European national news

The regular article tracking developments at the national level in key European countries in the area of IT and communications – co-ordinated by Herbert Smith LLP and contributed to by firms across Europe. This column provides a concise alerting service of important national developments in key European countries. Part of its purpose is to compliment the Journal's feature articles and briefing notes by keeping readers abreast of what is currently happening “on the ground” at a national level in implementing EU level legislation and international conventions and treaties. Where an item of European National News is of particular significance, CLSR may also cover it in more detail in the current or a subsequent edition.

Conservation and modern information technologies: The global register of migratory species (GROMS)

Abstract

The present paper reviews the state of knowledge of migratory species protected under the Bonn Convention (Convention on the Conservation of Migratory Species of Wild Animals) and presents first results from the “Global Register of Migratory Species” (GROMS). GROMS summarises our knowledge on migratory species within one relational database in combination with a geographical information system (GIS). GROMS will reveal information deficiencies, support the Convention on the Conservation of Migratory Species of Wild Animals, and contribute to the Clearinghouse Mechanism under the Convention on Biological Diversity. At present, GROMS contains 412 species distribution maps in GIS format. As an initial example of the potential of GIS‐analysis, GIS‐maps of birds and mammals were intersected with administrative borders, and the number of species was calculated for each province. The resulting map shows a high diversity in temperate regions, which is in contrast to maps that usually show most “biodiversity hotspots” to be in the tropics. Consequences for conservation policies are discussed and future prospects for GIS analysis are outlined.     

‘Catching’ and ‘Targeting’: Risk‐Based Policing,Local Culture and Gendered Practices

The aim of this article is to explore cultural and practical aspects of the growing use of information and communication technology (ICT) in policing. By using empirical research on policing in Norway, the focus will be on how ICT is used as a crime prevention instrument in everyday police work and culture. The transition, which the new technologies mediate, will be explored by focusing on concepts of risk and materialization of risk‐based policing at the practice level in two cases: 1) a special unit fighting serious and organized crime utilizing proactive policing methods, police informers, crime profiling and databases, and 2) a police station focusing on low‐level crime by using a problem‐oriented policing model, transmitting responsibility for personal security onto identified ‘problem‐owners’.1 ‘Problem‐owner’ is a notion used by the police in the two cases. It is referring to the POP‐model, and whom they identify as important to participate in the risk‐management. According to Wright (: 121): “Partnership refers to a purposeful relationship between the police and the public or between the police and other agencies in the field.” Based on an examination of risk phenomena as contextual, embedded in practice and cultural settings, various stories about risk management will be told. The stories reflect different control strategies in the crime control discourses, and point to how risk‐based technologies are shaped and adapted in occupational culture and practice. The article illuminates the importance of studying the empirical complexity ICT is used in, and looks towards, to paraphrase O'Malley and Palmer (), ‘firewalls of resistance’ in the local occupational culture, that are preventing full integration of risk tools.     

世界政治“平靖进程”的技术变迁支撑

二战后,世界政治经历了"平靖进程",具体体现为:"大国罕有战事""国家罕有消亡"。本文融合国际政治经济学与国际安全研究,展示二战后的技术变迁改变了大国的"意愿"与"能力",支撑了世界政治新变化。在马尔萨斯时代,由于技术水平低下,生存物资稀缺,生存保障匮乏,人类面临持续的安全难题。二战后,技术发展影响了当代大国的"意愿"与"能力",让世界政治呈现新变化。技术变迁给大国提供了更为丰富的选择,让大国使用武力征服的意愿降低;同时,随着技术变迁,尤其是在"核革命"后,大国确保自身安全的能力更强,使得"大国罕有战事"。得益于技术变迁,大国利益半径扩大,即便距离遥远地域的变化也与自身息息相关,大国保障遥远海外利益的意愿提升;同时,技术变迁扩大了大国的权力投射,让世界各国,尤其是大国保障体系稳定的能力更强,致使"国家罕见消亡"。随着技术变迁,世界政治已呈现出很多与传统智慧不同的方面,孕育国际交往的新理念。     

作为劳动基准的个人信息保护

劳动者的个人信息保护问题存在特殊之处,具体表现为资强劳弱和人格从属性背景下知情同意规则的失灵、工作数字化后劳动者被透视和被操控的风险、有组织生产的合作关系中个人信息处理的需要,因此不能完全适用《个人信息保护法》的一般规则。劳动基准法已经纳入立法规划,在其中就劳动者个人信息保护做专门规定,这是对数字时代人权保护新挑战的回应,对于其他劳动基准的实现也有重要意义。在劳动关系中仅遵循私法路径不足以保护个人信息,还需要配备公权力保障,劳动基准法的双重保护机制也契合了这一需求。作为劳动关系中保护个人信息的特别法,劳动基准法的相应条款应该考虑如何对一般规则进行调整,包括限制知情同意规则的适用,满足人力资源管理的正当需求,修改删除权、可携带权和自动化决策条款,协调主管机构、救济方式和法律责任。由于"必需"是一个语境依赖型概念,将来还应该通过配套文件来规制工作场所的视频监控等典型的应用场景。     

Quo vadis information society? Notification of draft rules on e-services in the EU

From its inception the European legislator has adopted a mixed approach to the regulation of a novel and complex phenomenon of the Internet based commerce. The idea of harmonisation or approximation of laws has been accompanied by a parallel process of monitoring of draft laws pertaining to e-commerce, known as the notification procedure under 98/34/EC directive related to information society services. The aim of this paper is to analyse the notification principle in the light of the Notification Directive as well as the practice of states as evidenced by data gathered in a database of submitted drafts.     

Edem v. The Information Commissioner and The Financial Services Authority [2014] EWCA Civ 92

From time to time the Court of Appeal feels the need to steer inferior courts and tribunals away from an over-enthusiastic application of a particular direction of travel signposted by its own previous decisions. In the Edem judgment, published on 7 February 2014, the court has taken the opportunity to restrict significantly the application of its decision more than a decade ago in Durant v. Financial Services Authority, ¹ a case that has been relied on by many commercial data protection practitioners to deny subject access or the wider application of the Data Protection Act 1998 on the grounds that the data were not personal in that they did not relate to the individual in question even though the individual's name appeared as part of the data.
