Haben im Rahmen eines niederl?ndischen Scheidungsurteils die Ehegatten zwar rechtsgesch?ftlich vereinbart, auch die Miteigentumsgemeinschaft/Eigentümerpartnerschaft an einem in ?sterreich gelegenen WE-Objekt (samt benachbartem Baugrundstück) aufzuheben, den Erl?s zu teilen und hat sich die Bekl darin verpflichtet, das WE-Objekt dem Erwerber ger?umt zu übergeben, regelt dieses Rechtsgesch?ft zwar die Ausübung des schuldrechtlichen Aufhebungsanspruchs jedes Ehegatten, stellt aber kein nach § 352 EO vollstreckbares Aufhebungsurteil mit Teilungsanordnung dar, das der Kl mittels R?umungsklage gegen die Bekl verfolgen k?nnte. Vielmehr muss der Kl ein Zivilteilungsurteil erwirken, das dann zwangsvollstreckt werden k?nnte. Selbst wenn die Bekl den vereinbarten Verkauf hintertrieben h?tte (was dem Sachverhalt jedoch nicht zu entnehmen ist), h?tte der Kl kein alleiniges Verwertungsrecht, da ihm ja auch nicht der Alleinbesitz am WE-Objekt zusteht, sondern blo? das Recht, die getroffene Teilungsvereinbarung im Klagsweg durchzusetzen. Auch die vertragliche R?umungszusage der Bekl stellt lediglich klar, dass sie kein weiteres Benützungsrecht am WE-Objekt geltend macht und dieses daher an den Erwerber übergeben werde. Soweit sich der Kl auf doloses Zusammenwirken der Bekl mit einem Dritten beruft, l?st dieses Verhalten h?chstens Schadenersatzansprüche gem § 1295 Abs 2 ABGB, jedoch keine R?umungsverpflichtung der Bekl aus.  相似文献

Pulmonary edema is a common finding in fatal methamphetamine intoxication. However, the underlying mechanism remains poorly understood. This study investigated the molecular pathology of alveolar damage involving pulmonary edema in forensic autopsy cases. Seven candidate reference genes (RPL13A, YWHAZ, GUSB, SDHA, GAPDH, B2M, and ACTB) were evaluated in the lung by the geNorm module in qBaseplus software. RPL13A, YWHAZ, and GUSB were identified as the most stable reference genes. Using these validated reference genes, intrapulmonary mRNA expressions of matrix metalloproteinases (MMPs), intercellular adhesion molecule‐1 (ICAM‐1), claudin‐5 (CLDN‐5), and aquaporins (AQPs) were examined. Relative mRNA quantification using TaqMan real‐time PCR assay demonstrated higher expressions of all markers except for AQP‐5 in fatal METH intoxication cases. These findings suggested alveolar damage and compensatory response in fatal METH intoxication cases. Systematic analysis of gene expressions using real‐time qPCR is a useful tool in forensic death investigation.  相似文献

Falsified drugs are a growing problem and a great threat all over the world. Searching for easy, fast, not expensive and reproducible methods for identification of active pharmaceutical ingredients (APIs) is an important issue. The application of ATR-IR technique for identification of phosphodiesterase-5 inhibitors (PDE-5i) in falsified products from the Polish market has been demonstrated. Furthermore, the strategy of confirmation of the product's originality in a quick and easy way has been developed. The advantages of this application are: exceptional simplicity, very short measurement time, high selectivity in relation to structurally similar substances and almost no sample preparation. After validation, developed strategy has been successfully introduced into routine analysis.  相似文献

