建党以来特别是新中国成立以来，中国共产党不断开拓创新，走出了一条正确的、符合本国实际的社会主义发展道路。其中，毛泽东对社会主义发展道路的开创与奠基、邓小平对社会主义发展道路的规划与践行、江泽民对社会主义发展道路的延伸与创新、胡锦涛对社会主义发展道路的拓展与升华，分别作出了重大贡献。回眸中国共产党对社会主义发展道路的拓新历程，总结其中的经验启示，对于胜利推进中国特色社会主义建设事业大有裨益。     

Third Way Regulation? Community Legal Service Partnerships

This article examines recent changes in the civil legal aid scheme in England and Wales (now called the Community Legal Service) and the creation of Community Legal Service Partnerships in particular. The article explores three main interests: it illustrates how third way thinking has been applied to the reform of the legal aid scheme under the Access to Justice Act 1999; it explores how partnership fits within theories of public regulation; and it illustrates how professionalism is being re-shaped by a combination of new public management, contractualism and partnership. It points to important limitations in new public law theories of extended accountability and democratised governance as manifested in partnerships.     

The Convergence of Social Policy and Criminal Justice

This article discusses the shift from crime as a problem of the police and judicial authorities to a subject of local policy. It will, in particular, examine the relationship between safety policy and social policy. Safety has become an important social theme in the last decades. There are at least three reasons to explain why this is the case: the increase of crime, increased attention for the victim and the legitimacy of the government. A concentric model is proposed to serve the development of a systematically set up local safety policy. In the Netherlands programmes such as Communities that Care and Justice in the neighbourhood (Jib) are important developments which stress the integral approach of the crime and safety problem. The article closes with a discussion on the convergence of criminal justice policy and social policy.     

Social Work and the Security Issue in the Netherlands and Belgium

Over the past years security has become a central issue in political discussions both in the Netherlands and Belgium. This has led to the setting of new governmental schemes in urban areas that rely upon the commitment of social workers to a large extent. Besides that, a number of new professions linked to social intervention have appeared. The purpose of this article is to analyse the emergence of security as an issue and the effects of the new governmental schemes in the field of social work, and to compare the political and social backgrounds, how security is dealt with and the effects on social work in Belgium and the Netherlands. The general assumption is that the practice of social professions tends to a new balance between change and control, the two usual poles of social work, at the expense of emancipatory practices towards marginalised people. In other words, it is wondered whether the action of social workers is to put in place a system of control and risk prevention as a mix of social work and people policing. The article shows that the development in this direction in the two countries is similar, in spite of significant background differences.

中国法律援助经历了从 1 994年初起发展到今天的过程。法律援助的概念有广、狭二义之分 ;其性质是法律之助 ,即援助公民个人或者人民法院不向受援人收费或者少收、缓收从而在法律方面提供帮助以维护其合法权益的行为。法律援助的特别包括 :具有国家、社会承担援助的公助性 ;受援人享受法律援助的无偿性和优惠性 ;律师、公证员等提供帮助的法律专业性。法律援助的理论基础有四 :权利保障之要求 ;实现控、辩双方力度平衡之条件 ;司法公正之所需和扶贫助弱法制化发展之必然     

行政公开的权利保障功能

行政公开 ,是指行政机关以民主、开放的精神从事行政管理 ,依法保障公民知政权、参政权和督政权的活动原则与方式。行政公开的理论与实践在我国已开始受到重视 ,但对于行政公开的理解和运用则存在简单化和片面性。因此 ,本文力求从行政公开的本质层面上弄清行政公开的性质、范围、内容和功能 ,以期有助于我国行政公开理论与实践的发展。为此 ,作者认为 ,行政公开从功能上看主要应该包括知政权、参政权和督政权的保障。     

Linkages between the Montreal and Kyoto Protocols – Enhancing Synergies between Protecting the Ozone Layer and the Global Climate

The international treaties for the protection of the ozone layer and the global climate are closely related. Not only has the Montreal Protocol for the protection of the ozone layer served as a useful example in developing the international climate regime, but policies pursued in both issue areas influence each other. This paper gives an overview of the many ways in which both treaty systems are linked functionally and politically. It investigates, in particular, the tension that has arisen with respect to the use of fluorinated greenhouse gases and the potential for drawing on the experience under the Montreal Protocol regarding data reporting and policy design on fluorinated greenhouse gases under the Kyoto Protocol to the United Nations Framework Convention on Climate Change. The potentials for enhancing synergy in these areas are explored, and related options discussed. Some initiatives for exploiting these potentials are already underway, aiming in particular at enhancing learning and exchanging of information. However, political choices concerning some of the issues willeventually need to be made, if action at the international level is to contribute to their solution.
