从国际实践看国家需要具备的条件

国家需要具备的条件用于区分国家与其他政治实体。从国际实践看,人民、与别的国家进行交往的能力或者进行国际交往的能力、有效的政府、遵守国际法方面的要求、国家的作用、民主和尊重人权方面的要求等国际法学者提出的国家需要具备的条件或者国家资格的标准不是国家需要具备的条件。国家需要具备的条件是定居的居民、领土、政府和独立。     

Analytical review on the major issues of the new bankruptcy (law) legislation

The bankruptcy law is an integral part of the legal system of societies with market economy. After many years of preparation, the draft of the new bankruptcy law in China was submitted to the Standing Committee of the National People’s Congress twice and is waiting for the third approval to be enacted. Drawing on the experiences of other countries, the new bankruptcy law tries to carry out the concepts of market economy, eliminate the residual influences of planned economy that existed in the old law, protect lawful rights and interests of creditors and debtors, and maintain the order of socialist market economy. This thesis analyzes and researches on the major and controversial issues that emerged during the legislation of the new bankruptcy law from the aspects such as the principle of the legislation, criteria of bankruptcy, preservation or abolishment of policy-related bankruptcy, protection of the employees’ rights and interests of bankrupt enterprises, the creditors’ committee system, the trustee system, reorganization system to prevent bankruptcy, and the legal obligations of bankrupt, and so on. It also gives a comprehensive introduction to the innovation and modification of the new bankruptcy law.

From dynamic risk factors to causal processes: a methodological framework

ABSTRACT

It is becoming increasingly apparent that dynamic risk factors are unable to function as explanations of offending because they are composite constructs, which contain a mixture of putative causes, states of affairs, and problematic cognitive, affective, behavioural and social states associated with crime. In this paper we draw from psychopathology research and theory on the conception and classification of mental disorders to develop the Dynamic Risk Research Framework (DRRF). In our opinion, the assumptions and methodological tool associated with this framework can better focus research into the causes of offending by making use of the information provided by dynamic risk factors. A conceptual framework such as the DRRF can arguably translate this valuable information into deep, coherent explanations, and ultimately, more streamlined and precise intervention strategies.

中国反恐的国际视角是在关注和解决国内产生恐怖主义的原因基础上,应研究影响国内恐怖主义活动外部原因,总结国际联合反恐成效与经验,探索新形势下加强反恐国际合作的思路,在更加开阔的国际视野下开展中国反恐斗争,从而更有力地打击和防范针对中国的恐怖活动并更有效地履行中国反恐的国际义务。     

论俄罗斯宪法法院对公民基本权利的保障

宪法诉讼是现代保障公民基本权利最为有效的方式。在俄罗斯,履行宪法诉讼职能的机构是宪法法院。实践中,宪法法院主要依托宪法诉愿制度,适用蕴含比例原则的俄罗斯宪法第55条第3款作为审查基准保障公民基本权利。此外,宪法法院还常在判决中援引国际条约和欧洲人权法院判例,其目的是用先进的权利保障标准来要求和促进俄罗斯的公民基本权利保障。

董事勤勉义务的规定关系到董事的责任承担和公司的经营发展,董事的勤勉义务包括勤业义务、关注义务、适业义务,违反了这些义务就应承担相应的责任。在勤勉义务的判断标准上应注意主客观标准相统一,我国现阶段应适当提高对董事勤勉义务的要求,但应该重视董事勤勉义务中的主观因素的考察。我国应完善现行公司法中董事勤勉义务的规定和适用。