Synthetic tryptamines have gained popularity for their hallucinogenic properties, unscheduled status, and availability from “head shops” and through the internet. Here, we present a case of synthetic tryptamine‐induced delirium secondary to 5‐MeO‐DALT ingestion in a previously healthy young male. 5‐MeO‐DALT led to the hospitalization of our patient after ingestion of a standard dose, presenting with extreme agitation, tachycardia, diaphoresis, and combativeness leading to physical restraint and intravenous sedation. A search of PubMed, Ovid, and Google Scholar for keywords of “5‐MeO‐DALT,” “5‐methoxy‐N,N‐diallyltryptamine,” or “Lucy‐N‐Nate” found no case reports or clinical articles in the literature. Rapid emergence and commercialization of this novel synthetic tryptamine 5‐MeO‐DALT points to the importance of health care and forensic professionals keeping abreast of the latest drugs of abuse and their clinical features. The authors hope this report leads the way in disseminating the potential risks associated with unscheduled and unregulated substances, synthetic tryptamines such as 5‐MeO‐DALT in particular.  相似文献

The Government has recently abolished Imprisonment for Public Protection, a highly controversial form of indeterminate sentence. Yet, at the time of writing, nearly 6,000 inmates are still serving such sentences, all of whom will have to convince a Parole Board that detention is no longer necessary for the protection of the public. This paper evaluates recent European Court of Human Rights jurisprudence which considered the legality of post‐tariff detention in the absence of suitable rehabilitative provision. The Court held that there would be a violation of Article 5(1) if prisoners were held without access to such provision. Consideration is given to the implications of this ruling for those serving such sentences and, more broadly, to the impact it may have on risk‐based sentencing policies.  相似文献

ABSTRACT

The decarbonisation of the global economy in response to the climate crisis and the fourth industrial revolution, featuring artificial intelligence (AI) and 5G networks (massively accelerated in response to the coronavirus pandemic), has triggered a race to secure uninterrupted access to critical raw minerals (CRMs) that are indispensable inputs for high-technology applications. Moreover, China’s Belt and Road Initiative, which unites Eurasia and Africa and loops in South America into a seamless space of trade, infrastructure and digital connectivity, challenges the dominance of traditional industrial powers (the United States, the European Union and Japan) and requires critical minerals. Rare earths, lithium and cobalt – among the most critical of the CRMs – are found in high geographic concentration, creating hotspots of contention, especially in unstable parts of the world. As economic transformations accelerate, securing access to these materials will both impact and help shape geopolitics in the years to come.  相似文献

以重组质粒pET-fliC和pUC57-M2e2为模板,通过重叠PCR将M2e2基因插入fliC的高变区域,构建嵌合鞭毛基因片段fliC/M2e2。将fliC/M2e2片段插入原核表达载体pET30a+,获得重组质粒pET-fliC/M2e2,将其转化鼠伤寒沙门氏菌LB5000,获得重组菌LB5000(fliC/M2e2)。应用P22噬菌体转导技术,将fliC/M2e2基因导入都柏林沙门氏菌SL5928的基因组中,经生化血清学鉴定、动力学测定、透射电镜观察、Western-blot分析,将阳性转导菌命名为SL5928(fliC/M2e2)。提取重组菌鞭毛蛋白fliC/M2e2作用HEK293-mTLR5细胞,能刺激细胞分泌IL-8。将fliC/M2e2通过皮下注射途径免疫C3H/HeJ小鼠,50μg/只。结果显示,二免后第14天,fliC/M2e2鞭毛蛋白免疫组的血清抗体效价与对照组之间呈现显著性差异(P<0.05)。ELISPOT结果表明,在脾细胞中,fliC/M2e2鞭毛蛋白免疫组检测到较高水平的IFN-γ和IL-4分泌细胞,且免疫应答以Th1型为主。结果表明,构建的fliC/M2e2嵌合基因能够在沙门氏菌中表达,重组嵌合鞭毛蛋白fliC/M2e2能激发机体针对M2e表位的体液免疫应答和Th1型细胞免疫应答。  相似文献

POPULATION: Two Tibeto-Burman-speaking Adi tribal populations of Arunachal Pradesh, India, Adi Pasi ( n =121) from Upper Siang district, and Adi Minyong ( n =33) from East Siang district were analyzed for polymorphisms at 15 microsatellite loci. The populations belong to Mongoloid ethnicity and are of special significance in genetic studies due to their small population size, relative isolation in remote hilly areas, and traditional subsistence patterns.  相似文献
