Internet auction fraud: The evolving nature of online auctions criminality and the mitigating framework to address the threat

Online auctions have emerged as one of the popular segments of e-commerce. The popularity of this technology-aided business model is evidenced by the continuous growth of eBay and other e-auction markets. However, this growth of online auctions has also led to a corresponding rise in deception and online criminal activity. This paper presents the findings of an original experiment undertaken to examine the evolving criminality associated with eBay auctions. The article examines eBay’s existing fraud prevention framework and evaluate its effectiveness in mitigating the risk. The research has identified foundation of eBay’s fraud problem - the inability of eBay’s fraud prevention architecture to identify and eliminate rogue traders with obscure identity and questionable reputation. The authors have proposed a proactive and holistic e-fraud prevention typology to enhance trader’s authentication to fight online auction fraud.     

网络环境下青少年心理健康教育研究

网络的推广与普及给青少年的身心带来了巨大的影响,它在拓宽青少年认知结构空间、促进其情绪宣泄和培养青少年多元价值观的同时,也容易导致青少年认知能力迷失、人际关系淡漠、生活意志丧失、抑郁、焦虑、敌对等一系列的心理问题。而我国当前在青少年网络心理问题的治疗过程中,存在着禁止青少年上网、只进行德育训诫、重治轻防和治疗人员专业水平较低等问题。提高青少年心理健康教育的效果,应建立家庭、学校和社会三位一体的教育和预防机制,开展网络心理教育,注重法制教育、德育教育与心理教育的有机结合并提高青少年网络心理疾病治疗人员的专业化水平。     

“人肉搜索”浅析

“人肉搜索”是一种大量网民参与、互动的信息搜索方式。“人肉搜索”作为转型期中国社会的特定产物尽管存在着诸多不足,但其维护正义及公益性本质为其自身发展提供了一个广阔前景。“人肉搜索”行为只要没有侵犯个人隐私,就不需要用刑法加以规制,而应完善网络法规对“人肉搜索”进行规范和引导。

上网是如今相当部分青年人生活的重要内容.本文主要从网民上网目的、经常查阅的信息,使用的网络服务功能等方面概述了网民的网上行为特征,提出了今后需要加强研究的问题.     

电子商务中知识产权纠纷的可仲裁性

现代社会中电子商务活动日渐普遍,电子商务中知识产权的纠纷也逐渐增多。具体到知识产权纷争的解决途径,除司法审判和行政查处外,仲裁将成为解决知识产权纠纷的第三条有效途径。电子商务知识产权纠纷的可仲裁性,不但有程序法和实体法的依据,也有现实社会发展的紧迫需要。电子商务中涉及私权处分的知识产权纠纷,通过传统的书面仲裁协议或者在网络上明示并经交易对方认可的仲裁条款,都将赋予仲裁机关管辖权,使得该知识产权纠纷具有可仲裁性。在新的历史条件下,仲裁机构应当与时俱进地加以改革。     

‘Customary internet-ional law’: Creating a body of customary law for cyberspace. Part 2: Applying custom as law to the Internet infrastructure

The shift in socio-economic transactions from real space to cyberspace through the emergence of electronic communications and digital formats has led to a disjuncture between the law and practices relating to electronic transactions. The speed at which information technology has developed require a faster, more reactive and automatic response from the law that is not currently met by the existing law-making framework. This paper suggests the development of special rules to enable Internet custom to form legal norms to fulfill this objective. In Part 2 of this article, I will construct the customary rules to Internet law-making that are applicable to electronic transactions by adapting customary international law rules; apply the suggested rules for determining customary Internet norms and identify some existing practices that may amount to established norms on the Internet, specifically practices relating to the Internet Infrastructure and Electronic Contracting.     

Asian Male Domestic Violence Victims: Services Exclusive for Men

The main reasons abused men do not seek social services include their strong endorsement of social/cultural values and avoidance of gender role conflict. Through internet-based service connections, we did not find sources in Asia, Australia, or New Zealand that advertised programs exclusively for male victims of domestic violence (DV). Nine social services in Hong Kong and Singapore describe their work with men in DV situations, but the main focus is “men as perpetrators.” Targeting men as victims, 32 sources in Canada, the United States, and the United Kingdom describe services designed especially for male DV victims. Findings demonstrate that services for male victims must address such factors as secretiveness, cultural values, masculine identity, tolerance, shame, and loss of face.
