Asian Criminology – Challenges, Opportunities, and Directions

Despite considerable advances in the field of criminology in Asia over the past few decades, the pace of growth has been quite slow compared with the rapid development of the field in North America and Europe. This paper discusses key features of the Asian context as they are related to the development of criminology in Asia. The paper examines the major challenges that Asia’s diverse culture, legal traditions, crimes, and crime control pose for development of criminology in Asia. It also discusses the opportunities afforded by the Asian context. The paper proposes general strategies in response to the challenges. The author suggests the importance of moving towards a unified paradigm of Asian Criminology. The Asian Journal of Criminology aims to play an instrumental role in this process of advancing Asian criminology.     

证据科学的走向：国际视野与中国语境——对证据问题研究领域的初步分析

我国证据科学的出现既是英美证据法学知识传统发展演变的结果,也是回应国内司法证明领域转型的一个重要发展。证据科学的本质是司法证明领域诸多学科之间在应对新的时代问题所作出的一系列变动和整合,而变动和整合的方向则取决于社会需求和司法证明领域多学科之间的竞争。我国司法证明领域的转型所提出的一系列问题为司法证明领域诸多学科的互动提供了最基本的动力。中国证据科学应该以这些问题为核心,在解决问题的过程中形成中国证据科学的基本格局。

International Hague Network of Judges: Significance in Implementation of the 1980 and 1996 Hague Conventions on the Civil Aspects of International Child Abduction

The 1980 Hague Convention on the Civil Aspects of International Child Abduction (“the Convention”) provides for the prompt return to the country of habitual residence of children taken by a parent from one country to another. It was created to address the threshold problem in such cases, that is, which court should determine the rights of the parties involved. In a case under the Convention, the court's concern is which country is the country of habitual residence and practical aspects of the return to ensure the safety of the child and the taking parent. This article will discuss the formation of the International Hague Network of Judges (IHNJ), why it is crucial in the advancement of the Convention's goals, and, specifically, what it does to educate judges and facilitate communication between judges, and how the IHNJ can facilitate the return, including providing information on services, procedures, and protections offered in the countries of return.     

“The big sleep: Elucidating the sequence of events in the first hours of death to determine the postmortem interval”

Recent developments on postmortem interval estimation (PMI) take an advantage of the autolysis process, pointing out to the analysis of the expression of apoptosis and autophagy genes towards this purpose. Oxidative stress plays a role in this signaling as a regulatory mechanism and/or as a consequence of cell death. Additionally, melatonin has been implicated on apoptosis and autophagy signaling, making melatonin a suitable target for PMI determination. The aim of this study was to investigate the early PMI through the analysis of the expression of autophagy genes as well as oxidative stress and melatonin receptor. Our results demonstrated a rapidly increased on the expression of autophagy genes according to the expected sequence of events, then a marked decrease in this expression, matched with the switch to the apoptosis signaling. These results revealed potential candidates to analyze the PMI in the first hours of death, helping to estimate the time-since-death.
