卢曼的社会系统论是对现代社会进行分析的理论产物,其理论根源是自然科学系统论。而作为卢曼社会系统理论核心的自我生产与自我参照概念,在合同制度中有着明显的体现。从系统的开放性与封闭性两个方面,以系统论的角度分析合同制度系统中的两个制度。     

Unpacking the politics of legislative debates

Legislative debates are a thriving field in comparative politics. They make representation work by offering legislators the opportunity to take the floor and represent their constituents. In this paper, we review the key theoretical concepts and empirical findings in a maturing field. We begin by addressing what legislative debates are and why we should study them to learn about inter- and intra-party politics. Next, we look at the contributions springing from Proksch and Slapin's ground-breaking model. In so doing, our review suggests that recent work extends the original model to include further dimensions of legislative debates. Third, we examine the role of legislative debates as mechanisms of representation, focusing on gender. Four, we examine the challenges of the comparative analysis of legislative debates. Finally, we map the road ahead by discussing four avenues of future research and some key questions that remain unanswered.     

The legislative consequences of Mexico’s mixed-member electoral system, 2000–2009

The emergence of mixed-member electoral systems across the globe has been an attempt to balance local representation through single-member districts (SMD) with programmatic representation through proportional representation lists (PR). However, there are several competing theoretical interpretations for the consequences of mixed systems on legislative bodies. Through a study of the Mexican Chamber of Deputies, I test several empirical implications of these competing theories by examining the impact of the electoral system on party discipline, participation, and legislative organization. I find little convincing evidence of differences between legislators elected through PR and those elected through SMD in their levels of party discipline, but I do find that PR legislators participate in a manner theoretically consistent with their mode of election. I also find that PR legislators have disproportionate control over key leadership positions. I suggest the primary reasons for these findings is due to differing methods of candidate selection and restricted use of dual candidacy.

3Q大战反垄断终审判决中相关市场界定与市场支配地位认定的相关问题

最高人民法院在奇虎诉腾讯滥用市场支配地位纠纷终审判决中对相关市场界定、市场支配地位认定及二者的关系问题进行了精辟的论述。我们将从该案二审亲历者的角度出发,结合国内外相关判例,对该判决中关于相关市场界定中的责任分配、假定垄断者测试在相关市场界定中的地位、替代性分析应遵循的多数且重要原则,以及从动态竞争的角度正确看待市场份额在市场支配地位认定中的作用、市场支配地位认定的综合分析方法等进行详细的解读和必要的归纳。最高人民法院的前述审理思路和认定结论无疑将对后续的反垄断诉讼、行政调查及企业的合规必然产生深远的影响。     

论iPad商标案中的“白手套”交易——一个法经济学的视角

iPad案中判断白手套交易是否存在欺诈,关键在于隐瞒买方真实身份是否违背了诚实信用原则。有关诚实信用的教义分析显然没有能力解决这一问题。有效的替代进路是对不同裁判方案的可能后果进行经济分析。白手套做法的正当性在于隐瞒相关信息有助于抑制敲竹杠、降低谈判费用、促成有效率的交易。     

Deliberative citizenship: a critical reappraisal

ABSTRACT

The study of citizenship as a political or moral ideal involves identifying core commitments and capabilities, the cultivation and exercise of which is often presented as a condition of being a ‘good’ citizen. Deliberative democracy was, at least until recently, associated with a conception of citizenship that endorses those qualities that equip us for a certain kind of respectful and reflective dialogue. This article reappraises this conception in light of the so-called ‘systemic turn’ within deliberative theory. It shows how systems thinking has displaced the traditional conception of deliberative citizenship, but that theorists have so far not elaborated a satisfactory replacement. A pluralist model is thus proposed, which casts light on the diverse qualities that a range of actors in a deliberative system might require. The resulting argument is not merely of interest to deliberative theorists, but to all who are concerned with the ethics of citizenship. The main reason is that it displaces the entrenched notion of a ‘good citizen’, in favour of the more heterogenous ideal of a ‘good citizenry’.     

Terrorism alerts and target transference: evidence and implications from the 2010 Europe-wide terrorism alert

This article examines how terrorist alerts and terrorist threats interacted during a period of heightened alert in Europe in late 2010. Taking from game theory the concepts of target transference (by terrorists) and defence races (among states) and using their underlying rationalist logic as a causal mechanism, the article attempts to construct an analytical narrative of the till now unwritten history of this event. In the process, the event serves to test whether the observable implications of theory corresponded to reality in this case. The study finds that during the Euro-alert transference in time was more common than transference of place and that there was more resistance to defence races than theory predicts. The alert itself was only a qualified success; the extent to which it was effective was determined by its combination with other offensive actions. The findings call for more attention to be given to terrorist preferences, inter-temporal transference and its relationship to bandwagoning, and state resistance to defence races with consideration of the role of information.
