刑事被害人国家补偿制度的路径选择

程序正义之下,减轻被害人的痛苦是国家和社会的责任,是公共福利的要求,也是正义的应有之意。经济社会的全面发展为国家补偿制度设置提供了一定的经济基础,司法探索为国家补偿制度的构建提供了一定的实践基础,建议我国在强化对犯罪追诉的同时,需要通过专项立法的形式构建对刑事被害人的长效专项补偿机制。     

艾滋病人犯罪的司法难点与解决对策探微

在谈＂艾＂色变的当今社会,艾滋病人已成为一个特殊的群体,被＂标签化＂。而基于这一特殊身份,艾滋病人犯罪造成司法办案过程中的诸多困难。但是面对艾滋病人犯罪愈发的严重态势,必须及时应对并提出解决对策,探讨控制这种态势的有效途径。     

Factors that Influence Life Satisfaction Among Battered Women in Shelters: Those Who Stay Versus Those Who Leave

The study focused on differences between women who left shelters for battered women and returned to their partners, versus those who stayed in the shelter for over 3 months. The study was conducted in battered women’s shelters in Israel, and examined the contribution of women’s internal resources (self-esteem and empowerment) to their life satisfaction, as well as the contribution of integration (participation and commitment) in the shelter at the time of their arrival to their satisfaction with their life. Findings indicate that, among the group of women who stayed in the shelter, personal resources as well as participation and commitment contributed to their life satisfaction. Among the group of women who left the shelter, only commitment contributed to life satisfaction.

政策评价方法是指在政策评价过程中所采用的方法,我国目前没有政策评价法相关法律的规范,亦没有对政策评价方法做出明确的规定。本文从构建我国政策评价的重要性出发,简述我国政策评价制度存在的问题,并分析其原因,介绍我国在实践中所运用的政策评价方法,提出推动成本——收益评价方法与公众满意度评价方法的建议。

State legitimacy: An updated dataset for 52 countries

A previous article in this journal presented a conceptualisation of the political legitimacy of the state and its operationalisation for 72 countries c. 2000. This article provides an updated dataset of state legitimacy for 52 countries c. 2008 using the same conceptualisation. It presents a brief discussion of the comparative results of the two datasets.     

RACIAL ANIMOSITY AND INTERRACIAL CRIME*

The primary objective of this study is to determine the effect of a victim's race on the likelihood of him or her being seriously injured during the commission of an interracial crime. We also assess the probability of a homicide occurring during an interracial crime. A multilevel city analysis shows that black offenders are no more apt than white offenders to injure their victims seriously during an interracial robbery or rape. A black offender also does not have a greater proclivity to kill his or her victim during the commission of an interracial crime. Some evidence suggests that white victims are more likely than black victims to suffer serious physical harm during an aggravated assault. Results also reveal that contextual factors related to racial animosity, such as residential segregation, white‐to‐black economic inequality, and black‐to‐white unemployment, fail to have any moderating effect on either the severity of victim injury or the likelihood of a homicide occurring during an interracial crime. Overall, the results generated in this study tend to cast doubt on the validity of racial animosity theory. Our findings also lead us to question the veracity of the oftenmade claim that black‐on‐white crimes are punished more severely because these types of offenses are somehow more heinous in circumstance. At least in regard to serious victim injury and victim death, black‐on‐white crime is no more violent than white‐on‐black crime.     

公务员满意度影响因素特性分析

从理论上系统地分析和解释公务员满意度问题,有助于改善政府公共管理实践,并促进我国公务员管理制度的发展完善.通过国外公共部门雇员薪酬满意度和工作满意度影响因素的有关研究,公务员薪酬满意度影响因素并不局限于货币薪酬,而是涵盖了薪酬制度与管理等非经济性薪酬因素范畴.同时,公务员工作满意度影响因素表现出鲜明的行政层级差异性.最后,公共部门与私营部门比较分析表明,公务员满意度影响因素与私营部门员工具有显著差异.应以这种差异性与特殊性作为公务员报酬机制设计的理论基础,以私营部门作为参照系,以提高公务员满意度为目标,兼顾外在报酬因素和内在报酬因素,区分不同行政层级设计公务员报酬激励机制.     

试论对被害人的诉讼外保护

对被害人除了应当予以强有力的诉讼保护外,诉讼外保护也十分重要。对被害人的诉讼外保 护主要是指：及时抚慰,治疗心理创伤;提供帮助,解决实际困难;帮助其总结教训,摆脱 中毒状态;果断处置,排除潜在威胁。
