Lessons from Roman law: EU law in England and Wales after Brexit

ABSTRACT

The experience of Roman law in legal education in England and Wales may serve as a cautionary tale for EU law post-Brexit. Similarly, past debates as to the position of Roman law in the curriculum may also be instructive in the EU law context. After tracing the history of the teaching of Roman law in England and Wales, this article posits first that the factors that appear to have caused the decline of Roman law could apply equally in the context of EU law. Secondly, based on both pragmatic and liberal education arguments that have historically been proffered for the study of Roman law, it advances arguments for the retention of a compulsory stand-alone EU law module in England and Wales after Brexit. To this end, the paper contends that the arguments for the retention of EU law in legal education are more robust than those asserted traditionally in favour of Roman law.

Taking Intervention Politics Seriously: Media Debates and the Contestation of African Regional Interventions ‘from Below’

ABSTRACT

Scholars increasingly investigate how the African Peace and Security Architecture (APSA) is contested and negotiated in practice. Yet little knowledge exists on the politics African regional interventions provoke in the societies affected by such interventions. Based on an analysis of media reports from Burkina Faso and The Gambia, we show that regional interventions are indeed contested locally, irrespective of the means of intervention applied. Our analysis demonstrates how local elites use regional norms and policies in order to claim power and define what is going (wr)on(g). With this, we provide evidence for the (contested) local effects of APSA and for the relevance of media for researching such effects.     

Rising to the Challenge: Europe’s Security Policy in East Asia amid US-China Rivalry

ABSTRACT

China’s growing power and assertiveness towards its smaller and weaker neighbours has been a wakeup call for the European Union and its member states which, as a result, have stepped up their involvement in East Asia. EU security policy in the region shows many elements of alignment with the United States, but also differences. In North East Asia, the EU has adopted harsh sanctions against North Korea but, contrary to the Trump administration which continues to seek regime change, has left the door open for dialogue. Moreover, the EU supports the process of trilateral cooperation among China, Japan and South Korea, while Washington has traditionally been lukewarm towards a process that excludes the US and risks being dominated by Beijing. The transatlantic allies also show differing approaches with regard to maritime disputes in the South China Sea. While EU security policy in East Asia is largely complementary to that of Washington, in some cases Europe tends – albeit inadvertently – to favour Beijing.     

非洲猪瘟病毒感染免疫反应的研究进展

非洲猪瘟是由非洲猪瘟病毒(ASFV)引起的一种危害全球养猪业的灾难性疾病,临床上以急性、热性、出血性、高发病率和高死亡率为特征。世界动物卫生组织(OIE)将其列为法定报告动物疫病,也是我国必须上报的一类动物疫病。自上世纪二十年代出现以来,有关非洲猪瘟病毒的病原特性、流行特点以及免疫应答等多个方面的研究虽然已经开展,但是我们对其仍然知之甚少。本文概括总结了非洲猪瘟病毒感染后机体的免疫应答反应,以期为非洲猪瘟病毒的后续研究和疫苗研制提供理论依据。     

UNAMID and the Legitimation of Global-Regional Peacekeeping Cooperation: Partnership and Friction in UN-AU Relations

ABSTRACT

The ‘hybrid' United Nations-African Union Mission in Darfur (UNAMID) was initially hailed as a model for peacekeeping cooperation between the UN and African regional organizations. However, UNAMID soon faced contestation from different stakeholders, and the UN and the AU have now essentially abandoned the hybrid approach. The article reconstructs how the mission’s deteriorating legitimacy relates to changing self-legitimation strategies by the two organizations. The UN and the AU pursued mutual legitimation when establishing UNAMID, but later mobilized historical narratives and diverging normative standards to promote competing authority claims. The article thus advances an understanding of inter-organizational relations as inherently political.     

The charismatic leadership of the ECB presidency: A language-based analysis

There is little doubt that the European Central Bank (ECB), and in particular its presidency, has taken the lead in tackling the euro crisis. But can this leadership be also characterised as charismatic? This article answers the question by focusing on language – a key component as well as a reliable indicator of charisma. By means of a software-assisted content analysis of the entire corpus of ECB presidential speeches, it is found that the crisis has indeed led to the emergence of the Bank's presidency as a charismatic euro leader. This in turn confirms the recent politicisation of the ECB, but at the same time might be seen as mitigating the problems related to the Bank's democratic deficit, to the extent that charisma can be seen, from a Weberian standpoint, as an alternative source of political legitimacy.     

Unity in the face of threat? Exploring the empirical relationship between strategic threat perceptions and public support for a common European army in Germany

ABSTRACT

Perceptions of threat from Russia’s military activities in Ukraine and President Trump’s critical attitude towards NATO have put the idea of a common European army on the agenda of European politics. Do these strategic threat perceptions also influence public support for the creation of a common European army? Previous research has largely overlooked strategic threat perceptions as individual-level determinants of public support for a common European army. This article explores the empirical relationship between strategic threat perceptions and support for a common European army at the individual level of analysis with representative German survey data from 2018. The multivariate analysis shows that perceiving Russia’s military activities in Ukraine as a threat to Germany’s security, and U.S. foreign and security policy as a threat to the cohesion of NATO significantly increases support for the creation of a common European army, even when the influence of numerous other determinants is controlled for. The findings highlight the importance of considering strategic threat perceptions in future analyses of public opinion on European defence cooperation and integration.     

The spaces of intervention for Mali and Guinea-Bissau

ABSTRACT

This article focuses on interventions by the African Union and the Economic Community of West African States in Guinea-Bissau and Mali. In the literature, these are often approached in a ‘top-down’ manner, focusing on formal institutions, not accounting for the complex dynamics in and around conflict intervention. This article argues that adopting space as an analytical lens allows new ways to address these issues. It highlights how interventions by different actors and their interactions are influenced by spatial perceptions and framings, which result in the making of different ‘spaces of intervention’ through different practices. The two described here, ‘scaling’ and ‘establishing reach’, enable strategic and continuous formation and negotiation of spaces for action, according to actors’ needs and interests. Thus, shedding light on specific actors and their practices, the article contributes to a better understanding of the complex dynamics in conflict intervention in West Africa.     

Knowledge production on conflict early warning at the African Union

ABSTRACT

How does the African Union (AU) generate knowledge about on-going violent conflict as well as post-conflict situations? This article offers an analysis of the multiple sites and sources in the construction of conflict-related knowledge. It also reflects on the various institutional ways this knowledge is filtered into the activities of a wide range of AU actors, starting with the AU Commission, the AU Commission Chairperson and the Peace and Security Council. Emphasis is on the development of the Continental Early Warning System and some of its limitations, the latter partly related to the specific organisational culture of the African Union.
