This article investigates the United Kingdom’s membership of the European Union (EU). This examination considers how the EU has provided greater protective employment rights for workers, through provisions in the Treaty and various Directives, than had been achieved through the UK’s own legislative programme. However, these rights are often inaccessible due to governmental intransigence and a lack of awareness by workers of many employment rights. Most studies of academic patenting focus on the university as the unit of analysis. In contrast, we examine this phenomenon at the laboratory level. Based on a sample of 83 research laboratories of Louis Pasteur University (ULP, Strasbourg, France) from 1993 to 2000, we constructed a panel data set that allows us to discriminate between patents that are owned by the university and those that are owned by firms and other organizations but invented by faculty members. We use these data to estimate a patent production function and find that university-owned patents are more responsive to specific public funding, while non-university-owned patents are more responsive to industrial funding. Our results also highlight the importance to control for disciplinary and institutional differences, since they significantly affect the production of the different kinds of ULP patents.  相似文献

The constitutional future of the European Union (EU) has attracted many scholars in economics and political science to apply their knowledge on political institutions and propose concrete suggestions. We highlight that economists and political scientists proceed quite differently in this endeavour and suggest that, due to this, they also are exposed to different pitfalls. This article focuses on the UK government's proposal to incorporate the European Convention on Human Rights into UK law, and the consequences of incorporation for the individual in the context of education. The first part of the article explores the mechanisms proposed for bringing about incorporation, and stresses in particular the importance attached by the government to upholding the fundamental principle of the sovereignty of the UK Parliament. In this context it emphasises the government's decision to deny to the British courts the capacity to strike down legislative provisions as being incompatible with Convention rights. The second part of the article goes on to explore (highly selectively) a number of key areas in which incorporation of the ECHR has the potential to enhance individual rights in the field of education, including parental choice of school, collective worship and religious education, and aspects of the secular curriculum. The discussion emphasises strongly the likely significance of the UK government's reservation to the second sentence of Article 2 of the First Protocol to the ECHR. Broadly, the conclusion drawn is that the incorporation of the Convention will have only a very marginal impact on the reality of individual rights to education.  相似文献

Abstract

As international relations actors in the post-Second World War world, international organisations have played a significant role in the standardisation of global policy concepts during the 20th century, and humanitarian assistance has been no exception. While the study of the role of international organisations in shaping a dominant model of humanitarian aid has recently gathered pace, few historians have focused on different, less successful models and interpretations developed by other international organisations. Recently declassified Commonwealth Secretariat records show that discussions within the Secretariat and among member states regarding the potential objectives and scope of Commonwealth humanitarian assistance programmes took place as early as the 1960s, and continued throughout the following decades. This article provides an overview of the origin and evolution of the Commonwealth’s approach to humanitarian assistance since the 1960s. Its objective is to document this hitherto little known aspect of Commonwealth assistance policies, and, based on an initial literature and archival survey, to contribute to the identification of further research questions and gaps in this aspect of Commonwealth history. Although they are very different in nature and scope, the Commonwealth and the European Union share at least one common feature in so far as humanitarian assistance is concerned, namely their difficulty in reaching a consensual definition of it. By exploring the links and discrepancies between, as well as within, each organisation’s approach to humanitarian assistance, and by examining the initiatives of some of their member states, this paper seeks to highlight the plasticity of the definition of humanitarian assistance.  相似文献

This article traces how the development of regional law is linked to the state of regional integration in Africa. Given the prominent role European Union law plays in the functioning of the European Union, the question is posed whether there is similar scope for the development of ‘African Union law’, a term not established hitherto. Initially devoid from the necessary supranational elements required to adopt law that would automatically bind member states, the African Union is leaning towards a functionalist approach paving the way for transfer of sovereign powers to African Union institutions. It is argued that law-making capacity, be it through the activities of the Pan-African Parliament, the Peace and Security Council or the African court system, is a necessary requirement to accelerate the process of regional integration. African Union law will hold member states accountable to comply with international and continentally agreed standards on, inter alia, democracy, good governance and human rights.  相似文献
