美国公众舆论与战争--以朝鲜战争、越南战争和伊拉克战争为例

本文以朝鲜战争、越南战争和伊拉克战争为例说明美国是最喜欢用武力处理国际关系的国家。战争的伤亡会影响美国的民意,反战的民意进而会影响政策的实施,甚至影响总统竞选连任,但不会制止战争。     

美国通讯监听立法的演进与发展

1968年美国通过的<综合控制犯罪和街道安全法>对通讯监听的条件、程序、方式及被告人的权利保护等问题做出了规定,以实现有效执行法律和保护公民个人权利之间的平衡."9·11"恐怖袭击事件后,美国先后出台了<爱国者法案>、<外国情报监视法>修正案,以加强情报搜集工作,提高反恐和打击犯罪的能力.这个立法过程漫长曲折,在立法技术上也表现出严格限制和灵活处置的两面性,对我国相关领域的立法具有很强的借鉴意义和参考价值.     

中美法庭科学实验室比较研究

本文以中美权威部门发布的统计报告以及有关文献报道的数据为基础,通过比较研究,从实验室分布、规模、人力资源、工作量、专业设置、技术标准化、资金、管理体系和信息化9个方面进行深入分析,找出双方的差异和距离,为我国法庭科学实验室的发展建设提供参考依据。

Within and beyond citizenship: alternative educational initiatives in the Arab society in Israel

In recent years, Arab-Palestinian citizens in Israel are in search of ‘a new vocabulary of citizenship’, among other ways, by resorting to ‘alternative educational initiatives’. We investigate and compare three alternative schools, each challenging the contested conception of Israeli citizenship. Our findings reveal different educational strategies to become ‘claimants of rights’, yet all initiatives demonstrate the constraints Arab citizens face while trying to become ‘activist citizens’ (E.F. 试论非法移民对美国国家安全的影响

非法移民是非传统安全领域的一个重要组成部分,同时也是国际社会所面临的一个共同问题。＂9·11＂事件后,美国社会对于非法移民与国家安全的关注达到了新的高度。非法移民与美国国家安全之间存在一定的相关性,这可从社会安全、国土安全与文化安全三个维度来分析非法移民对美国国家安全所产生的影响。在一定程度上,非法移民问题使得美国的国家安全环境变得复杂化,成为美国国家安全一个不容忽视的挑战。但是,过分夸大非法移民问题对美国国家安全的影响也与客观事实不符。

In 1933 the army of the nascent Iraqi state launched an exterminatory attack on members of the Assyrian community who had fled to Iraq during the First World War. 'The Assyrian affair' which at the time sent shock-waves around the world has now been largely forgotten. But an examination of its origins and causation reveals much about the nature and pattern of modern genocide. Levene argues that typecasting genocide as the outcome of prejudice, racism or even xenophobia, while these may be significant ingredients, proves to be insufficient as a comprehensive explanation. Rather, these factors need to be analysed within the context of an emerging international system of nation-states. This itself may be a factor in helping to catalyse the most extreme and radically ideological responses, especially from new and untried national elites seeking to overcome perceived obstacles to their state's development and genuine independence.     

Imagining modernity: the language and genealogy of modernity in nineteenth-century Arabic

This article employs the methodology of conceptual history to contest two of the most common theoretical approaches dominating our understanding of modernity in the field of Middle Eastern studies. The first approach relies on the assumption of incompatibility between modernity and Islam and captures Arab modernity using concepts such as ‘adoption’. The second understands Arab modernity through concepts such as ‘imitation’, contending that it is a legacy of Western imperialism. This article challenges both theories by examining the genealogy of tamaddun (civilization, being civilized), a pivotal concept used in nineteenth-century Arabic to imagine modernity. The genealogy of tamaddun elucidates that medieval paradigms derived from the concept of madina (polity) were rediscovered, reimagined, and reused in the context of the rise of the nation-state and the challenge of Western imperialism. The article suggests understanding Arab modernity and its critique from within, rather than outside of, the temporality of the historical condition.     

美国《网络空间国际战略》的法律分析与对策

美国出台《网络空间国际战略》是争夺制网权,主导互联网世界的信号,既有其自身安全上的考虑,也有政治上的目的。该＂战略＂从美国自身利益出发,试图为全世界的互联网活动制定规则,有违国际法中主权平等等一系列基本原则。中国应该尽快建立自己的信息化战略,依托国际法原则,努力参与国际网络行为准则的制定,争取平等的话语权,平衡世界制网权。同时也要逐步完善国内互联网立法,提高网络应用技术,增强网络空间的软硬件能力。
