协同共治:粤港澳大湾区建设中大学的角色定位及其实现路径

在国家战略背景下,粤港澳大湾区高等教育融合发展问题倍受社会关注。课题组在粤港澳大湾区、旧金山湾区、纽约湾区、波士顿湾区和东京湾区等国际湾区收集了丰富的访谈资料,在一手资料及协同治理理论基础上,采用扎根理论质性研究方法构建起大学在粤港澳大湾区建设中的角色及治理路径模型。研究结果表明,大学在大湾区建设中承载着特殊角色与常态化角色。特殊角色是湾区文化与价值引领;常态化角色包括英才培育、知识创造、成果转化、制度创业等。适应粤港澳大湾区具体情境,实现大学积极治理的主体角色,必须发挥多元主体协同共治的作用,湾区高等教育协同治理路径表现为大学与政府协同、大学与市场协同、大学与社会协同、大学与大学协同以及大学内部治理协同。     

论我国环境影响评价制度的效用及完善

环境影响评价(Environmental Impact Assessment,英文缩写为EIA)是实现可持续发展的重要工具,多数国家都要求时建设项目进行环境影响评价.我国法律要求对国家的政策、计划和规划项目进行的环境影响进行评价,目的是通过该制度把环境保护目标和措施纳入经济和社会发展的规划中,使环境因素与经济、社会因素一起,在规划形成的早期阶段得到重视.鉴于环评制度的重要意义,从环境影响评价的基本问题出发,分析环境影响评价效用以及存在的现实问题,最终提出环境影响评价制度的完善措施.

Spurring Vaccine Development for the Developing World: A Collaborative Governance Perspective on Product Development Partnerships

Collaborative governance has emerged recently as an alternative to the traditional sector-based, single-actor approaches for addressing complex governance challenges. However, previous research has given little attention to collaborative governance within international policy contexts. To address this gap, an integrative collaborative governance framework is used to analyze product development partnerships (PDPs) that seek to develop vaccines to prevent the spread of devastating diseases within the developing world. The analysis indicates that PDPs are helping address acute governance challenges and are emblematic of the increasing importance of nonprofit organizations in collaborative governance regimes. Implications for research on collaborative governance are also discussed.     

Privadentiality: Developing a Coherent Framework for Establishing Communication Protections in Family and Child Protection Dispute Resolution Methods

The emergence of innovative family and child protection dispute resolution (DR) methods has resulted in a varying array of communication protections. Review of these communication protections in the United States reveals a lack of consistency and clarity within each form of DR, and no clear policy to guide the development of the different communication protections across the spectrum of DR methods. This article proposes a new term, privadentiality, to describe communication protections which may be provided for a wide range of DR methods and a framework for categorizing DR methods in order to develop more consistent and appropriate communication protections across the spectrum of DR. This article concludes with recommendations to improve party and professional understanding of DR communication protections; protect families from escalating conflict; promote the integrity of DR methods; and enable courts to appropriately review and, where appropriate, approve DR outcomes.     

Collaborative leadership in EMU governance: a matter of cognitive proximity

Abstract

Collaborative leadership has stood at the heart of European politics since its inception. Yet EU scholars have only recently started to examine the concept and mainly from an institutional perspective. This article conceptualises the phenomenon of collaborative leadership from an actor-centered perspective. It explores a central condition for successful collaborative leadership identified in the literature: the existence of shared beliefs among the leaders involved. To do this, the article focuses on four events in the history of European Economic and Monetary Union. Using the method of cognitive mapping, the study establishes the extent of congruence in the beliefs on European integration and fiscal and monetary policy of the four leadership trios overseeing these events. On the basis of a survey of leading experts in the field, the article reveals that the level of cognitive proximity in leaders’ beliefs aligns with the perceived success with which the trios exerted collaborative leadership.     

Institutional interplay and effectiveness: assessing efforts to conserve western hemisphere shorebirds

Bird conservation agencies and organizations can take credit for a long list of transnational policy accomplishments. This article examines one set, a constellation of arrangements developed over the past three decades by those seeking to conserve western hemisphere shorebirds. At the center of this constellation are the US and Canadian national shorebird conservation plans and a cross-border initiative, the Western Hemisphere Shorebird Conservation Reserve Network. We treat these and associated plans, programs, and initiatives as a nested set of institutions, noting that these are operated by a wide assortment of state and societal actors. Exploring the potential of a framework based on Oran Young’s concept of interplay, we analyze the construction of these institutions and efforts to establish effectiveness. Examining activity in three zones of issue proximity, we conclude that shorebird conservationists have responded well to formative interplay challenges. They have made least progress in engaging remote institutions responsible for threats to shorebird habitat. We note, though, that it is important to distinguish between scientific and political levels of interplay work. On a substantive level we conclude that the shorebird community is well-positioned to move beyond generative and programmatic tasks to focus on establishing policy capability. On a theoretical level, we conclude that a framework based on interplay provides a strong foundation for analysis of the forces shaping the effectiveness of informal conservation institutions such as the ones examined.

Commentary on Interdisciplinary Teamwork in Family Law Practice

This commentary discusses and expands upon Mosten and Traumm's extraordinary work on interdisciplinary teams. Focusing on the continuum between independence and interdependence in team formation, we explore the benefits of team members' shared responsibility and highlight potential challenges. We emphasize that regardless of where a team may fall on the continuum, establishing and adhering to a strong structure results in increased practitioner satisfaction and better client outcomes. This commentary identifies five best practices that promote highly functioning teams and urges family law practitioners to seek more advanced interdisciplinary team training opportunities.     

AN EMPIRICAL ANALYSIS OF COLLABORATIVE PRACTICE

This article summarizes empirical research about Collaborative Practice, the Collaborative movement, its interaction with other parts of the dispute resolution field, and its impact on the field. It reviews studies of Collaborative Practice describing the individuals involved in Collaborative cases, how the process works, the operation of local practice groups, and the impact of Collaborative Practice on legal practice generally. Based on this analysis, it suggests an agenda for future research. Finally, it offers suggestions for constructive development of the Collaborative field.
