Criminal Behavior: A Real Option Approach With an Application to Restricting Illegal Insider Trading

Traditionally, criminal behavior is analyzed within an expected utility framework. This paper offers an alternative model to analyze criminal behavior based on real option models. It is shown that all criminal decisions can be analyzed as real options, in a sense that they confer the possibility but not the obligation to commit a crime in the future. The criminal option model is a richer model compared to conventional economic models of crime, because it takes into account four additional variables. As such, the conventional economic analysis of crime is a special case of criminal option models. The criminal option model is then applied to the enforcement of illegal insider trading. Based on the six value-drivers of criminal options, an active management strategy can be developed for the criminal as well as for the legislator.

关于县市公安机关执法质量的调查与思考

严格执法与解决经费不足的关系

经费紧张一直是困扰公安执法工作的难点问题。乍看起来二者是一对不可调合的矛盾 ,通过不断的研究与实践 ,就会发现它们之间的关系是协调一致、相辅相成的 :如果真正做到了严格执法 ,就会增加公安机关的财政收入 ,就会解决经费不足的问题 ;反之 ,如果不严格执法 ,不仅公安机关经费问题解决不了 ,反而会因行政败诉赔偿造成公安经费的巨大损失。     

Paradoxical effects of law enforcement policies: the case of the illicit drug market

This paper presents a model of a vertically organized distribution network of illicit drugs. The key assumptions are costs imposed by law enforcement on drug sellers and the vertical relationship between trackers and retailers. We study the effects of a tougher drug law enforcement policy on wholesale and retail prices of drugs according to the identity of the pursued member of the distribution network, trafficker or retailer. We show that these effects are different according to the used law enforcement tool (probability of detection or sanction) and according to the seller who undergoes the law enforcement (retailer or trafficker). Moreover, results of tougher law enforcement can be opposite to a usual objective of the drug policy, namely, the decrease of the number of consumers. This model could partially explain the failure of the “war on drugs” in the United States in the 1980s.

端正执法思想、坚持执法为民是对公安机关和公安执法工作最根本的要求.目前,端正执法思想的革命带来了一些负面效应,我们应客观、科学地看待端正执法思想过程中出现的负效应,要在思想层面和操作层面双管齐下,采取积极有效的措施,尽量减少负效应,不断深化端正执法思想的革命,切实做到执法为民.

从2002年至今,学院成功培训了来自缅甸、老挝禁毒官员六期.通过学习,使受训学员了解目前毒品犯罪的形势,宣传中国禁毒方针,掌握如何采样和毒品检验的方法,认识毒品犯罪案件侦查的做法和有效措施,掌握查缉毒品的方法和手段以及禁毒、戒毒方法等,使学员能有针对性地提出毒品问题控制和预防的对策,为切实做到识毒、防毒和禁毒提供理论指导,提高禁毒执法水平与质量.
