The new trend in Collaborative Family Law (CFL) in the United States and Canada raises new questions about theories of justice. CFL achieves many of the goals of a viable theory of justice and its implicit critique of the legal system is a valid one. However, it unnecessarily demonizes law and has yet to explicitly articulate where it fits in terms of its own theory of justice. After considering the claims made by CFL, it is apparent that while some are productive, others are problematic and should be discarded. Specifically, CFL's rejection of factual determinacy may be inappropriate in some cases. The CFL approach has the potential to ignore problems of power imbalance, and may sacrifice just outcomes for the sake of efficiency. The emphasis on relationships and the need for their protection is not always an appropriate approach, and in demonizing law in favor of private ordering, CFL unnecessarily rejects the importance of law as a site for public participation in the creation and defense of norms. CFL is an important step forward in law reform, but if it is to fulfill its potential, it needs to incorporate within its practice a theory of justice that avoids the pitfalls of liberal individualism and allows for the public authorship of norms. 相似文献

跨域治理机构是因应和解决区域公共问题,协助政府开展跨域事务治理的不可或缺力量。世界三大湾区在长期的演进发展过程中,逐步建构生成了类型多样、功能各异的跨域治理机构。依据"类同度"和"依存度"两个分类维度,可以对世界三大湾区的跨域治理机构做不同的划分,识别出官方型、半官方型、专区型、协会型、商会型跨域治理机构。通过对五种模式的代表性机构的比较分析,总结其优缺点、共性与差异及适用性,进而找寻出对粤港澳大湾区跨域治理机构建设的几点启示:一是借鉴东京湾区经验,建立健全类同度和依存度都较高的官方型或半官方型跨域治理机构;二是吸收旧金山湾区和纽约湾区启示,创设类同度较低、依存度较高的协会型跨域治理机构;三是探索建设商界驱动的商会型跨域治理机构,从而形成以政府为核心、多元主体参与的大湾区跨域协作治理体系。 相似文献

This article looks at the growth of collaborative practice in Canada in the last decade and the legal and Canadian cultural underpinnings influencing this growth. Government recognition of and support for collaborative process has come from both the federal and provincial governments. Statutory support in family law statutes and in ethical standards for lawyers encourage alternate dispute resolution and have helped normalize consensual dispute resolution options. For attorneys who engage in matrimonial practice, work is often performed by a sole practitioner. While members of other professions have already demonstrated that interdisciplinary practice and teamwork are integral to efficiency, client satisfaction, and career success, matrimonial attorneys are just beginning to work in deliberately constructed interdisciplinary teams. In this article, we examine the definition of teamwork and highlight the characteristics of an effective team, drawing examples from the business, medical, and mental health fields.
