other modes of intervention to bring that violence to an end.

An innovation economics agenda for the Obama administration

Seven recommendations are offered for the Obama Administration to ensure that the economy is on a robust growth path over the next decade. These recommendations are intended as first steps towards building the innovation-based public-private partnerships needed to drive economic growth and prosperity.

FAMILY COURT–UNIVERSITY PARTNERSHIP TO BENEFIT DIVORCING FAMILIES: THE EXPERIENCE OF MARICOPA COUNTY (ARIZONA) FAMILY COURT DEPARTMENT AND ARIZONA STATE UNIVERSITY'S PREVENTION RESEARCH CENTER*

Using evidence‐based methods to help divorcing families requires the combined best efforts of legal professionals, courts, judges and administrators, mental health oriented service providers, and university researchers. Collaborative program development, implementation, and evaluation involve a complicated process of negotiation between professionals, yet this process is hardly ever described. The current article describes the processes we underwent in forging an alliance of researchers from Arizona State University's Prevention Research Center with professionals from the Maricopa County (Arizona) Family Court, a collaboration that involved a true dialogue and cooperation from the earliest stages and continuing throughout the project. A Community‐Based Participatory Research model was the underlying basis for our partnership; its lynchpin device was a Joint Planning Committee.     

Methodological and Ethical Challenges in Partnering for Refugee Research: Evidence From Two Australian Studies

In this article we reflect on methodological and ethical challenges encountered while conducting two large, nationally funded studies on refugee resettlement in Australia. We focus on collaborative research partnerships, specifically with “industry partners,” wherein the partners may have different understandings of the research process and different agendas, and with bilingual research assistants. We analyze methodological challenges primarily pertaining to collecting good-quality data in cross-cultural contexts and ethical challenges concerned with ensuring confidentiality in recently arrived, tightly knit communities where community insiders assisted in accessing respondents and collecting data.     

Civic Engagement – A Problem in Search of a Solution?

This article discusses the use of community partnerships to produce civic engagement. In two undergraduate courses during the Fall 2016 semester, students created products that met the stated needs of local nonprofit organizations. Students indicated a positive reaction to their experiences in qualitative assessment instruments, and the community partners were appreciative of students’ output. Given the semester-long timeframe of the projects, it is unknown whether they will lead to greater civic engagement on the part of students or the communities in which the projects took place.
