转变行政管理思路 发展市场经济制度——皖粤黔川稳增长和转方式调结构调研报告

2012年经济增长下行压力加大,各地方采取了积极有效应对措施,实现经济平稳发展。该文根据对皖粤黔川四省的调研,在肯定成绩的同时,也找出了一些存在的困难和问题,并从长期困扰中国社会主义市场经济发展的思维习惯、管理体制、政策法规和运作路径入手,提出转变行政管理思路、改善行政工作方法等对策建议。     

关于长三角区域的国际科技合作发展的研究

长三角区域是中国国际科技合作最为成功的地区之一。该文首先介绍长三角区域的国际科技合作现状,然后探讨长三角区域在国际科技合作过程中遇到的一些问题,最后提出促进长三角区域国际科技合作的意见和应对措施。     

内地与港澳打击跨境网络犯罪警务合作研究

内地和港澳之间的跨境网络犯罪主要包括通过网络实施的传统非跨境犯罪、传统跨境犯罪以及新型经济犯罪。这些网络犯罪主要以牟利为主,数额巨大;犯罪形式多样,有组织化;犯罪成本小,打击难度大。为了惩治跨境网络犯罪,内地和港澳警方采取了一系列合作措施并取得了一定成效。但是,由于内地和港澳三地在法律、技术和协作程序方面存在缺陷,三地警务合作仍然面临挑战。深化三地警务合作必须缩小各方的立法差距,增强对网络犯罪的调查、取证技术能力,建立跨境网络犯罪的协查机制。     

Shifting borders: Islamophobia as common ground for building pan-European right-wing unity

ABSTRACT

In recent years, Islamophobia has become a useful tool for right-wing parties to mobilize electors in many European nation-states. The general xenophobic campaigns of the 1980s have given way to Islamophobia as a specific expression of racism. It is not only the new incarnations of right-wing populist parties that are making use of Islamophobic populism, but also right-wing extremist parties, whose traditions hark back to fascist or Nazi parties. This development appears unsurprising, as Islamophobia has somehow become a kind of ‘accepted racism’, found not only on the margins of European societies but also at the centre. Another interesting concomitant shift is the attempt by such parties to gain wider acceptance in mainstream societies by distancing themselves from a former antisemitic profile. While the main focus on an exclusive identity politics in the frame of nation-states previously divided the far right and complicated transnational cooperation, a shared Islamophobia has the potential to be a common ground for strengthening the transnational links of right-wing parties. This shift from antisemitism to Islamophobia goes beyond European borders and enables Europe's far right to connect to Israeli parties and the far right in the United States. Hafez's article explores this thesis by analysing the European Alliance for Freedom, a pan-European alliance of far-right members of the European parliament that has brought various formerly antagonistic parties together through a common anti-Muslim programme, and is trying to become a formal European parliamentary fraction in the wake of its victory in the European elections in May 2014.     

合作型信任:政府与第三部门合作关系的基础

进入21世纪后,随着社会事务的复杂化,政府与第三部门之间形成了密切的合作关系,通过相互合作来进行社会管理。合作是以信任为基础的,政府与第三部门合作也应以合作型信任为基础。合作型信任与契约型信任、习俗型信任相比更有利于政府与第三部门的合作。为此,通过建立公共承诺机制,构建平等的对话机制,完善制度体系以及培育相互信任的社会文化来构建合作型信任。     

论惩治恐怖活动犯罪的国际刑事司法合作

有效防治恐怖活动犯罪离不开国际刑事司法合作。出于打击恐怖活动犯罪的目的,国际社会对于恐怖活动犯罪排除适用政治犯不引渡原则。打击恐怖活动犯罪还需在联合侦查、情报交流与信息合作、案件文书送达等方面开展司法协助。在国际刑事司法协助中有必要建立刑事诉讼移转管辖的司法合作制度,以便于各国之间加强反恐合作,更加有效地打击恐怖活动犯罪。     

Domestic drivers of transgovernmental regulatory cooperation

Transgovernmental cooperation among domestic regulators has generated considerable interest among scholars and policymakers. While previous research has focused on describing such regulatory networks, we know very little about what drives individual jurisdictions to join them. The question of membership is important because it determines the reach of rules and standards promulgated by a given network, and because it is logically prior to understanding the rulemaking dynamic within a network. We develop a set of hypotheses that highlight the role of domestic political factors in shaping network membership. Our empirical analysis, using an original data set for transgovernmental cooperation in securities and insurance regulation, finds that the institutional form of domestic market regulation, as well as the relative domestic weight of the industry, are closely correlated with membership. All else equal, jurisdictions with independent regulatory agencies and those where the industry in question represents a large share of gross domestic product are much more likely to join the respective network than jurisdictions without these characteristics. The paper underscores the important interactions between domestic and international factors for informal cooperation, an issue that has become increasingly central to global governance.     

对党际合作下协商民主的思考

协商民主作为中国特色社会主义民主的重要形式,是社会主义政治文明发展的必然趋势。两个5号文颁布以来,我国党际协商民主产生了很大突破,取得了诸多成效。但是,从政党制度的高度看,我国党际协商还存在一定问题。多渠道解决这些问题是推进社会主义协商民主的客观要求。     

接轨:挑战与机遇的来临——论加入《联合国反腐败公约》后中国刑事法制的自我调整

我国现行反腐败刑事法律制度与《联合国反腐败公约》存在一定的差距。从实体法方面看 ,该公约对诸多行为的犯罪化态度与我国现行刑法规定很不一致 ;从程序法以及证据方面 ,该公约提出的诸多要求 ,需要我国现行法律积极回应 ;从反腐败国际合作看 ,如何加强国际合作 ,创造稳定的国际合作机制 ,对于我国今后反腐败工作的开展具有重要意义。该公约所建立的诸多机制 ,为我国积极预防和遏制腐败犯罪提供了很大的机遇 ,同时也对我国现行刑事法制提出了挑战。如何根据我国实际与该公约的规定相衔接 ,是我国目前需要认真解决的一大课题。     

朝贡贸易制度论

朝贡贸易是存在于古代中国——东亚和东南亚的一种地区合作制度,贸易成为相互联系的手段,目的是维系地区关系的和谐与秩序。它是中国传统文化的—个重要组成部分和外化,是中国古代外交思想的体现。它在有效运作的同时,也存在着因为制度缺陷而引发的矛盾和冲突。本文从历史学与国际关系学相结合的角度,客观评价了朝贡贸易制度的积极作用和不足之处。
