依据专利法等特定法律,专利制度通过授予发明人对发明享有的独占权来保护、鼓励发明创造,进而推动科技进步和经济发展。完整意义上的专利权保护,除事后的侵权救济和违法惩处之外,还应该涵盖新技术的发明创造到其获得专利权后将之市场化应用于社会生产等阶段,确保创新主体顺利获得专利权并实施或转让其专利技术,也即专利权的事前保护。授益行政行为在专利权的事前保护方面可以起到注重提供事后救济的负担性行政行为以及司法措施所无法替代的重要作用,而我国现行专利权保护体系在授益行政行为方面却存在着严重的缺失,本文针对这些缺失,就几类典型的授益行政行为,提出了具体的完善建议。  相似文献

Much of the Indian debate about secularism is built around what seem to be commonsense assumptions about India and the West. But a close look at the impact of Protestant Puritanism on the relationship between religion and politics in the United States suggests that these assumptions are mistaken. Tominaga Nakamoto, a Japanese scholar of the early 18th century, changed the basic pattern of Japans Buddhist and Confucianist studies with his books Shutsujō Kōgo (Words after Enlightenment) and Okina no Fumi (The Writings of an Old Man). In the former book, based on his analysis of Chinese culture in terms of Confucianism and Indian culture from the viewpoint of Buddhism, he compared Indian, Chinese and Japanese culture and summarized their characteristics with the words “fanciful”, “elegant” and “simple” respectively. In the meantime, in combing through the development of Buddhism he put forward a set of key concepts in relation to his research methodology, extending his domain from country-specific studies to Asia regional studies and finally Oriental studies. In the latter book, he used the concept “makoto”, roughly meaning “practicing the good”, to synthesize the Way of the three nations. His study transformed Japanese Confucianism and Buddhism from a system of belief to an academic field. Despite his rational analysis and criticism of the traditional oriental culture, Tominaga consciously identified with it and inherited it. As the first scholar in early modern Japan who developed his own research methodology, Tominaga is the trailblazer of Oriental studies.  相似文献

Abstract

In the development of modern philosophy self-consciousness was not generally or unanimously given important consideration. This was because philosophers such as Descartes, Kant and Fichte thought it served as the highest principle from which we can ‘deduce’ all propositions that rightly claimed validity. However, the Romantics thought that the consideration of self-consciousness was of the highest importance even when any claim to foundationalism was abandoned. In this respect, Hölderlin and his circle, as well as Novalis and Schleiermacher, thought that self-consciousness, itself, was not a principle but must be ranked on a minor or dependent level, and presupposed the Absolute as a superior but inaccessible condition or ground. This reservation did not hinder them from recognising that the foundationalist Fichte was the first to have shown conclusively that from Descartes, via German Rationalism and British Empiricism, up to Kant, self-consciousness was misconceived of as the result of an act of reflection by which a second-order act bent back upon a first-order act that is identical to itself. This conception entailed circular entanglements and infinite regresses, and was too high a price to pay. Whereas Fichte thought pre-reflexive self-awareness was a philosophical principle, the Romantics and their vehement critic Kierkegaard, abandoned the idea of self-consciousness as a foundational starting point of philosophy. Instead, they founded self-consciousness on transcendent Being, a prior non-conceptual consciousness (‘feeling’) and reproached Fichte for having fallen back into the repudiated reflection model of self-consciousness.  相似文献

环境会计是开展环保活动的一个有效工具。实施环境会计有利于促进企业加强环境管理,提高环境业绩,提升企业形象,增强竞争优势,也有利于提升企业和公众的环境意识,对落实科学发展观、发展循环经济、实施可持续发展战略和建设和谐社会十分重要。韩国是目前亚洲环境保护工作做得很好的国家之一,其环境会计的发展也有较明显的特色。韩国的经验表明,企业重视环境信息,不仅有利于提高企业的经济效益和环境效益,而且具有明显的社会效益,推进了环保型社会建设的进程,也给我们提供了有益的启示。  相似文献

理性一直被认为是人类所特有的并引以为傲的能力,科学则一直标榜“理性”的大旗。近代以来,“理性”被科学发展到了极致,但是接踵而来的问题则使人们开始质疑理性,质疑自己的能力,进而质疑人自身。此时,法兰克福学派,特剐是霍克海默和阿多尔诺的《启蒙辩证法》则为人类理性的良性发展提供了可能性道路,正是在这样的背景下,第二代的哈贝马斯才能够进一步提出“交往理性”的概念。  相似文献
